3 November 2017 Daily Human Rights Report…

(11/033) Extrajudicial Killing Claim in Diyarbakır …

It is learned that 1 police officer and 1 alleged YPS militant died during a house raid in Diyarbakır’s Kayapınar district and 10 police officers were injured. A person named Murat Çelik living with his wife and 3 children was reportedly executed when he was wounded during the operation.

A witness revealed to press what he saw during the incident and said: ‘‘First there was a raid to the house. Then clash began and they forced the door and opened it. Snipers were positioned everywhere. Then we saw that the man inside the house got out to the balcony. He was wounded, covered in blood and he raised his hands. Then an officer came out to the balcony as well. We though he was going to take him captive. At that moment, executed him.’’

Governorate of Diyarbakır released a statement and said that 8 people are detained following the same investigation. Murat Çelik’s mother was also detained.

(11/034) Operations and Attacks Southeast…

It is learned that a soldier heavily injured due to open fire from HPG militants on November 2, 2017 in Hakkari’s şemdinli district, died in hospital on November 3, 2017.

(11/035) People Beaten by the Police on the Street in Karabük…

It is learned that a person named Zahit Yarar (56), his spouse and 2 children were brutally beaten on the street by a police officer in Karabük on October 23, 2017. The incident came out when the video footage one witness recorded with his phone was published through media on November 2, 2017. It is reported that Zahit Yarar filed official complaints against police officers.

(11/036) Torture and Other Ill-Treatment in Prison…

It is learned from news coverage of November 3, 2017 that prisoners in Ödemiş Type T Prison who were transferred to hospital were handcuffed for the second time to accompanying soldiers’ arms and the prisoners who refused this were not sent to the hospital.

It is learned from news coverage of November 3, 2017 that prisoners were placed in singular compartments in vehicles while going to hospital and court. Prisoners who refused this were not taken to court nor hospitals.

It is alleged that a prisoner named Hıdır Bakır was beaten and put into the isolation cell on November 3, 2017 in Tekirdağ No:2 Type F prison.

(11/037) Rejection of Meeting Request with Öcalan…

It is learned that on November 2, 2017 PKK Leader Abdullah Öcalan’s attorneys İbrahim Bilmez, Faik Özgür Erol and Ebru Günay requested from Bursa Public Prosecutor’s Office to meet with him. The request was denied on the same day based on limitations regarding the convicted prisoners due to Law on the Execution of Criminal and Security Measures Number 5275. With this latest decline meeting requests with Öcalan have been denied for the 701st  time. Öcalan last met with his attorneys on July 27, 2011.

It is learned that on November 3, 2017 PKK Leader Abdullah Öcalan’s brother and sister along with families of Ömer Hayri Konar and Veysel Aktaş who are both prisoners in Imrali, requested from Bursa Public Prosecutor’s Office to meet with them. The request was denied on the same day based on limitations regarding the convicted prisoners due to Law on the Execution of Criminal and Security Measures Number 5275.

(11/038) Police Intervention Towards ‘‘I Want My Job Back’’ demonstrations in Ankara…

Civil servants discharged from their jobs with Statuary Decree’s planned for press meetings in front of the Human Rights Monument in Ankara Yüksel Street on November 2, 2017. Demonstrations of the group has been going on for several months. Two meetings planned at 13.00 and 18.00 respectively were both intervened and prevented by the police forces.

It is learned that 2 people (Sultan Aydoğdu and İlker Işık) during the intervention towards the meeting at 13.30 on and 5 people (Veli Saçılık, Turgut Türksoy, Simge Aksam, İlker Işık and Mustafa Keçeli) during the 18.00 meeting were detained. It is learned that police officers also prevented press members from reporting the incident. It is learned that people detained after the 18:00 meeting were fined 1135 TL penalties due to violating the Misdemeanor Law.

In total, 7 people were detained on October 31, 2017 Yüksel street demonstrations. It is reported that detainees were released within the same day.

(11/039) Detention of Student on Hunger Strike to Support Nuriye Gülmen and Semih Özkaka…

It is learned that a student of Çanakkale Onsekiz Mart University named Ceren Öztemiz who has been on a hunger strike for 20 days to support Nuriye Gülmen and Semih Özakça was detained in her dorm room on November 2, 2017.

(11/040) Detention and Arrests…

It is learned that 3 of 5 HDP members including HDP Osmaniye District Executive Kamuran Barak, who were detained on November 1, 2017 in Osmaniye, were released with a judiciary control condition. Kamuran Babrak, Abdullah Turan, Özkan Aktaş were released. Birsen Karataş sent to court on November 3, 2017 was arrested due to ‘membership of an illegal organization’. Abdülmecit Caymak was released with judiciary control condition.

It is learned that 4 of 11 people detained in Urfa were arrested by court on November 2, 2017. 2 people were released with overseas travel bans. 7 people were released. Names of arrested: Kemal Baysan, Yasin Pişkin, Hasan Karakurt, Mahmut Uygurlar.

A person named Ş.M. detained in Aydın was arrested by court on November 2, 2017 due to making propaganda of an illegal organization.

It is reported that HDP Ankara District Executive Ayfer Balıkçı and former BES Secretary General Davut Balıkçı were detained on November 3, 2017 in Ankara during house raids. Both were detained due to ‘making propaganda of an illegal organization’ allegations.

It is learned that 2 unidentified people were detained during a house raid in Diyarbakır’s Silvan district on November 3, 2017.

(11/041) Trial of HDP MP…

The final trial of HDP Hakkari MP Selma Irmak for the case opened by Diyarbakır Heavy Penal Court No 5, took place on November 3, 2017. The court sentenced Irmak to 10 years due to membership of an illegal organization and making propaganda of an illegal organization and also decided for the continuity of her arrest. Selma Irmak was detained and arrested on November 4, 2016.

(11/042) Trials of Co-Mayors…

The trial of 8 people including former Van municipality Co-Mayor Bekir Kaya continued on November 2, 2017. The case was opened by Van Heavy Penal Court No 2. Bekir Kaya attended the trial through SEGBİS from prison and made his defense. A witness testifying in court named Mervan Ural revealed that her previous testimonies were invalid because she was forced to sign her testimony under pressure. The court ruled for the continuity of arrest for Bekir Kaya and release of other defendant Neriman Uyar with judiciary control condition. The court adjourned the trial date to February 20, 2018. Van Governor İbrahim Taşyapan was appointed as a trustee to Bekir Kaya’s position on November 17, 2016. Kaya was detained on November 17, 2017 and arrested on November 18, 2017.

(11/043) Writer on Trial in İstanbul…

The final trial for writer Hamide Yiğit took place on November 3, 2017. The case was opened by Istanbul Heavy Penal Court No 30 due to a ‘making propaganda of an illegal organization’ allegation towards Yiğit through her book “Tekmili Birden IŞİD: El Kaide’den IŞİD’e Amerika İçin Cihat”. Following the defenses the court acquitted Hamide Yiğit.

(11/044) Person on Trial for ‘Insulting Atatürk’…

It is learned on November 3, 2017 that Penal Department No 18 of Istanbul Regional Court of Justice overruled the jail sentence of 2 years 6 months towards Hasan Akar who was on trial for ‘insulting the memory of Atatürk’ and ‘provoking public on hostility and hatred’. It is also reported that Akar was released.

(11/045) Detentions and Arrests in Connection with the Coup d’État Attempt…

It is learned that 20 of 60 people issued with detention warrants during operations in 14 cities through an İstanbul based investigation, were detained on November 2, 2017. 23 soldiers were detained through a Kocaeli based investigation in 13 cities and 1 person was detained in Ankara.

It is reported that former sub governor of Akkuş Hüseyin Atilla was arrested by court on November 2, 2017. Hüseyin Atilla was discharged from his role with a Statuary Decree.

It is learned that 8 of 21 people detained in Sivas were arrested by court on November 2, 2017. 13 people were released with judiciary control conditions.

(11/046) Trials in Connection with the Coup d’État Attempt…

The final trial of 40 defendants employed in the 14th Mechanized Infantry Brigade 1st Tank Battalion including 15 arrested took place on November 2, 2017. The court sentenced former Lieutenant Üzeyir Ayten to a life sentence due to ‘attempting to overthrow constitutional order’. The court sentenced other 10 defendants to jail time ranging from 18 years 9 months to 20 years and acquitted 29 defendants.

The final trial of a former education center teacher named Esra Akay took place on November 2, 2017. The case was opened by Erzurum Heavy Penal Court No 2. The court sentenced Esra Akay to 6 years 3 months due to membership of an illegal organization and ruled for her release.

The final trial of 5 former police officers including 3 arrested took place on November 2, 2017. Officers were discharged from their jobs with a Decree with the Force of Law. The court sentenced 3 defendants to jail penalties ranging from 7 years 5 months 3 days to 8 years 1 month 6 days due to ‘membership of an illegal organization’. The court acquitted 2 defendants.

The final trial of business person Halil Benli took place on November 2, 2017. The case was opened by Çorum Heavy Penal Court No 2. The court sentenced Benli to 6 years 3 months due to ‘membership of an illegal organization’.

The final trial of former teacher Şeref Çolak took place on November 2, 2017. The case was opened by Kahramanmaraş Heavy Penal Court No 2. Çolak was discharged from his role with Statuary Decree’s. the court sentenced Şeref çolak to 2 years 1 month due to ‘aiding an illegal organization’.

The trial for 15 defendants 13 of whom are arrested including Former Gendarmerie Commander Coronel Yurdakul Akkuş, continued on November 2, 2017. The case was opened by Bursa Heavy Penal Court No 8. Following the defenses the court ruled for the release of one defendant and adjourned the trial to a further date.

The trial of a former police chief named Erdal D. continued on November 2, 2017. The case was opened by Denizli Heavy Penal Court No 5. Following the defenses the court ruled for the continouty of Erdal D’s arrest and adjourned the trial to a further date.

The trial of former President of Judges and Prosecutors Union Murat Aslan continued on November 2, 2017. The case was opened by Ankara Heavy Penal Court No 25 due to an alleged ‘membership of an illegal organization’. Following the defenses and testimonies of the witnesses the court ruled for the continuity of Murat Aslan’s arrest and adjourned the trial to December 18, 2017.
