10 August 2018 Daily Human Rights Report

(08/082) Operations and Attacks in Southeast…

It is learned that 1 soldier died and 5 soldiers were wounded in a mortar attack of HPG militants to a military base in Güven mountain in Çukurca district of Hakkari on August 9, 2018.

It is learned from news coverage of August 9, 2018 that 3 militants died in a clash between security forces and HPG militants in rural areas of Nusaybin district of Mardin on July 24, 2018; and 2 militants died in a clash in rural areas of Diyarbakır on August 1, 2018.

It is learned from news coverage of August 9, 2018 that, HPG took responsibility for death of Ahmet Nabi, the village guard who was found dead near Sudüğün village of Sancak town of Bingöl on August 6, 2018.

It is learned from news coverage of August 9, 2018 that security forces prevented villagers of Üzümlü village of Hakkari’s Çukurca district from fighting the forest fire in the village, and that the fire department were allowed to intervene into only the area around Karataş Gendarmerie Station.

(08/083) Report on Death of Two People in Hakkari…

A delegation of People’s Democratic Party (HDP) MP’s, Human Rights Association (IHD) representatives and lawyers from Platform of Lawyers for Freedom (ÖHP) inspected the incident scene of explosion which caused death of Nurcan Karakaya, a military member’s spouse, and her baby Mustafa Bedirhan Karakaya in Yüksekova district of Hakkari on July 31, 2018. It is stated in the report of inspection that there was no clear information and evidence regarding the reason of the explosion and that the concrete evidence was still in the incident scene. The delegation suggested establishing a commission in Grand National Assembly to reveal the material facts before the evidence would be spoiled.

(08/084) Migrant Boat Sank in Aydın…

It is learned that a boat carrying immigrants to cross to Greece sank off the coast of Kuşadası district of Aydın on August 9, 2018, and 9 people including 7 children died.

(08/085) Torture and Ill-Treatment in Prison…

It is learned from news coverage of August 9, 2018 that 19 prisoners who were transferred to Kayseri Women’s Prison from Tarsus Women’s Prison under coercion, were not given their belongings, and that they were subjected to ill-treatment and psychological oppression.

(08/086) Right to Health Prevented in Prison…

It is learned from news coverage of August 9, 2018 that Şakir Akkurt, an ill prisoner who has been transferred to 3 different prisons (Kandıra, Bandırma and Akhisar Prisons) in the last year, could not get proper and regular treatment due to transfers. It is reported that Şakir Akkurt has eye-infection because of not being treated.

(08/087) Rejection to Meeting Request with Abdullah Öcalan…

It is learned that the appeal made on August 9, 2018 to chief public prosecutor’s office in Bursa by PKK leader Abdullah Öcalan’s lawyers in order to visit their client was rejected the same day on the grounds of limitations for prisoners in accordance with the law on the execution of sentences and security measures (law no 5275). With the last rejection, it was the 779th time that appeals for visiting Öcalan have been rejected so far. Abdullah Öcalan has met his lawyers on July 27, 2011 for the last time.

(08/088) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling for a while to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on August 9, 2018 at 13.30 and 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on August 9, 2018, 2 people (Acun Karadağ and Gülnaz Bozkurt) and at 18.00 2 people (Gülnaz Bozkurt and Mahir Kılıç) were detained.

Thus in total 4 people were detained due to press declaration intended to be held in Yüksel Street on August 9, 2018. It is learned that detainees were released the same day.

(08/089) Nuriye Gülmen and Mehmet Dersulu are Released…

Academician Nuriye Gülmen, who was one of the initiator of “I Want My Job Back” protests in Yüksel Street, Ankara, and Mehmet Dersulu, one of the protesters, who were detained in Bodrum district of Muğla on August 8, 2018, are released by the court on juridical control conditions.

It is learned that Nuriye Gülmen and Mehmet Dersulu were in Bodrum to support Engin Karataş, an Education and Science Workers’ Union member teacher who was dismissed by a state of emergency decree on October 29, 2016, and who has been organising “I Want My Job Back” protest in Bodrum district of Muğla. It is reported that the police wanted to make a criminal record check while the group was flying kites to protest, and Nuriye Gülmen and Mehmet Dersulu were detained after they say “You already knew us” and reject to show their ID cards.

Nuriye Gülmen was brought to the court house in wheelchair, and their lawyer stated the following on police violence to which Nuriye Gülmen and Mehmet Dersulu were subjected: “We have learned that our client Nuriye Gülmen was attacked by the police while she was taken to hospital for health check. She possibly has a fracture in her left leg. We have also learned that Mehmet Dersulu was attacked while being detained and subjected to pepper gas sprayed at close range.”

(08/090) HDP and DBP Members and Executives on Trial in Istanbul…

The case against 21 members and executives of Democratic Regions Party (DBP) and People’s Democratic Party (HDP), including 8 arrestees, on Istanbul Heavy Penal Court No 22 is held on August 9, 2018. After defence hearings the court decided to continue detention of 8 people (journalist Haydar Ergül, DBP and HDP executives Eşref Yaşar, Ahmet Sağnıç, Ercan Doğru, Aygül Turhan, Mustafa Elma, Abdullah Geldi, Münevver İlingi and Aysel Diler) and adjourned the trial to November 2, 2018.

21 people have been detained in house raids in Istanbul on July 28, 2018 and have been arrested on August 11, 2017.

(08/091) Detentions and Arrests in Alleged Link to Coup Attempt…

On August 9, 2018, 6 people (including 3 children) are detained in Edirne in alleged attempt to illegally flee to Greece. It is reported that 3 children were given to their relatives afterwards.

It is learned that on August 9, 2018, a detention warrant was issued in Ankara for 12 teachers from schools which are closed down by state of emergency decrees and 4 of these people were detained.

(08/092) Trials in Alleged Link to Coup Attempt…

The final trial of the case against 51 people including Anadolu Atayün, former deputy police chief of Konya who has been dismissed by a state of emergency decree, on Konya Heavy Penal Court No 2, is held on August 9, 2018. The court sentenced Anadolu Atayün to 40 years and 6 months in total for ‘being an illegal organisation member’, ‘violating the prosecution process’, ‘forgery of official documents’ and ‘defamation’. The court sentenced 13 defendants to jail penalties differing from 1 year 8 months to 20 years. The court acquitted 37 defendants.

The final trial of the case against former judge Gültekin İpeş, who has been dismissed by a state of emergency decree, on Izmir Heavy Penal Court No 13 is held on August 9, 2018. The court sentenced Gültekin İpeş to 8 years an 9 months for ‘being an illegal organisation member’.
