(12/093) Operations and Attacks…

The Ministry of National Defence declared that 3 soldiers (Ali Sarı, İdris Aksöz and Doğanay Çelik) died and 7 soldiers got wounded in a clash between HPG militants and Turkish Armed Forces units in Zap area of the Iraqi Kurdistan Regional Government on December 9, 2021.

The Ministry of National Defence declared that 1 soldier (Emre Ceyalan) died after falling in Idlib area of Syria on December 9, 2021.

(12/094) Suspicious Death in Prison…

On December 9, 2021, Garibe Gezer, lost her life in a suspicious way the solitary cell in Kocaeli Kandıra F Type Prison. The prison administration claimed Garibe Gezer killed herself. It is learned from the news reports that; Garibe Gezer’s body was taken to the Forensic Medicine Institution for autopsy without noticing the lawyers. And it is reported that the preliminary report states no cause of death detected.

Asya Gezer, sister of Garibe Gezer, stated the following to the press: “I spoke with her on November 16 for the last time. She told me the pressures on her was getting milder, so she was feeling better. But she told me that she was imposed solitary cell confinement for 20 times earlier. So she told me that she would go in a solitary cell. I told her that I would see her in January, she was happy to hear that, she told me she would look forward to it (…) I do not believe she killed herself.”

Garibe Gezer was subjected to torture and ill-treatment and sexual assault of the correction officers on May 21, 2021.

(12/095) Torture and Ill-Treatment in Prison…

It is learned from the news coverage of December 9, 2021 that, Kadri Katar, a prisoner who was transferred from Şırnak T Type Prison to Erzurum E Type Prison, was subjected to torture and ill-treatment during transfer. It is also stated in the news reports that he was imposed a penalty of prevention of communication and social rights for 1 month as a result of disciplinary proceedings.

(12/096) Detained People in Malatya for Social Media Posts…

On December 9, 2021, 2 people are detained on the grounds of making propaganda for an illegal organisation on social media in Malatya.

(12/097) Journalists on Trial in Istanbul…

The trial of the case against 6 journalists (Ömer Çelik, news director and Metin Yoksu, reporter of Dicle News Agency which was closed down by a state of emergency decree; Tunca Öğreten, former editor of Diken news portal; Mahir Kanaat, Birgün newspaper employee; Eray Sargın, editor in chief of Yolculuk newspaper; Derya Okatan, Etkin News Agency news director) is held at Istanbul Heavy Penal Court No 29 on December 9, 2021.

The indictment demands sentence for 6 journalists on the charges of ‘being an illegal organisation member’, ‘making propaganda for an illegal organisation’ and ‘blocking and breaking the information system, changing or destroying the data’, for reporting on the e-mails of Berat Albayrak, Minister of Energy and Natural Sources which were hacked by Redhack and then published on the internet.

The court decided to continue judicial control conditions for the journalists and to widen the investigation, adjourning the trial to December 31, 2021.

3 of 6 journalists who were detained on December 25, 2016, were arrested by the court on January 17, 2017. Ömer Çelik was released on October 24, 2017; Tunca Öğreten and Mahir Kanaat were released on December 6, 2017.

(12/098) Criminal Complaint Against Academicians…

It is learned from the news coverage of December 9, 2021 that, the new rector appointed to Boğaziçi University by the President has made criminal complaints against 16 academicians participating in the daily protests in the campus.

(12/099) Vartinis Massacre Case…

The retrial of the case against former gendarmerie lieutenant Bülent Karaoğlu, for death of 9 members of Öğüt family including 7 children, in their house that was burned down by soldiers on May 17, 1993 in Altınova (Vartinis) town of Korkut district in Muş; is held at Kırıkkale Heavy Penal Court No 1 on December 9, 2021. The court adjourned the trial to January 27, 2022.

The final trial of the case was held on March 1, 2016; and the local court has acquitted all 4 defendants (Hasköy Gendarmerie Commander lieutenant Bülent Karaoğlu, Hasköy District Company Commander Lieutenant Hanifi Akyıldız, Gökyazı Gendarmerie Commander master sergeant Turhan Nurdoğan and Muş Security Directorate Special Task Department chief police Şerafettin Us). On January 26, 2021, the Penal Department No 1 of the Court of Cassation has approved the acquittal for 3 defendants but reversed the local court’s verdict regarding Bülent Karaoğlu, who was the commander of Hasköy Gendarmerie Station back then. The case will drop due to term of limitation if it will not be finalised until October 3, 2023.

(12/100) Prison Massacre Case…

The trial of the case against 196 people who were on duty at Gendarmerie General Command during “Operation Back to Life”, which caused death of 12 people and injury of 29 in Bayrampaşa Prison, is held on Bakırköy Heavy Penal Court No 13 on December 9, 2021. The operation which killed 32 people in 20 prisons in total was conducted to enable conversion of the prisons to F Type prisons and to end hunger strikes in prisons on December 19, 2000.

The court decided to call Sadettin Tantan, the Interior Minister back then and Ali Suat Ertosun head of the General Directorate of Prisons and Detention Houses for testimony and adjourned the trial to April 19, 2022.

(12/101) Covid-19 Pandemic…

The Ministry of Health declared that 195 people died due to Covid-19 pandemic and the daily number of Covid-19 cases is 19,696 as of December 9, 2021.

The death toll from Covid-19 in Turkey increased to 78,602 and total number of confirmed ill patients is 8,984,407 as of December 9, 2021.

It is learned that veterinary physician Fuat Güneş in Adana and doctor Tankut Sevim in Aksaray lost their lives due to Covid-19 on December 9, 2021.
