(02/133) People Subjected to Torture and Ill-Treatment of Police in Mersin…

It is learned from the news coverage of February 12, 2020 that, the police raided house of Mehmet Beyhan, member of People’s Democratic Party (HDP) Youth Assembly in Mersin on February 11, 2020 and committed physical and verbal violence to persons in the house and held gun to their heads.

Mehmet Beyhan’s brother Cindi Beyhan stated the following: “The police hold a gun to my 11 years old kid’s head, asked his name and beat him. They scattered everything around. They pulled my 17 years old daughter’s hair, pushed her to the ground, stepped on her back and beat her; asked her name and hold a gun to her head. They kept holding guns to my daughter Zehra and son Erhan, and beat them. They beat us, they tormented us.”

It is learned from the news coverage of February 12, 2020 that, journalist Aziz Oruç who is kept in Patnos L Type Prison is not given the books, letters and clothes sent to him.

(02/135) Hunger Strike in Prison…

It is learned that Şerif Mesutoğlu, who was on hunger strike in Siverek T Type Prison for 229 to demand a fair trial, ended his strike on February 12, 2020. Şerif Mesutoğlu has been sentenced to heavy life imprisonment through the case about Derik district sub-governor Muhammed Safitürk’s death.

(02/136) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling 1191 days to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on February 12, 2020 at 13.30, and at 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on February 12, 2020, 2 people (Alev Şahin and Mehmet Dersulu) and at 18.00 3 people (Merve Demirel, Nazan Bozkurt and Sercan Çakır) were detained.

Thus in total 5 people were detained due to press declaration intended to be held in Yüksel Street on February 12, 2020. It is learned detained people were released on the same days they were detained.

(02/137) Detained Trade Union Executive, Political Party Executives and City Council Member in Ağrı…

On February 12, 2020 5 people (Confederation of Progressive Trade Unions Ağrı branch chair Ersin Erinçik, HDP central district co-chair İsmail Çiftçi, HDP central district executives Ömer Taş, city council member Sabri Taşdemir and Hamit Taşdemir, former executive of Democratic Regions Party [DBP]) are detained in house raids in Ağrı. The reason of detention is unknown.

(02/139) Detained Local Authority and Other People in Muş…

On February 12, 2020, 8 people including Salih Söylemez, local authority of Kazgöl village, are detained in house raids in Kazgöl, Aslankaya and Yaramış villages of Malazgirt district of Muş. It is learned that 8 people are taken to Malazgirt District Gendarmerie Command however the reason of detention is unknown.

On February 12, 2020, Rumet Dursun, provincial co-chair of HDP in Bitlis is detained in a house raid in Tatvan district of Bitlis.

(02/141) Detained People in Antep…

On February 12, 2020, 12 people are detained on the grounds of ‘making propaganda for an illegal organisation’ in house raids in Antep.

(02/142) Journalist on Trial in Istanbul…

The first trial of the case against Cumhuriyet newspaper reporter Zehra Çelenk, on the grounds of mentioning an anonymous witness’ name in a report, is held at Istanbul Heavy Penal Court No 27 on February 12, 2020. After defence hearings the court adjourned the trial to April 14, 2020.

(02/143) HDP Executives and Members on Trial in Van…

On February 10, 2020, the first trial of the case against 12 people (5 of them are arrested) including Yadişen Karabulak, former provincial co-chair of HDP in Van, was held at Van Heavy Penal Court No 7 and the court has released 4 arrested defendants. It is learned that the prosecutor’s office objected the release and the court accepted the objection. Fikret Doğan and Yadişen Karabulak are detained again on February 12, 2020.

(02/144) Trials in Alleged Link to Coup Attempt…

The final trial of the case against Selman Gülen is held at Adana Heavy Penal Court No 12 on February 12, 2020. The court sentenced the defendant to 6 years and 3 months on the charge of ‘being an illegal organisation member’.

The final trial of the case against Faruk Güllü is held at Istanbul Heavy Penal Court No 23 on February 12, 2020. The court sentenced the defendant to 8 years and 9 months on the charge of ‘being an illegal organisation member’.

(02/145) Ban of Events in Hakkari…

Hakkari Governorate made a declaration on February 12, 2020 and announced that, all open-door events such as demonstrations, press declarations, meetings, sit-ins, opening stands and tents, festivals, concerts, delivering leaflets and so on are banned for 15 days as of February 13, 2020. All events are banned in Hakkari for 328 days since April 4, 2019.

It is learned from the news coverage of February 12, 2020 that, access to a news report on evrensel.net website, about dismissal of a teacher at private Maya school, is banned to access by Ankara Penal Court of Peace on February 10, 2020.

(02/118) People Subjected to Torture and Ill-Treatment of the Police in Diyarbakır… 

It is learned from the news coverage of February 11, 2020 that, the police raid a house in Kayapınar district of Diyarbakır and detained a 17 years old child named T. T. in the house. It is learned that during the raid the police put a gun to head of T. T. and of a 3 years old baby. T. T. was released after statement procedures on the same day.

  1. T.’s mother stated the following: “The doorbell rang. We were surprised to hear the doorbell this time since the police usually uses a hammerhead to raid in our house. They came when my child was preparing to go to school. As soon as my son opened the door they forced him lie down on the ground putting a gun to his head. I told them that my son was 17 years old, but they waited him in this position for minutes. I tried to stop them. They took him in the kitchen when I intervened them. They did not tell the reason of detention. They searched the house, scattering everything around. My grandchild was at home, they put a gun to his head too.”

It is learned that İrfan Arslan, one of 3 people who were subjected to torture and ill-treatment during raid of security forces to a house in Çavuş village of Karayazı district of Erzurum on February 8, 2020, is arrested by the court on the charge of ‘aiding an illegal organisation’ on February 11, 2020. 2 people (Şevin Arslan and Halis Arslan) are released on judicial control conditions.

It is learned from the news coverage that İrfan Arslan who was hospitalized due to torture and ill-treatment that he was subjected during raid, has rib fracture, and wounds at forehead, nose and head.

People’s Law Office declared on February 11, 2020 that their client Hakan İnci was subjected to physical violence of the wardens in Edirne F Type Prison.

(02/121) Police Intervention to a Protest in Istanbul…

The police intervened the press declaration for Mustafa Koçak, İbrahim Gökçek and Helin Bölek, at Khalkedon Square in Kadıköy district of Istanbul on February 11, 2020 and detained İsmail Kara. İsmail Kara is released on the same day. Mustafa Koçak is on death fast for 225 days in Izmir Şakran T Type Prison, to demand a fair trial. İbrahim Gökçek and Helin Bölek have gone on a hunger strike on June 18, 2019 and İbrahim Gökçek turned his strike to a death fast on January 3, 2020 and Helin Bölek did it so on January 20, 2020.

The police intervened the press declaration for Mustafa Koçak, İbrahim Gökçek and Helin Bölek, at Özgürlük Square in Bakırköy district of Istanbul on February 11, 2020 and detained 2 people (Baki Can Işık and Aygül Bilgi).

Arlet Natali Avazyan is detained in Istanbul on February 11, 2020 for her social media posts. Arlet Natali Avazyan is released after statement procedures at the police on February 12, 2020.

(02/124) Arrested Person in Istanbul ‘Insulting the President’…

On February 11, 2020, Ayten Sarıkaya Kesler, who came to Istanbul from Switzerland is detained on the grounds of ‘insulting the President’ in her social media posts and is arrested by the court on the same day. It is reported that Ayten Sarıkaya Kesler, who has cancer, deteriorated and taken to hospital and that she would be taken to prison after treatment. It is also claimed in the news reports that Ayten Sarıkaya Kesler was enforced to sign the interrogation report while she was unconscious.

(02/125) Arrested City Council Member in Muş…

Şengül Çiçek, Varto city council member; People’s Democratic Party (HDP) Varto district co-chair Atik Yıldız, and Bektaş Han, former district executive of HDP who were detained in house raids in Varto district of Muş on February 11, 2020 are referred to the court on the same day. Şengül Çiçek is arrested on the charge of ‘being an illegal organisation member’ and 2 people are released.

(02/126) Detained People in Adana…

2 people including 1 child (Şirda Erol and 15 years old D. S.) are detained in house raids in Adana through an investigation against DEM Music Center on February 11, 2020. 4 people (İlyas Arzu, Jiyan Savcı, Hakan Taş and Berfin Doğan) were detained earlier through the same investigation and detention period for these people was extended 4 more days.

(02/127) Detained People in Urfa…

On February 11, 2020, 13 people are detained on the charges of ‘being an illegal organisation member’ and ‘aiding an illegal organisation’, in house raids in Koçova neighbourhood of Bozova district of Urfa. It is learned that 5 of them (Mehmet Yıldırım, Tacettin Gül, İbrahim Polat, Mahmut Pehlivan and İskender Şeker) are taken to Bozova District Gendarmerie Command; and 8 people are taken to Urfa. Detained people are: Mehmet Yıldırım, Kenan Yıldırım, Müslüm Yıldırım, Yılmaz Doğan, Tacettin Gül, Abdullah Polat, İbrahim Polat, Mustafa Yıldız, İskender Şeker, Emin Zincirkıran, Mahmut Pehlivan, Ayhan Atmaca and Mustafa Taş.

(02/128) Detained People in Mersin…

On February 11, 2020, 12 people including 2 children are detained on the charge of ‘being an illegal organisation member’ in house raids in Mersin. Names of detained people known so fare are: S. A., V. Ç., Ferhat Salman, Mehmet Beyhan, Resul Demir, Mustafa Koç, Barış Şen and Yusuf Keskin.

(02/129) Co-Mayor on Trial in Diyarbakır…

The indictment of Diyarbakır Public Prosecutor’s Office against Cemal Özdemir, HDP co-mayor of Sur district of Diyarbakır, is accepted by Diyarbakır Heavy Penal Court No 8.

The indictment accuses Cemal Özdemir for 22 activities he participated in, statement of an anonymous witness and 3 social media posts and demands jail sentence from 17 years and 6 months to 36 years for Cemal Özdemir, on the charges of ‘being an illegal organisation member’, ‘making propaganda for an illegal organisation’, ‘possession of hazardous substances without permission’ and ‘selling, purchasing, carrying and owning weapons and/or bullets which are severe in terms of quality’.

The first trial will be held on March 10, 2020.

(02/130) Journalists on Trial in Van…

The trial of the case against Sibel Eres, Kadir Cesur, Nahide Aslan, Gülsün Altan, announcers of Van TV channel which was closed down by a state of emergency decree; managing director Koçali Özipek and shareholders Gürcan Bayrakçı and Nedim Dalga, is held at Van Heavy Penal Court No 4 on February 11, 2020.

The indictment demands sentence for 8 people on the charge of ‘making propaganda for an illegal organisation’.

After defence hearings the court adjourned the trial to May 7, 2020.

(02/131) People on Trial in Istanbul…

The first trial of the case against 7 people (Ayfer Yılmaz, Muzaffer İpek, Türkan Sünbül, Elvan Uçar, Mürvet Kesen, Zübeyde Ağırbaş, Maynur Yılmaz) is held at Istanbul Heavy Penal Court No 36 on February 11, 2020. 7 people were detained on November 24, 2019, while they were distributing leaflets on International Day for the Elimination of Violence Against Women in Esenyurt district of Istanbul, and were arrested by the court.

After defence hearings the court released 7 people on judicial control conditions and adjourned the trial to March 10, 2020.

On February 11, 2020, 14 people are detained in operations covering 4 cities through an Istanbul based investigation.

It is learned from the news coverage of February 9, 2020 that 2 militants died in a clash between security forces and HPG militants in rural areas of Beytüşşebap district of Şırnak on September 18, 2019.

(02/071) Military Operation to North and South Syria and Attacks…

Ministry of National Defence announced that 1 soldier died and 4 soldiers got wounded due to roll-over of a military vehicle in Syria in February 8, 2020.

(02/072) Person Burned Himself in Hatay…

A person named A. Y. who has been unemployed for a long time and who has burned himself in front of Hatay Governorate saying “My children are hungry” on February 7, 2020, died in Hatay Public Hospital.

(02/073) Asylum Seekers Died in Van…

It is learned that 13 asylum seekers found dead due to cold in rural areas of Sarıçimen neighbourhood of Çaldıran district of Van on February 9, 2020. It is stated in the news reports that 10 of them were from Afghanistan and 3 of them are from Syria.

(02/074) Torture and Ill-Treatment in Erzurum…

It is learned from the news coverage of February 8, 2020 that, 3 people (İrfan Arslan, Şevin Arslan and Halis Arslan) were subjected to torture and ill-treatment of security forces raiding a house in Çavuş village of Karayazı district of Erzurum. It is stated in the news reports that İrfan Arslan got deteriorated due to torture and was taken to Karayazı Public Hospital first and then to Erzurum by ambulance.

It is learned that Şevin Arslan and Halis Arslan were detained after the raid and were taken to Erzurum Police Headquarters.

(02/75) Torture and Ill-Treatment in Prison…

It is learned from the news coverage of February 7, 2020 that, Grand National Assembly Human Rights Inquiry Committee’s Sub-Committee on Prisoners’ Rights has declared its report on prisons in Elazığ and stated that 704 prisoners are kept in Elazığ E Type Prison which has a capacity of 468 people. It is also stated in the report that, heating do not work, tap water is dirty, prisoners are referred to prison infirmary with a delay of 2 weeks and to hospitals with a delay of months, stuff that prisoners buy from prison commissary store is seized during ward searches, food given to prisoners is not adequate and hygienic enough all the time, petitions of prisoners are not put in process, visit time is reduced from 1 hour to 30 minutes; and cultural, sports and social rights of prisoners are limited.

It is also stated in the report that food given to prisoners is not adequate and hygienic, outdoor time for prisoners is reduced, children staying in prison with their mothers are not given food required for their development, personal belongings of prisoners are scattered around during ward searches, and prisoners are forced to be medically examined in handcuffs in Elazığ Women’s Prison.

It is also stated in the report that in Elazığ High Security Prison No 1, food for 1 person is portioned out to 3 people.

It is learned from the news coverage of February 7, 2020 that political prisoners in Rize L Type Prison are put in wards of ordinary prisoners under coercion. It is stated in the news reports that political prisoners are subjected to psychological pressure, death threats and insults in these wards.

It is learned from the news coverage of February 8, 2020 that Hüseyin Bağ, a prisoner kept in Elazığ High Security Prison No 2 was subjected to physical violence of wardens because of reacting them for scattering his personal belongings during a search on February 3, 2020.

(02/076) Prevention of Right to Health in Prison…

It is learned from the news coverage of February 9, 2020 that Adem Durmuş, a prisoner with cataract in Samsun Bafra T Type Prison was not treated and has visual impairment due to this.

(02/077) Rejection to Meeting Request with Abdullah Öcalan…

It is learned that the appeal made on February 7, 2020 to chief public prosecutor’s office in Bursa by PKK leader Abdullah Öcalan’s sister and brother and tutelary along with the families of Hamili Yıldırım, Ömer Hayri Konar and Veysel Aktaş in order to visit, was rejected the same day on the grounds of limitations for prisoners in accordance with the Law on the Execution of Criminal and Security Measures Number 5275. Abdullah Öcalan met his family on January 12, 2019 for the first time after September 11, 2016 and meeting requests have been rejected for 93 times to this date.

The police intervened the sit-in protests after press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling 1181 days to regain their jobs, in front of Human Rights Monument in Yüksel Street on February 7, 8, and 9, 2020 at 13.30, and at 18.00.

It was reported that the police intervened the sit-in protest after press declaration at 13.30 on February 7, 2020, and detained Nazan Bozkurt and Acun Karadağ by using physical violence and forcing them away from Human Rights Monument.

It was reported that that the police intervened the sit-in protest after press declaration at 13.30 on February 8, 2020, and detained Acun Karadağ, Merve Demirel and Fatma Karataş by using physical violence. Nazan Bozkurt, who then wanted to hold another sit-in protest in front of Human Rights Monument is also detained by the police by using physical violence. The police intervened the sit-in protest after press declaration at 18.00 same day and forced participators away from the monument; and detained Acun Karadağ, Nazan Bozkurt, Merve Demirel and Fatma Karataş by using physical violence.

It was reported that that the police intervened the sit-in protest after press declaration at 13.30 on February 9, 2020, and detained Acun Karadağ and Merve Demirel by using physical violence.

Thus in total 12 people were detained in police interventions in Yüksel Street on February 7, 8, and 9, 2020. It is learned detained people were released on the same days they were detained.

The police intervened press declaration of Alev Şahin, who was dismissed by a state of emergency decree, in front of Ministry of Environment and Urban Planning in Ankara on February 7, 2020 and detained her and Merve Demirel who was recording the protest. It is learned that Alev Şahin and Merve Demirel were released on the same day.

The police intervened the press declaration for Mustafa Koçak, İbrahim Gökçek and Helin Bölek, at Khalkedon Square in Kadıköy district of Istanbul on February 6, 2020 and detained Feridun Osmanoğlu. Mustafa Koçak is on death fast for 223 days in Izmir Şakran T Type Prison, to demand a fair trial. İbrahim Gökçek and Helin Bölek have gone on a hunger strike on June 18, 2019 and İbrahim Gökçek turned his strike to a death fast on January 3, 2020 and Helin Bölek did it so on January 20, 2020.

The police intervened the press declaration of Cemal Yıldırım, who was dismissed from his job by a state of emergency decree and Melek Çetinkaya, mother of an Air Force Academy student who was sentenced to heavy life imprisonment through “Fethullahist Terrorist Organisation / Parallel State Structure” cases, in Sakarya Street of Ankara on February 8, 2020 and detained 2 people.

(02/084) Prevention of Saturday Mothers’ Protest in Istanbul…

Police obstructed all the streets around Galatasaray Square in Istanbul to prevent Saturday Mothers who rally every Saturday for 23 years in the same place to gather for the 776th time on February 8, 2020. Upon police prevention, the group including representatives of political parties, human rights defenders and artists along with families of disappeared people held a press declaration on the street of Human Rights Association (IHD) Istanbul office.

(02/085) Prevention of Human Rights Defenders’ Event in Istanbul…

“F sit-in”, which is organized for the 411st time by Human Rights Association (IHD) Istanbul Branch Prison Watch Committee, to demand release of ill prisoners, on February 8, 2020, is prevented by the police. The police obstructed all the streets around Galatasaray Square. Human rights defenders made the press declaration in front of IHD Istanbul office.

(02/086) Police Intervention to a Protest in Istanbul…

The police intervened Youth Committees members in Şişli district on February 8, 2020, protesting increased public transportation fees in Istanbul, and detained 10 people and Sendika.Org news portal reporter Vedat Örüç. It is learned that the police did not end intervention although 1 person fainted due to police violence. The names of detained 11 people who were released by the court on judicial control conditions and with a ban on leaving the country on February 9, 2020, are unknown.

(02/087) Police Intervention to a Protest in Istanbul…

The police intervened Dev-Lis (Revolutionary High School Students) members who block the way in Kadıköy district of Istanbul on February 9, 2020, with a banner saying “We are students not customers” to protest increase of application fee for Higher Education Exam; and detained 3 people (Bünyamin Süskü, Yıldız İdil Şen and Berivan Han) by using physical violence. 3 people are released after statement procedures at the prosecutor’s office on February 10, 2020.

Çetin Dirin, local authority of Kali neighbourhood of Lice district of Diyarbakır, who was detained on February 8, 2020, is arrested by the court on the same day on the charge of ‘being an illegal organisation’.

(02/089) Detained HDP Executive, Peace Mother and Other People in Istanbul…

On February 7, 2020, at least 5 people including People’s Democratic Party (HDP) executive and one of Peace Mothers are detained in house raids in Istanbul. Detained people are: Peace Mother Canşah Cemile Çelik, HDP Bahçelievler district executive Serkan Yılmaz, HDP provincial office security officer Mustafa Turgut, İhsan Sinmiş, Adem Özyurt.

HDP Youth Assembly member Muhsin Acar, who was detained in Diyarbakır on February 1, 2020, is arrested by the court on the charge of ‘disturbing integrity and unity of the state’ on February 8, 2020.

Dem Music Center in Adana is raided by the police on February 8, 2020. 2 people (İlyas Arzu and Jiyan Savcı) are detained in the center. It is learned that the police searched the houses of 2 people and seized books and digital material in these houses.

(02/092) Fine Penalty for a Journalist in Istanbul…

It is learned from the news coverage of February 8, 2020 that, journalist Ersan Kınık was asked to give his ID card to watchmen in Beşiktaş district of Istanbul, was taken to Beşiktaş Police Station after he told the watchmen that it was not lawful; and was given a fine penalty of 579 Turkish Liras in total – 392 Turkish Liras and 187 Turkish Liras for violating Article 32 and Article 40 of Law of Misdemeanour.

(02/093) Journalist on Trial in Istanbul…

The first trial of the case against Aydın Keser, editor in chief of Yeni Yaşam newspaper, for headline “No peace flows from this spring” related to military operation “Peace Spring”, is held at Istanbul Heavy Penal Court No 21 on February 7, 2020.

The indictment demands sentence for Aydın Keser on the charge of ‘making propaganda for an illegal organisation’.

After defence hearings the prosecutor declared legal opinion and demanded acquittal. The court acquitted Aydın Keser.

(02/094) People on Trial in Urfa…

The first trial of the case against 30 people including 25 arrestees is held at Urfa Heavy Penal Court No 5 on February 7, 2020.

The indictment demands sentence for defendants on the charges of ‘being an illegal organisation member’ and ‘making propaganda for an illegal organisation’.

After defence hearings the court decided to release 15 people and adjourned the trial to March 6, 2020.

30 people were detained on October 9, 2019 and 25 of them were arrested on October 21, 2019.

(02/095) The Case Against People Evacuated from Nusaybin…

The case against 70 people who were detained and then arrested on May 26, 2016, after being evacuated from the buildings they were stuck in during the curfew on Nusaybin district, is held on February 7, 2020 on Mardin Heavy Penal Court No 4. The court has decided to separate the case for each defendant and to start proceedings all over again with new case files on April 5, 2019. The court sentenced 2 people (İsmail Yılmaz and Ömer Günür) to heavy life imprisonment and 18 years each. The court adjourned the trial of İbrahim Halil İldiz. With the last verdicts, 39 people in total are sentenced through this case.

It is learned from the news coverage of February 8, 2010 that, General Directorate of Credit and Dormitories Agency ended scholarship of students who participated in “Las Tesis” protest against violence against women on December 25, 2019. Van Governorate made a declaration on February 7, 2020 and announced that, all open and indoor events such as demonstrations, press declarations, meetings, sit-ins, opening stands and tents, festivals, concerts, delivering leaflets and so on are banned for 15 days as of February 8, 2020. All events are banned in Van for 1189 days since November 21, 2016.

Gülseren Yoleri is released after statement procedures at Sarıyer Police Station.

On February 6, 2020, Ferdi Sertkal, distributor of Yeni Yaşam newspaper; Mehmet Soner Bilir, member of Yüzüncü Yıl Science Anthropology Art and Culture Association (BASK-DER) and Ferhat Kalkan, People’s Democratic Party (HDP) Youth Assembly member, are detained in house raids in Van. The reason of detention is unknown.

The trial of the case against Hüseyin Aykol and Zana Kaya, executive editors and İnan Kızılkaya, editor in chief of Özgür Gündem newspaper and politician Hatip Dicle, is held at Istanbul Penal Court of First Instance No 22 on February 6, 2020. The court decided to prolong the detention warrant for Hatip Dicle and adjourned the trial to June 2, 2020.

The case against 6 journalists (Ömer Çelik, news director and Metin Yoksu, reporter of Dicle News Agency which was closed down by a state of emergency decree; Tunca Öğreten, former editor of Diken news portal; Mahir Kanaat, Birgün newspaper employee; Eray Sargın, editor in chief of Yolculuk newspaper; Derya Okatan, Etkin News Agency news director) on Istanbul Heavy Penal Court No 29 is held on February 6, 2020.

The indictment demands sentence for 6 journalists on the charges of ‘being an illegal organisation member’, ‘making propaganda for an illegal organisation’ and ‘blocking and breaking the information system, changing or destroying the data’, for reporting on the e-mails of Berat Albayrak, Minister of Energy and Natural Sources which were hacked by Redhack and then published on the internet.

The court lifted ban on leaving the country for Derya Okatan and Eray Sargın but rejected to lift judicial control conditions on other 4 journalists and adjourned the trial to June 25, 2020.

3 of 6 journalists who were detained on December 25, 2016, were arrested by the court on January 17, 2017. Ömer Çelik was released on October 24, 2017; Tunca Öğreten and Mahir Kanaat were released on December 6, 2017.

(02/069) Helin Hasret Şen Case…

The first trial of the case against police officer A. E., for death of 12 years old Helin Hasret Şen, is held at Diyarbakır Heavy Penal Court No 1 on February 6, 2020. Helin Hasret Şen died due to fire opened from an armoured police vehicle on October 12, 2015, during curfew in Sur district of Diyarbakır.

The indictment demands sentence for A. E. on the charge of ‘reckless killing’.

Helin Hasret Şen’s mother stated the following: “It happened around 8 a.m. on October 12, 2015. We went to greengrocer first, and then to bakery. There was an armoured vehicle behind us. Fire was opened from the vehicle 3 times. (…) When I looked around I saw my daughter on the ground. When I tried to get her, fire was opened again. A neighbour threw her white muslin on the ground and attempted to get my daughter’s body.  A continuous firing was around us at that moment. (…) The ambulance arrived late although we kept calling. The ambulance came and took my daughter. (…) There were around 20 police officers at the place where my daughter was killed. There was no conflict going on that day.”

Diyarbakır Bar Association chair Cihan Aydın stated the following: “This is a threat to right to live and this is a murder. We are here with the responsibility of legal profession act. We demand intervention to the case in accordance with Article 38 of The United Nations Convention on the Rights of the Child (UNCRC)” and demanded arrest of the defendant police officer.

Jiyan Aydın, lawyer of defendant police officer who is appointed as required by Code of Criminal Procedure, stated that he is a member of Diyarbakır Bar Association Centre of Children’s Rights, and demanded withdrawal from advocacy of the defendant.

The court rejected intervention demands of Human Rights Association, HRFT, Lawyers for Freedom (ÖDH) Diyarbakır branch, Diyarbakır Bar Association Centre of Children’s Rights, Roza Women Association; rejected Jiyan Aydın’s demand of withdrawal and arrest of defendant police officer A. E. and adjourned the trial to March 3, 2020.

On February 4, 2020, 5 people died due to an avalanche that hit Van-Bahçesaray roadway. On February 5, 2020, a second avalanche hit the rescue squad, killing 33 people and injuring 75 people. Thus the number of people died due to two avalanches rise to 38.

On February 5, 2020, a plane from Izmir to Istanbul skidded off a runway and crashed at Sabiha Gökçen Airport. It is reported that 3 people died and 179 people got injured. Video recording of injured passengers being carried by apron buses to the airport is covered by press.

It is learned that 1 soldier (Özgür Çelik) died due to explosion of a grenade in a military base in Çukurca district of Hakkari on February 5, 2020.

It is learned from the news coverage of February 5, 2020 that, Ömer Köse, former chief of Anti-Terror Department of Istanbul Security Directorate, who is now in Tekirdağ T Type Prison No 2, is being kept alone in a ward for 3 people, is not given hot water, his rights for social, cultural and sports activities are prevented and his petitions are not put in process.

It is learned from the news coverage of February 5, 2020 that in Kayseri T Type Prison No 2, letters sent to prisoners are not delivered to them, prisoners are not given radios, and the number of books per prisoner is limited.

It is learned from the news coverage of February 5, 2020 that 2 prisoners (Kadir Çiçek and Furkan Uğur) were subjected to physical violence of the wardens during a roll-call and were put in single cells.

The police intervened Dev-Güç (Revolutionary Forces of Youth) members holding a press declaration in front of Red Crescent office in Beşiktaş district of Istanbul on February 5, 2020 to protest transfer of donations to Ensar Foundation; and detained 2 people (Umut Doğan and Bekir Açat) by using physical violence.

Ferhat Çelik, Mezopotamya News Agency editor in chief, who was detained at Silivri Prison No 5 where he went for a prisoner visit on February 5, 2020, is released on the same day after giving official statement about a news report, at Silivri Courthouse.

Ferhat Çelik is detained in his house once again on the same day through the same investigation. It is learned that Ferhat Çelik was detained again because his statement was not recorded in. Ferhat Çelik is released afterwards.

The trial of the case against People’s Democratic Party (HDP) Hakkari MP and Democratic Society Congress (DTK) co-chair Leyla Güven, for her declarations about Turkish Armed Forces operation to Afrin and her activities within DTK, is held at Diyarbakır Heavy Penal Court No 9 on February 5, 2020. The court rejected to lift the ban on leaving the country and adjourned the trial to April 8, 2020.

(02/055) “I Want My Job Back” Protestor on Trial in Düzce…

It is learned from the news coverage of February 5, 2020 that, the final trial of the case against architect Alev Şahin, for continuing her protests “I Want My Job Back”, to regain her job from which she was dismissed by a state of emergency decree, in spite of governorate’s ban, is held at Düzce Penal Court of First Instance No 2. It is reported that the court sentenced Alev Şahin to 37 days for violating governorate’s ban.

The first trial of the case against Yusuf Ziya Yavuz, city council member from HDP in Bağlar district of Diyarbakır and Leyla Akgül, advisor of HDP MP Dersim Dağ, for participating in a protest against Turkish Armed Forces operation to north and south Syria, is held at Diyarbakır Heavy Penal Court No 9 on February 5, 2020.

The indictment demands sentence for 2 people on the charges of ‘being an illegal organisation member’ and ‘resisting to police’.

After defence hearings the court released Yusuf Ziya Yavuz and Leyla Akgül on judicial control conditions and adjourned the trial.

The first trial of the case against journalist Durket Süren for her social media posts and on the grounds of delivering banned newspapers, is held at Diyarbakır Heavy Penal Court No 11 on February 5, 2020. The indictment demands sentence for Durket Süren on the charges of ‘aiding an illegal organisation’ and ‘making propaganda for an illegal organisation’. After defence hearings the court adjourned the trial to May 18, 2020.

(02/058) Berkin Elvan Case…

The case against police officer Fatih Dalga for Berkin Elvan’s death, is held at Istanbul Heavy Penal Court No 17 is held on February 5, 2020. Berkin Elvan was wounded due to a gas canister fired by the police on June 16, 2013, during Gezi Park protests in Okmeydanı neighbourhood of Istanbul’s Beyoğlu district; and died in hospital on March 11, 2014.

The indictment demands sentence for police officer Fatih Dalga on the charge of ‘killing with probable intention’.

It is learned that the report of gendarmerie sent to court on January 24, 2020, Berkin Elvan is presented as “faulty at secondary rate”.

The court adjourned the trial to March 18, 2020.

(02/059) Detentions and Arrests in Alleged Link to Coup Attempt…

The final trial of the case against Ahmet Kaya, former member of Supreme Council of Judges and Prosecutors is held at Penal Department No 9 of Supreme Court on February 5, 2020. The court sentenced the defendant to 12 years for ‘being an illegal organisation member’.

The final trial of the case against Burka Okuç is held at Ankara Heavy Penal Court No 15 on February 5, 2020. The court sentenced the defendant to 8 years 1 month and 15 days for ‘being an illegal organisation member’.

(02/060) City Council Members Prevented from Entering Municipality Offices…

It is learned from the news coverage of February 3, 2020 that city council members in Bismil district of Diyarbakır, who came to municipality buildings to attend monthly council meetings, were not allowed in by the police. Bismil co-mayor Orhan Ayaz was suspended by Ministry of Interior on October 22, 2019 and a trustee was appointed to Bismil.

(02/034) Hunger Strike in Prison…

It is learned from the news coverage of February 4, 2020 that 8 lawyers including Selçuk Kozağaçlı, chair of Progressive Lawyers Association (ÇHD) went on a hunger strike in prisons. It is reported that the hunger strike is to support demands of Mustafa Koçak, and Grup Yorum band members İbrahim Gökçek and Helin Bölek who are all on death fast; and to demand fair trial and cancellation of results of proceedings which came up with unfair trials. Mustafa Koçak is on 218th day of death fast as of today. İbrahim Gökçek is on death fast since January 3, 2020 and Helin Bölek is on death fast since January 20, 2020; they have both started their hunger strike on June 18, 2019. Helin Bölek is released from prison on November 20, 2019. Bahar Kurt, another member of Grup Yorum who was released from prison on November 20, 2019, has paused hunger strike on January 20, 2020.

(02/035) Torture and Ill-Treatment in Prison…

It is learned from the news coverage of February 4, 2020 that Cebrail Ancar, a prisoner kept in a single cell in Hatay Iskenderun T Type Prison was subjected to physical violence of wardens during the roll-call on January 13, 2020. It is learned that the wardens said “State is here, stand up” and Cebrail Ancar is not given a medical report from prison infirmary evidencing the violence.

(02/036) No Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police did not intervene the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling 1183 days to regain their jobs, held in front of Human Rights Monument in Yüksel Street on February 4, 2020 at 13.30, and at 18.00. Nuriye Gülmen and Semih Özakça, who were dismissed by state of emergency decrees, started this protest and went on a hunger strike in time; and the police intervened the protest on May 12, 2017, on the 65th day of hunger strike, for the first time and blocked Human Rights Monument in Yüksel Street. The police have intervened all press declarations ever since.

Müslüm Arsan, Haliliye district co-chair of People’s Democratic Party (HDP) who was detained during a general information check by the police on February 3, 2020, on the grounds of a warrant, is released after statement procedures at the prosecutor’s office on February 4, 2020.

(02/038) Detained Iranian Singer in Istanbul…

Iranian rap singer Amir Hossein Maghsoudloo who was detained Istanbul on January 28, 2020 on the grounds of being sought on red notice by Iran, is released by the court with a ban on leaving the country and on judicial control conditions.

(02/039) Former Co-Mayor on Trial…

The first trial of the case against Remziye Yaşar, HDP co-mayor of Yüksekova district of Hakkari, is held at Hakkari Heavy Penal Court No 1 on February 4, 2020.

Şirvan Sedal, one of the witnesses stated the following: “I was tortured under custody at police directorate for 4 days. They forced me to sign blank papers. Accusations are not mine; I do not accept them”. Another witness Abdullah Orhan stated the following: “I do not speak Turkish. I was under custody for 6 days. I am illiterate. It appears that I have given statements accusing many people. The police learned that I was illiterate and forced me to put my thumbprint on papers in lieu of signature. I have nothing to do with these statements and I do not know any of mentioned people”. After defence hearings the court released Remziye Yaşar on judicial control conditions and adjourned the trial to May 15, 2020.

The prosecutor’s office appealed to release to Hakkari Heavy Penal Court No 2 as the higher court and the court suspended the release.

Remziye Yaşar was detained on October 15, 2019 and was arrested on October 17, 2019. Ministry of Interior appointed a trustee to Yüksekova on October 19, 2019.

(02/040) Director Kazım Öz on Trial…

The trial of the case against director Kazım Öz is held at Tunceli Heavy Penal Court No 2 on February 4, 2020. The indictment demands sentence up to 15 years for Kazım Öz on the charge of ‘being an illegal organisation member’. It is learned that the prosecutor declared legal opinion before investigation of digital material is completed and all evidence is gathered. After defence hearings the court lifted judicial control conditions on Kazım Öz and adjourned the trial to April 28, 2020.

(02/041) Police Officer on Trial in Diyarbakır…

Şahin Öner was hit by an armoured police vehicle on February 10, 2013 in Diyarbakır, during protests about anniversary of PKK leader Abdullah Öcalan’s being taken to Turkey, and died. The trial of the case against police officer S. K., driver of the armoured vehicle, on the charge of intentional killing, is held at Diyarbakır Heavy Penal Court No 1 on February 4, 2020. It is learned that crime scene investigation was not done despite the court order at the previous trial. It is also reported that witness police officers did not attend the trial. The court ruled crime scene investigation to be done on February 27, 2020, and to send a writ for expert report from Traffic Department of Istanbul Technical University and adjourned the trial to April 2, 2020.

(02/042) Efe Tektekin Case…

The first trial of the case against police officer İ. A., for death of Efe Tektekin (5), due to being hit by an armoured police vehicle in Bağlar district of Diyarbakır on September 11, 2019, is held at Diyarbakır Penal Court of First Instance No 9 on February 4, 2020. The indictment demands sentence for I. A. on the charge of reckless killing.

İ. A. stated “We carry out a duty on behalf of the state, we have to ensure our security first” in his defence.

After defence hearings and declarations of lawyers, the court adjourned the trial to April 27, 2020.

(02/043) Journalist on Trial in Diyarbakır for ‘Insulting the President’…

The trial of the case against journalist Hakkı Boltan, on the grounds of ‘insulting the President’ in a Kurdish speech he made, is held at Diyarbakır Penal Court of First Instance No 12 on February 4, 2020. The court decided to have the Speech translated in Turkish by an expert and adjourned the trial April 9, 2020.

(02/044) Constitutional Court Decision on Mehmet Altan’s Appeal…

The Constitutional Court decided on individual appeal of Mehmet Altan on January 20, 2020 and the decision is published on the official gazette on February 4, 2020.

The court has concluded on Mehmet Altan’s appeal on January 11, 2018 and has ruled that personal security and freedom of expression and press was violated. The court also stated that Mehmet Altan’s arrest was not lawful since there is no strong indication presented by authorities of investigation. Lawyers of Mehmet Altan have appealed to Istanbul Heavy Penal Court No 26 on the same day for release, but the court has rejected it on the grounds that the court order was not published on the official gazette. Istanbul Heavy Penal Court No 27, as the higher court, has also rejected the objection to this decision on January 15, 2018. A second appeal for release was made after publication of the Constitutional Court decision, however it was rejected by Istanbul Heavy Penal Court No 26 too. This rejection was based on the claim that the Constitutional Court cannot identify violation due to inadequate evidence in case the local court considered the evidence for arrest, and that Constitutional Court decision which is out of legal limits is not certain and binding. Istanbul Regional Court Penal Department No 2 considered the appeal on the heavy life imprisonment given to Mehmet Altan, and decided release on June 27, 2018, with regard to Constitutional Court decision. This decision was rejected and Penal Department No 16 of Supreme Court, as the higher court considered the appeal this time and reversed the sentence on July 5, 2019, ruling acquittal of Mehmet Altan. Istanbul Heavy Penal Court No 26 held the re-trial and ruled acquittal of Mehmet Altan on December 4, 2019.

The Constitutional Court decided that Mehmet Altan’s right to personal freedom and security was violated and should be paid a compensation of 30.000 Turkish Liras. The court rejected the claim of violation of right to fair trial.

The Constitutional Court states the following in their decision: “The Constitutional Court decisions cannot be inspected by any authority in terms of legality, and being in accordance with the Constitution and laws”, “it is not necessary to have it published on the official gazette in order to have legal consequences of a decision on violation, since it is sufficient to declaration or notification of the court order to relevant authorities”, “relevant authorities have to pay regard to decision of violation and act in order to eliminate violation and its legal consequences, and in this sense, duty of trial courts is not to consider scope and extent of duties and  authorities of the Constitutional Court but to eliminate violation and its legal consequences”.

(02/045) Examination Fee Asked from a Protestor…

It is learned from the news coverage of February 4, 2020 that, Social Security Institution (SSI) demands fees of obligatory medical examinations given to Nazan Bozkurt, participator of “I Want My Job Back” protests in Ankara, after she was detained by the police. Nazan Bozkurt states that SSI sent a notification saying “As a result of legal correspondence with authorities there is no record reached on the ‘judicial case’ that you were subjected from 17/03/2017 to 19/01/2020”, and that SSI will sue her to get examination fees.

(02/046) Detentions and Arrests in Alleged Link to Coup Attempt…

On February 4, 2020, 27 people are detained in operations covering 22 cities through a Konya based investigation; and 24 people are detained through a Balıkesir based investigation against personnel of courthouses and departments of correction.

It is learned that 7 soldiers and 1 civilian personnel died and 4 soldiers got wounded due to cannon fire opened by Syrian Army to Turkish Armed Forces in İdlib area of Syria on February 3, 2020.

(02/022) Person Died at Police Raid in Hatay…

It is learned from the news coverage of February 3, 2020 that 70 years old Edibe Özçelik who fell ill during police raid to a house in Samandağ district of Hatay on January 17, 2020, died at hospital.

Edibe Özçelik’s son Servet Özçelik was at home during the raid and states the following: “I asked the police whether there was an ambulance outside or not, my mother has diabetes she has to be under control. They did not answer me although I asked numerous times. My mother came to the living room, she was crying. One of the police officers said ‘Shut this woman up’. I kept asking an ambulance and they said that there was no ambulance (…) My mother was about to faint, she lay on the sofa, when I asked her how she was she did not react, she could only speak with gestures (…) Then there was no reaction at all. I asked to get her out at least, they did not accept (…) After a while my mother wanted to go to hospital and she fell on my brother, she was talking unconsciously. The police officers who did not even let us out, understood that it was serious and stop preventing us (…) We take her to Güneypark Hospital and the doctor said my mother had a heart attack and she needs an angiography and referred her to Antakya Hospital where she had angiography and was taken into intensive care unit. And towards that evening they told us that my mother died.”

It is learned from the news coverage of February 3, 2020 that, 59 years old Bedrettin Akalın who was on partially exempted paid military service at Kütahya Air Force Training Command felt ill twice on January 14 and January 18, 2020 and died at hospital on January 22, 2020. It is stated in the news reports that Bedrettin Akalın applied to infirmary twice but was prescribed a medication and sent back to his unit, and was not referred to hospital on time.

(02/024) Torture and Ill-Treatment in Prison…

It is learned from the news coverage of February 3, 2020 that a disciplinary proceeding was initiated against 25 people including 8 lawyers one of which is Selçuk Kozağaçlı, chair of Progressive Lawyers Association (ÇHD), for the one-week hunger strike they had in Silivri Prison to support Mustafa Koçak. Mustafa Koçak is on a death fast for 216 days in Izmir Şakran T Type Prison No 2, demanding a fair trial. As a result of disciplinary proceedings 25 prisoners are prevented from some activities for 2 months.  

It is learned from the news coverage of February 3, 2020 that, letters and newspapers which are paid from prisoners’ deposits are not given to prisoners in Eskişehir H Type Prison.

(02/025) Police Intervention to a Protest in Ankara…

The police intervened the press declaration organized by trade union confederations DISK and KESK, Union of Chambers of Turkish Engineers and Architects TMMOB, Ankara Medical Chamber and Ankara Chamber of Independent Accountants and Financial Advisors ASMMMO and participated by political parties, unions and professional organisations held in front of Red Crescent Headquarters in Çankaya district of Ankara on February 3, 2020 and detained 5 people. The press declaration was to protest transfer of the donation made by Başkent Gas Company for Red Crescent to Ensar Foundation. The police once again intervened the group marching to Sakarya Street and detained 14 people. Thus the police detained 19 people by interventions. It is reported that detained people are released on the same day.

Detained people are: Sezgin Çalışkan (TMMOB executive), Deniz Bulunmaz (Party Assembly member of Left Party), Mevlüt Çakmak (BES Ankara Branch chair), Mert Ünal (Ankara provincial executive of Left Party), Uğur Çepe.

(02/026) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling 1182 days to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on February 3, 2020 at 13.30, and at 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on February 3, 2020, 2 people (Merve Demirel and Nazan Bozkurt) and at 18.00 2 people (Merve Demirel and Nazan Bozkurt) were detained.

Thus in total 4 people were detained due to press declaration intended to be held in Yüksel Street on February 3, 2020. It is learned detained people were released on the same days they were detained.

The police intervened the protestors in front of Çankaya Public Health Directorate on February 3, 2020, who rally to regain their jobs from which they had been dismissed by state of emergency decrees, and detained 2 people (Mahmut Konuk and Cemal Yıldırım). It is learned that 2 people were released the same day.

The police intervened the sit-in protest at Bakırköy Square on February 3, 2020 of Nursel Tanrıverdi who rally for 150 weeks to regain her job from which she had been dismissed by state of emergency decree, and detained her by using physical violence.

(02/029) Police Intervention to a Protest in Ankara…

On February 3, 2020, the police intervened the press declaration in Güvenpark, Ankara to support Mustafa Koçak, who is on death fast for 216 days in Izmir Şakran T Type Prison No 2, demanding a fair trial, and detained 2 people (Sinan Yanbal and Sercan Çakır).

(02/030) Detained HDP Executive in Urfa…

Müslüm Arsan, Haliliye district co-chair of People’s Democratic Party (HDP) is detained during a general information check by the police on February 3, 2020, on the grounds of a warrant. It is leaned that Müslüm Arsan is taken to Urfa Police Directorate and detention period for him is extended 2 days.

(02/031) Detained Person in Istanbul for ‘Insulting the President’…

It is learned that, Nuri Başkapan who went to public notary in Sarıyer district of Istanbul on February 3, 2020, to instigate a warning to President declaring that he does not find the President impartial and thus he does not recognise him as President, is detained by the police who was called in by the notary. It is learned that Nuri Başkapan who was detained on the grounds of ‘insulting the President’ is released by prosecutor’s order on the same day.

(02/032) City Council Members Prevented from Entering Municipality Offices…

It is learned from the news coverage of February 3, 2020 that city council members in Kızıltepe, Nusaybin, Derik, Savur and Mazıdağı districts of Mardin and Cizre and İdil districts of Şırnak, who came to municipality buildings to attend monthly council meetings, were not allowed in by the police. In these 7 districts, elected co-mayors on March 31, 2019, were suspended by Ministry of Interior and were replaced by appointed trustees.

On February 3, 2020, 17 people including military members on active duty are detained in operations covering 20 cities through an Istanbul based investigation; 23 people including professors and associate professors are detained in operations covering 7 cities through an Ankara based investigation to GATA Health Sciences University personnel; 39 people are detained in operations covering 5 cities through an Izmir based investigation; and 14 people are detained through and Ankara based investigation on Scientific and Technological Research Council of Turkey.

It is learned from the news coverage of January 30, 2020 that, 1 militant died in a clash between security forces and HPG militants in rural areas of Şırnak on April 7, 2019.

(01/274) Trans Woman Subjected to Police Violence in Istanbul…

It is learned from the news coverage of January 30, 2020 that, a trans woman named Ada was subjected to physical and verbal violence of the police because she reacted to detention of her friend during an identity check in Beyoğlu district of Istanbul. It is reported that she made an official complaint about the police officers on duty.

It is also learned that a Jinnews reporter who was recording police violence was taken to police station and was released after checking recorded video.

(01/275) Torture and Ill-Treatment in Prison…

It is learned from the news coverage of January 30, 2020 that, Macit Şahinkaya, a prisoner in Van High Security Prison was penalised to prevention from visit for 3 months on November 15, 2019, and Akil Nergüz, another prisoner was penalised to prevention from visit for 4 months on December 28, 2019.

It is also stated in the news reports that prisoners were given hot water only for one and half an hour a day, magazines and newspapers were not given to prisoners although there is no ban on them, and conversation rights pf prisoners which has to be 10 hours a week is limited to 3 hours.

It is learned from the news coverage of January 30, 2020 that, 2 books (Şehvetiye Tarikatı by İsmail Saymaz and Türklük Sözleşmesi: Oluşumu, İşleyişi ve Krizi by Barış Ünlü) send to a prisoner in Ümraniye T Type Prison, is not given to prisoner by prison administration on the grounds of “being obscene” and “intemperately criticising and accusing the state”. It is reported that Istanbul Anadolu Court of Execution No 2 rejected the appeal too.

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling 1178 days to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on January 30, 2020 at 13.30, and at 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on January 30, 2020, 2 people (Mehmet Dersulu and Nazan Bozkurt) and at 18.00 2 people (Merve Demirel and Mehmet Dersulu) were detained.

Thus in total 4 people were detained due to press declaration intended to be held in Yüksel Street on January 30, 2020. It is learned detained people were released on the same days they were detained.

(01/278) Former Co-Mayor and Others on Trial in Şırnak…

The final trial of the case against 5 people [Mehmet Demir (former co-mayor of Kumçatı town of Şırnak), Veli Encü, and HDP employees Salih Kerçin, Mazlum Güzel and Şeyhmus Kerçin], on the charge of ‘being an illegal organisation member’ is held at Şırnak Heavy Penal Court No 1 on January 30, 2020.

The court sentenced Mehmet Demir and Mazlum Güzel to 7 years and 6 months on the charge of ‘being an illegal organisation’; Veli Encü and Şeyhmus Kerçin to 5 years on the charge of ‘knowingly and willingly aiding an illegal organisation’ and decided to continue detention of 4 people. The court acquitted Salih Kerçin.

5 people were detained on May 22, 2019 and were arrested on May 24, 2019.

(01/279) Lawyer on Trial in Istanbul…

It is learned from the news coverage of January 30, 2020 that the indictment of Istanbul Public Prosecutor’s Office against lawyer Kemal Aytaç, for “Justice Watch” in front of Istanbul Courthouse on May 4, 2017 is accepted by Istanbul Penal Court of First Instance No 9 and the first trial will be held on April 16, 2020.

The indictment demands sentence for Kemal Aytaç on the charge of ‘organising, leading and participating in illegal demonstrations and meeting’ according to Article 28 of Turkish Penal Code.

Jinnews reported Melike Aydın, who was detained on November 12, 2019 and was arrested on November 15, 2019 on the charge of ‘activities on behalf of an illegal organisation’, is released by the appeal made by her lawyers on January 30, 2020.

The first trial of the case against 26 members of People’s Democratic Party (HDP) Adana Youth Assembly, including 7 arrestees, is held at Adana Heavy Penal Court No 2 on January 30, 2020. After defence hearings the court decided to release 2 people and adjourned the trial to March 12, 2020.

It is learned that the number of people investigated by Ankara Public Prosecutor’s Office on the grounds of ‘publicly degrading Turkish nation, Turkish state, institutions and organs of the state’ and ‘provoking worry, fear and panic among public’ by their social media posts about the earthquake that shook Elazığ on January 24, 2020, raised to 67.

(01/283) Constitutional Court Decision on the Appeal of a Prisoner…

The Constitutional Court concluded on the appeal of Resul Kocatürk, a prisoner in Kırıkkale F Type who was not allowed to be in his father’s funeral. The court’s decision is published on the official gazette on January 30, 2020 and the court ruled a compensation of 5.500 Turkish Liras for immaterial damages on the grounds of ‘violation of right to respect for private and family life’.

The final trial of the case against 4 former executives of Kaynak Holding which was appointed a trustee by a state of emergency decree, is held at Istanbul Heavy Penal Court No 33 on January 30, 2020. The court sentenced 4 people to jail penalties from 9 years to 13 years and 6 months and decided to continue detention of them.

Şırnak Governorate made a declaration on January 30, 2020, and announced 15 areas with given coordinates in central, Cizre, Silopi, Uludere, Güçlükonak and Beytüşşebap districts as special security zones as of January 31, 2020 until February 14, 2020.

(01/265) Torture and Ill-Treatment in Prison…

It is learned from the news coverage of January 29, 2020 that prisoners in Maraş Türkoğlu L Type Prison No 1 were forced to stand in military order during roll-calls and visit time for political prisoners is limited to 40 minutes although it is 80 minutes for other prisoners.

It is learned from the news coverage of January 29, 2020 that, İbrahim Sütçü, a prisoner who was transferred to Osmaniye Prison from Konya Ereğli Prison was subjected to physical violence of the wardens for he rejected strip search at the entrance of prison. It is learned that torture and ill-treatment continued at certain areas in prison where surveillance cameras do not cover and İbrahim Sütçü got wounded due to violence. It is also stated in the news reports that İbrahim Sütçü was being kept in a single cell and his demand for ward was rejected, he was being taken to open-door areas only 1 hour a day, his rights for sports, social and cultural activities are being prevented and he was forced to stand in military order during roll-calls.

It is learned from the news coverage of January 29, 2020 that prisoners have problems in heating and hot water supply in Tarsus T Type Prison No 1.

The final trial of the case against Mehmet Aydın Alökmen, former Democratic Regions Party (DBP) co-mayor of Savur district of Mardin, is held at Mardin Heavy Penal Court No 2 on January 29, 2020 After defence hearings the court sentenced Mehmet Aydın Alökmen to 7 years and 6 months on the charge of ‘being an illegal organisation member’ and to 2 years and 9 months for ‘making propaganda for an illegal organisation’.

(01/270) Journalist on Trial in Diyarbakır…

The trial of the case against journalist Aziz Oruç, for his social media posts, is held at Diyarbakır Heavy Penal Court No 9 on January 29, 2020.

Aziz Oruç joined the trial from Ağrı Patnos Prison via sound and vision system. The prosecutor declared legal opinion and demanded sentence from 10 months up to 5 years for Aziz Oruç. The court adjourned the trial to March 2, 2020.

It is learned that, 10 proceedings against 6 parliamentary members from HDP including co-chairs Pervin Buldan and Sezai Temelli, are submitted to the Constitution and Justice Committee of the Grand National Assembly.

HDP MP’s subjected to proceedings are: Pervin Buldan (1 proceeding), Sezai Temelli (4 proceedings), Ağrı MP Berdan Öztürk (2 proceedings), Diyarbakır MP Remziye Tosun (1 proceeding), Diyarbakır MP Musa Farisoğulları (1 proceeding), Diyarbakır MP Semra Güzel (1 proceeding).

It is learned from the news coverage of January 28, 2020 that F. Ç. (m), a 15-years old child was stopped by the police in Denizli neighbourhood of Seyhan district of Adana, and was subjected to verbal and physical violence of the police. It is learned that F. Ç. was stopped by the police on the grounds that he made an interview with journalists about violence and being forced to be a police informant he was subjected to while he was under custody. It is reported that F. Ç. was wounded at the eyebrow due to violence. F. Ç. was detained by the police on the grounds of ‘making propaganda for an illegal organisation’ on January 20, 2020 and was forced to be a police informant at Denizli Police Station in Seyhan district of Adana, and was subjected to physical violence of the police for rejecting it.

(01/253) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling 1176 days to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on January 28, 2020 at 13.30, and at 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on January 28, 2020, 2 people (Mahmut Konuk and Nazan Bozkurt) and at 18.00 2 people (Merve Demirel and Nazan Bozkurt) were detained.

Thus in total 4 people were detained due to press declaration intended to be held in Yüksel Street on January 28, 2020. It is learned detained people were released on the same days they were detained.

(01/254) Police Prevention to a Protest in Izmir…

The police prevented the press declaration in Konak district of Izmir on January 28, 2020, organized by People’s Democratic Party (HDP) including Izmir MP Serpil Kemalbay, to protest Elazığ Governorate’s blocking of humanitarian aid from Ergani Municipality of Diyarbakır. After the earthquake in Elazığ on January 24, 2020, two trucks with relief supplies coming of HDP’s Ergani Municipality was excluded by Elazığ Governorate from entering the city.

It is learned from the news coverage of January 28, 2020 that Iranian rap singer Amir Hossein Maghsoudloo was detained in Fatih district of Istanbul. It is stated in the news reports that Maghsoudloo was being sought on red notice in Iran on the grounds of ‘promoting drug addiction’.

(01/256) Non-Prosecution for Torture Allegation in Mardin…

It is learned from the news coverage of January 28, 2020 that, Mardin Public Prosecutor’s Office decided non-prosecution on the complaint of F. A. who was subjected to torture and ill-treatment under custody. Fevzi Adsız, lawyer of F. A., states that the prosecutor’s office made the decision without witness hearing and investigation on camera recordings. F.A. was detained in the police intervention against protests in Mardin on August 21, 2019, which started after trustee appointment of the Ministry of Interior to Mardin; was subjected to torture and ill-treatment under custody. It was stated that F.A. had to have sutures on his back due to torture, and that he was forced to sign a detention report and since he rejected to do so, he was taken to containers in the yard of the police directorate where he was subjected to sexual assault and rape threats of the police.

The trial of the case against Osman Kavala, Yiğit Aksakoğlu, Ali Hakan Altınay, Ayşe Mücella Yapıcı, Ayşe Pınar Alabora, Can Dündar, Çiğdem Mater Utku, Gökçe Yılmaz, Handan Meltem Arıkan, Hanzade Hikmet Germiyanoğlu, İnanç Ekmekçi, Mehmet Ali Alabora, Mine Özerden, Şerafettin Can Atalay, Tayfun Kahraman and Yiğit Ali Ekmekçi, for Gezi Park protests in 2013, is held on October 8, 2019.

The indictment demands heavy life imprisonment for 16 people on the charge of ‘attempting to abolish the government of the Republic of Turkey or to prevent it from fulfilling its duties’. The indictment also demands sentence for defendants on the charges of ‘qualified damage to property’, ‘possession or exchange of hazardous substances without permission’, ‘damaging places of worship and cemeteries’, ‘qualified robbery’, ‘injury’, ‘opposition to Law on the Conservation of Cultural and Natural Property No 2863’, and ‘opposition to Law for the Firearms and Knives and Other Tools No 6136’.

It is reported that the court board rejected recusation demand and lawyers left the court room in reaction to this. The court board continued judging in the absence of lawyers and Republican People’s Party (CHP) MP Sezgin Tanrıkulu who react to this was taken out of the courtroom. The court rejected the appeal made to its earlier decision to accept Mevlüt Saldoğan, who is charged for killing Ali İsmail Korkmaz during Gezi Park protests, to join the trials as injured party.

The court decided to continue detention of Osman Kavala, despite of ECHR decision which rules immediate release and adjourned the trial to January 28, 2020. 

Business person Osman Kavala was arrested on November 1, 2017. Yiğit Aksakoğlu was arrested on November 18, 2018 and was released at the first trial on June 24, 2019.

(01/258) The Case Against People Evacuated from Sur…

The trial of the case against 40 people including 19 arrestees who were evacuated from the buildings they were stuck in during the curfew in Sur district of Diyarbakır during February and March, 2016; is held at Diyarbakır Heavy Penal Court No 5 on January 28, 2020.

The court has decided to separate the cases for each person on January 10, 2020.

The court sentenced 1 person (İhsan Karatay) to 15 years on the charge of ‘being an illegal organisation member’. The court adjourned the trial of Hamza Tunç to February 27, 2020.

The case against 5 people [Mehmet Demir (former co-mayor of Kumçatı town of Şırnak), Veli Encü, and HDP employees Salih Kerçin, Mazlum Güzel and Şeyhmus Kerçin], on the charge of ‘being an illegal organisation member’ is held at Şırnak Heavy Penal Court No 1 on January 28, 2020. The prosecutor declared legal opinion and demanded sentence for Mehmet Demir and Mazlum Güzel on the charge of ‘being an illegal organisation’ and for Veli Encü and Şeyhmus Kerçin on the charge of ‘attempt to aid an illegal organisation’ and acquittal of Salih Kerçin. The court decided to continue detention of 5 people and adjourned the trial to January 30, 2020. 5 people were detained on May 22, 2019 and were arrested on May 24, 2019.

The trial of the case against Güven Boğa, former Adana branch chair of Education and Science Workers Union (Eğitim-Sen) on the charge of ‘violating the law on demonstrations and meetings’ is held at Adana Penal Court of First Instance No 10 on January 28, 2020. The court adjourned the trial to February 11, 2020.

(01/263) Blockage of Municipality Aid in Elazığ…

It is learned from the news coverage of January 28, 2020 that trucks with relief supplies for those injured at Elazığ earthquake coming from HDP’s Ergani Municipality were stopped by the police in Maden district and was sent back to Ergani in order to deliver to Red Crescent. This was the second time of blockage of humanitarian aid trucks of Ergani Municipality. Elazığ Governorate has excluded two trucks of Ergani Municipality from entering the city on January 26, 2020.

(01/264) Ban of Events in Hakkari…

Hakkari Governorate made a declaration on January 28, 2020 and announced that, all open events such as demonstrations, press declarations, meetings, sit-ins, opening stands and tents, festivals, concerts, delivering leaflets and so on are banned for 15 days as of January 29, 2020. This extended the ban on all events in Hakkari to 314 days since April 4, 2019.
