3 July 2015 Daily Human Rights Report

(07/017) Worker Death…

Worker’s Health and Job Safety Assembly announced on 3 July 2015 that at least 147 workers died in June 2015 during work accidents due to untaken security measures. At least 794 workers died in first 6 months of 2015.

(07/018) Nihat Kazanhan Case…

Cizre (Şırnak) Heavy Penal Court No 1 continued on 2 July 2015 to hear the case launched in connection with the killing of Nihat Kazanhan (12) by the police on 14 January 2014 in Cizre district of Şırnak.

The police officers who testified at hearing as eyewitnesses stressed that they did not see the remanded police officer M.N.G. shooting Nihat Kazanhan. But the friends of Nihat Kazanhan testified to the effect that remanded police officer M.N.G threatened them to death.

The court rejected the demand for the arrest of the defendants U.İ., H.V., O.Ç. and G.T., and adjourned the hearing to 2 October 2015.

The indictment wants the defendants U.İ., H.V., and M.N.G. to be sentenced for “intentional killing”, the defendants O.Ç. and G.T for “not reporting a crime”.

(07/019) Lütfullah Tacik Case…

According to the news appeared in the press on 2 July 2015, a court case was launched against the police officers Serdar Oran and Hasan Özgür Özdemir in connection with the killing of Afghani refugee Lütfullah Tacik (17) under beatings on 31 May 2015 in Van.

Van Heavy Penal Court No 2 will start to hear the case on 19 November 2015. The indictment wants the police officer Serdar Oran to be sentenced for “simple wounding and causing death by intentional wounding” and the police officer Hasan Özgür Özdemir for “misconduct of duty”.

Lütfullah Tacik (17) who was detained by the soldiers on 16 May 2014 while trying to pass the border illegally in Iğdır and transferred to the Repatriation Centre of the Foreigner’s Department in Van on 26 May 2014 to be deported was beaten by a police officer for lying about his age.

Lütfullah Tacik had cerebral haemorrhage when the police officer Serdar Oran working at Illegal Migration and HumanTrafficking Department of Foreigner’s Department beat him. He was hospitalised, but died on 31 May 2014.

(07/020) Verdict Quashed in Torture Trial…

Öztürk Aladağ (28) was beaten by the police in a side street nearby Tarlabaşı Avenue in Beyoğlu during the police intervention against the 1 May celebrations in İstanbul on 1 May 2009. The video recording of the incident shot by an amateur was revealed after a while and appeared in the media.

Öztürk Aladağ made an official complaint against the security forces relying on the video recording and medical report given to her. And Public Prosecutor in İstanbul combined on 13 May 2010 the complaint with another one by Naciye Kaplan who was dragged on the ground by the police before being detained and launched a court case against 5 police officers on 30 June 2010 at the Bakırköy (İstanbul) Heavy Penal Court no 12. But the Public Prosecutor did not indict Anti-Riot Police Branch Director Gökhan Özsavaş who was the chief of the police officers.

Öztürk Aladağ’s lawyer Meral Hanbayat objected and the court revoked the decision. Gökhan Özsavaş testified during the investigation to the effect that he was not in Beyoğlu and he could be the one who ordered excessive use of force. But the ruled that the chief also committed the crime of torture by allowing torture on the grounds that he did not interfere the police officers despite the possibility of torturing.

İstanbul Heavy Penal Court No 18 concluded on 24 December 2013 to hear the case against police officers and chief police officer Gökhan Özsavaş and acquitted the defendants for lack of evidence for torture.

According to the news appeared in the press on 2 July 2015, 8th Penal Chamber at the Court of Cassation concluded to deal with the appeal case and quashed the verdict by majority of votes for “inadequate inspection”.

The Penal Chamber ruled that the court should have examined recent photographs of the defendants to compare with the video recording of the incident to identify the perpetrators. The Chamber also decided that the court should have asked the Security Directorate for the footages of the victims recorded in detention centre to be examined before the examination of evidences.

(07/021) Prisoner Died…

Rear Admiral Cem Aziz Çakmak who was convicted in Sledgehammer Case and incarcerated in Silivri (İstanbul) L-type Prison was temporarily on 1 February 2014 for upon a medical report given by Forensic Institute. Cem Aziz Çakmak died on 3 July 2015. He was suffering from lung cancer and was under treatment in İstanbul at Yedikule Chest Diseases Hospital since his release.

(07/022) Pressures in Prisons…

According to news appeared in the press on 2 July 2015 based on a letter sent by Cafer Koç from Silivri (İstanbul) F-type Prison No 9, the prisoners were beaten before search and subjected to torture in isolation cells.

The guards and soldiers wanted to search the cells on 24 June 2015. When the prisoners objected the search, they were handcuffed from behind and taken to isolation cells. The prisoners were beaten there for minutes.

(07/023) Condition of Prisoners…

According to the news appeared on the press on 2 July 2015, Cengiz Sinan Halis Çelik incarcerated in Metris (İstanbul) R-type Prison for being convicted in a PKK case was transferred back to Silivri (İstanbul) F-type Prison No 9 recently without his demand. He was under treatment for suffering from epilepsies and bladder cancer.

(07/024) Condition of Prisoners…

According to the news appeared in the press on 2 July 2015, Hasan Çetin incarcerated in Alanya (Antalya) L-type Prison was not given a medical report by the Forensic Institute certifying his helath condition. He has a medical report certifying that he is 73% disabled for having mental illness, but he was not released from prison on the grounds that the Forensic Institute did not provide a medical report on his condition.

(07/025) Hunger Strike Intervened…

The police conducted an operation against the members of People’s Front (Halk Cephesi) on 3 July 2015 in Küçükçekmece district of İstanbul. The activists were on hunger strike in a public park with the demand of securing justice in Hasan Ferit Gedik case. One person was detained during the intervention.

Hasan Ferit Gedik was killed on on 30 September 2013 during the armed attack by drug dealers against the members of People’s Front in Gülsuyu quarter of Maltepe district in İstanbul.

(07/026) 1 May Demonstrators on Trial…

Çağlayan (İstanbul) Heavy Penal Court No 4 started on 2 July 2015 to hear the case against Revolutionary High School Students (DEV-LİS) member Semih Kundakçı who was detained and arrested in accordance with the new Security Law. The case was launched for taking part in 1 May demonstrations in İstanbul.

After the identification and testimony of the defendant and screening of the video recordings of the incident, the court decided to release the defendant to be tried without remand and adjourned the hearing to 10 November 2015.

(07/027) Detentions and Arrests…

A.T. (17), Azad Yıkar (23) ve Kenan Turgay (28) who were detained during house raids in Bismil district of Diyarbakır were arrested on 2 July 2015 on the allegations of “being member of an illegal organisation”.

Yunus Ekmen who was one of the 2 persons detained during house raids in Diyarbakır was arrested on 2 July 2015 on the allegations of “being member of an illegal organisation”.

(07/029) House Raids in Batman…

Yusuf Yalçın who was among 5 persons detained during house raids on 1 July 2015 in Batman on the allegations of “taking part in unlawful demonstrations on various dates” was arrested on 2 July 2015 on the allegations of “being member of an illegal organisation”.

(07/030) House Raids in Gaziantep…

The police conducted house raids on 2 July 2015 in Gaziantep and detained 5 persons. The reason of the operations was not disclosed.

The police conducted house raids on 2 July 2015 in İdil district of Şırnak and detained 5 persons. The reason of the operations was not disclosed.

(07/032) House Raids in Adana…

The police conducted house raids on 2 July 2015 in Adana and detained 10 persons on the allegations of “being member of an illegal organisation”.

(07/007) Torture and Ill-treatment in Custody…

4 children who were detained when the villagers staged an action to protest in the dispatching soldiers on the border on 29 June 2015 in Roboski village of Uludere district in Şırnak were reportedly subjected torture in custody. The children were beaten with truncheons; there were reportedly traces of beatings and bruises on the bodies of children.

(07/008) Protesters on Trial for Putting Up Placard…

Kayseri Penal Court of First Instance No 15 concluded on 1 July 2015 to hear the case against People’s Republican Party (CHP) Chair for Kayseri province Mustafa Ayan, CHP Chair for Melikgazi district Asef Türkdönmez, youth wings members Deniz Can Demir, Onur Karabulut, Emeç Aksoy Parlak, Halil Can Öz, Seçkin Akıncı ve Ahmet Nazif Yüce launched in connection with a placard put up on the building of CHP premises in Kayseri. There were photographs of 4 former ministers as a reference to bribery and corruption allegations.

After the testimonies of the defendants, the court acquitted the defendants on the grounds that the placard was within the limits of freedom of expression, the defendants and the persons on the placard were politicians and such interactions do not constitute crime. The indictment wanted the defendants to be sentenced according to the Article 125 TPC for “insulting public officers”.

(07/009) March Intervened in İzmir…

The police prevented members of Democratic Youth Federation (Demokratik Gençlik Federasyonu – DEM-GENÇ) who wanted to stage a march on 1 July 2015 in Karabağlar district of İzmir to protest in the drug use and drug dealers. 6 persons were detained during the intervention.

(07/010) House Raids in Batman…

The police conducted house raids on 1 July 2015 in Batman and detained 5 persons on the allegations of “taking part in unlawful demonstrations on various dates”.

(07/011) Medical School Student on Trial…

Diyarbakır Heavy Penal Court No 4 continued on 1 July 2015 to hear the case against Esra Yakar launched on charges of “being member of an illegal organisation”.

Esra Yakar went to Kobanê’ to deliver medical service to YPG/YPJ militants when she was student at Dicle University Medical School and wounded during the armed clashes with IS/ISIS. She was wounded at her right eye and taken to a hospital in Ankara for treatment. She was arrested in the hospital and sent to Sincan Women’s Prison after the completion of treatment. The court released the defendant at the previous hearing of the case on 5 March 2015.

She testified at the hearing and his father appeared as witness. After the Public Prosecutor’s opinion as to the accusations, the court adjourned the hearing to later date for final decision.

(07/012) House Raids in Mardin…

The police conducted house raids on 1 July 2015 in Nusaybin district of Mardin and detained 11 persons. The detainees were reportedly subjected torture during detention. The reason of the operation was not disclosed relying on the confidentiality decision on the operation.

(07/013) House Raids in Ankara…

The police conducted house raids on 1 July 2015 in Ankara and detained 4 persons. The reason of the operation was not disclosed.

(07/014) House Raid and Hate Crime in Edirne…

Some 700 police officers conducted house raids on 1 July 2015 in Keşan district of Edirne as a part of “Peace Operation” and detained 44 persons including Trace Roma Association Federation Chair F.S. After the operation, some 200 police officers marched in the neighbourhood shouting the slogans “Police give peace and safety” and “How happy is he who says I’m a Turk”.

The police conducted house raids on 1 July 2015 in Diyarbakır and detained Uğur Turan and Yunus Ekmen. The reason of the operation was not disclosed.

(07/016) Children Detained in Şırnak…

The children S.A. and H.B. were detained by the police on 1 July 2015in Cizre district of Şırnak for waving victory sign against a military convoy.

(07/001) Çayan Birben Case…

Yalova Heavy Penal Court continued on 1 July 2015 to hear the case against police officers İbrahim Baltacı, Ercüment Küçükakça, Serhat Ayhan Yeni and Tekin Ceyhan launched in connection with the death of Çayan Birben.

On 27 May 2012, the police used tear gas to break up a fight in Abdullah Baştürk Park in Yalova. Çayan Birben who was suffering from asthma was hospitalised due to use of tear gas and died on 30 May 2012 in the hospital.

After the testimonies of the eyewitnesses, the court decided to send the hard disk of the security camera of internet café where Çayan Birben was found fainted to Gendarmerie Criminal Laboratory in Ankara for examination.

The court also decided to ask İstanbul Forensic Institute whether standard pepper gas sprays are harmful to health, have lethal effect, and may cause death if the person has previous illness. Forensic Institute issued a medical report on 12 February 2013 certifying that the use of tear gas might have caused the death of Çayan Birben.

The court also rejected the arrest demand for the defendants and adjourned the hearing to a later date.

The case against the officers was launched at Yalova Heavy Penal Court and the Court decided not to be responsible with case and sent the file to Heavy Penal Court of First Instance. But Heavy Penal Court of First Instance sent the file back to the Heavy Penal Court. Yalova Heavy Penal Court insisted on not to be responsible with case and 5th Penal Chamber at the Court of Cassation ruled that Yalova Heavy Penal Court is responsible with case.

(07/002) Muammer Öz Case…

Kadıköy (İstanbul) Penal Court of First Instance No 5 concluded on 25 December 2009 to hear the case against 2 police officers launched for beating Lawyer Muammer Öz in the park and then in the police vehicle with his hands had been cuffed in front of his family on the grounds that he “did not show his identity card” in Moda Quarter of Kadıköy District of İstanbul Province on 29 July 2007. The court sentenced the defendants to 23 months and 15 days of imprisonment each in connection with on charges of “intentionally wounding” and “insulting” under Articles 86, 87 and 125 of TPC. The sentences were postponed on the grounds that they are under 24 months.

According to the news appeared in the press on 1 July 2015, 3rd Penal Chamber at the Court of Cassation quashed the verdict. Upon decision of the Court of Cassation, Anadolu (İstanbul) Penal Court of First Instance No 21 started to hear the retrial of the police officers. The medical report prepared by the Forensic Institute was presented to the court. The medical report of Muammer Öz reportedly certified that the victim was subjected to torture according to the classification of World Health Organisation.

(07/003) Journalist Convicted on the allegations of Insulting State President…

Anadolu (İstanbul) Penal Court of First Instance No 2 concluded on 30 June 2015 to hear the case against remanded journalist Mehmet Baransu launched in connection with the twits he shared criticising the State President Recep Tayyip Erdoğan.

The court sentenced the defendant to 10 months’ imprisonment under the Article 299 TPC for “insulting the State President”.

(07/004) Journalist Detained in Kilis…

İlhan Çulha, correspondent with the daily Zaman, was detained when he was following the dispatching military troops on the Syrian border on 30 June 2015 in Kilis province.

(07/005) House Raid in İstanbul…

The police conducted house raid on 30 June 2015 in Küçükçekmece district of İstanbul and detained İrfan Bilgiç, journalist with the journal Demokratik Modernite Dergisi. The reason of the operation was not disclosed.

(07/006) Detentions and Arrests…

4 members of New Democratic Youth (YDG) who were detained in Cizre district of Şırnak were arrested on 30 June 2015 on the allegations of “being member of TİKKO (Liberation Army of the Workers and Peasants of Turkey)”.

From Taqsim Square to Rabin Square: Institutionalized Violence

From the occasion of the International Day in Support of Torture Victims, PCATI in cooperation with the Chaim Herzog Center for Middle Eastern Studies and Diplomacy held a conference on May 25th, From Taqsim Square to Rabin Square: Institutionalized Violence, at the Ben Gurion University.

image-5cf5587c0988686b321f3f371342406fa2d0e40731a6a6b9234dcac89c1d60d7-VThe first part of the conference explored the roots of torture in Turkey and Israel. Dr. Noam Hofstadter (PCATI) and Adv. Elif Koru (Human Rights Foundation of Turkey) presented the findings of a joint, two-year research project, aiming at analyzing the topic. The findings show similarities in the overarching phenomena of using torture in the investigation rooms as well as on the streets against demonstrators both in Turkey and Israel. As pointed out by the researchers, torture is not only used by the law enforcement authorities to extract information but also as a means of punishment.

The second part of the conference explored the issue of police brutality in Israel. Rafat Abu Aish (Negev Co-Existence Forum for Civil Equality) and Adv. Tali Dajeen (Tebeka) spoke about police brutality and ill-treatment which may amount to torture and which has recently been used against various groups of Israeli the society (such as Bedouins and Ethiopians). The speakers also spoke about the high prevalence of impunity and the difficulties in prosecuting the policemen having committed ill-treatment.

HRFT Events Report for 26th of June Solidarity Day with Torture Survivors

Since our establishment in 1990, particularly with our founder Human Rights Association (HRA) and with other Organisations, we are as HRFT organize meetings, press confreneces, cultural events and demonstrations on each June, 26th to empower us all in this struggle against torture and for the solidarity with the torture survivors.

Training of İstanbul Protocol was held in Cizre!

On June the 13-14th 2015, a training programme about “The Manual on Effective Investigation and Documentation of Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, commonly known as the Istanbul Protocol” with the participation of physicians and lawyers who are dealing with traumatized people was held by Assoc. Prof. Halis Ulaş, Prof. Ümit Biçer and Att. Senem Doğanoğlu in Cizre. The reason to choose Cizre was there has been a very critical social and political kaos including killings and arrests, torture by the authorities.

As HRFT, we are grateful to all those who made a great effort during the preparation and implementation process of this Training.
