(01/097) Torture and Ill-Treatment in Prison…
It is learned from the news coverage of January 12, 2023 that, PKK leader Abdullah Öcalan and Ömer Hayri Konar, Veysi Aktaş and Hamili Yıldırım in İmralı High Security Prison were given the penalty of prevention from family visits for 3 months as a result of disciplinary proceedings.
It is learned from the news coverage of January 12, 2023 that, a prisoner named Mahsum Sarp, Elazığ High Security Prison No. 2 was subjected to torture and ill-treatment of the correction officers and his tooth was broken.
It is learned from the news coverage of January 13, 2023 that, İsmail Taylan and İsa Aslan, two prisoners in Giresun Espiye L Type prison were handcuffed by the correction officers and were taken out of their ward by physical violence; they were subjected to torture and ill-treatment which injured them in several parts of their body. It is also stated in the news reports that other prisoners in the ward were threatened by the correction officers saying “It’s time to execute you”.

It is learned from the news reports that 6 prisoners in Elazığ High Security Prison No. 2 started a hunger strike to demand an end to right violations on January 12, 2023.

Journalist Sezgin Kartal who was detained on January 10, 2023 in Istanbul was arrested by the court on the grounds of ‘being an illegal organisation member’ on January 13, 2023.

The trial of the case against 6 people including human rights defender and medical secretary of the HRFT in Izmir Aytül Uçar and the Progressive Lawyers’ Association (ÇHD) member Erdoğan Akdoğdu is held at Izmir Penal Court of First Instance No. 49 on January 13, 2023. 6 people (Aytül Uçar, Emine Akbaba, İrem Çelikbaş, lawyer Erdoğan Akdoğdu and 2 others) have been detained by the police intervening the protest against the new rector appointed to Boğaziçi University, held in Izmir on June 24, 2021.
The indictment demands sentence for 6 people on the charges of ‘violating the Law on Meetings and Demonstrations’, ‘resisting to prevent public duty’ and ‘insult’.
The court rejected the request to watch the footage of the day of the incident at the trial; accepted the rejection of the submitted expert report and the requests for the images to be sent to a new expert, adjourning the trial to May 12, 2023.

The trial of the case against the Human Rights Association Istanbul branch executive Hatice Onaran, on the grounds of sending money to prisoners, is held at Istanbul Heavy Penal Court No. 13 on January 12, 2023. The indictment demands sentence for Hatice Onaran on the charge of “violating the Law on the Prevention of Financing of Terrorism”. After defence hearings the court adjourned the trial to March 21, 2023.

The trial of the case against the executive board members of the Chamber of Architects Ankara branch (branch chair Tezcan Karakuş Candan, branch secretary Nihal Evirgen, and board members Muteber Osmanpaşaoğlu, Ünal Kara, Tuğba Arslan, Ece Yoltay and Özgür Bayramoğlu) for giving the International Television Journalism to Jin TV channel, is held at Ankara Heavy Penal Court No. 25 on January 13, 2023. The indictment demands sentence for 7 people on the charge of ‘making propaganda for an illegal organisation’. After defence hearings the court adjourned the trial to February 24, 2023.

The trial of the case against 28 people including the Democratic Regions Party (DBP) former co-chair and former deputy Sebahat Tuncel and Jiyan News grant holder İdris Yayla, on the grounds of the protest against trustee appointments to the municipalities in 2016, is held at Batman Penal court of First Instance No. 1 on January 12, 2023. The court adjourned the trial to May 9, 2023.

The first trial of the case against 12 members and executives of the Peoples’ Democratic Party (HDP) is held at Istanbul Heavy Penal Court No. 24 on January 12, 2023. After defence hearings the court adjourned the trial to April 25, 2023.
5 of 12 people who were detained on July 29, 2022 were arrested by the court on August 2, 2022. 5 people were released by the court that accepted the indictment on September 7, 2022.

The trial of the case against 52 people, including journalist Yağmur Kaya who were detained at the Çağlayan Courthouse in Istanbul where they have been to support students who were detained for carrying rainbow flags during the protests against the rector appointment to Boğaziçi University by the President; is held at Istanbul Penal Court of First Instance No. 17 on January 13, 2023. The court adjourned the trial to July 7, 2023.

The trial of the case against 23 members and executives of DIAYDER (Religious Scholars Solidarity Association) including 1 arrestee, is held at Istanbul Heavy Penal Court No. 14 on January 13, 2023. After witness and defence hearings the court decided to release Ekrem Baran and adjourned the trial.

It is learned that the indictment of Tunceli Public Prosecutor’s Office against 19 people who were detained on the grounds of celebrating Newroz in city, is accepted by Tunceli Heavy Penal Court on January 13, 2023. The first trial will be held on March 13, 2023.

The final trial of the case against Mika Can Raun, the charge of ‘degrading the symbols of state sovereignty’ and ‘insulting the memory of Atatürk’, for sharing a video of throwing Turkish Lira in a toilet on social media, is held at Istanbul Penal Court of First Instance No. 43 on January 12, 2023. The court acquitted Mika Can Raun.

The first trial of the case against a person named Merve Taşkın, on the grounds of photographs she shared on social media is held at Istanbul Penal Court of First Instance No. 55 on January 12, 2023. The indictment demands sentence for Merve Taşkın on the charge of ‘obscenity’. The court adjourned the trial to January 26, 2023.

The trial of the case against 5 correction officers (Ç. Ş., H. G., H. C., R. D., Y. M.) on duty in Adana Kürkçüler F Type Prison for the torture against and other ill-treatment of the prisoner named Şehmuz Emen is held at Adana Heavy Penal Court No. 10 on January 12, 2023. The indictment demands sentence for the correction officers on the charge of ‘torture’. Security camera footage of torture and ill-treatment against Şehmuz Emen was featured in the press. After defence hearings, the court adjourned the trial to April 13, 2023.
