(02/074) Torture and Ill Treatment in Custody…
According to news appeared in press on 8 February 2017, B. O., who had been detained on 6 January 2017 and released on 1 February 2017, was subjected to torture during his detention period. According to his statement, his hands were cuffed from behind, his genital organs were squeezed and the police, after pouring cold water on his naked body, put him in front of a fan. He added that detainees were subjected to torture while giving their police statements with their lawyers.

Members of Socialist Party of The Oppressed (ESP) and Federation of Associations of Socialist Youth (SGDF) Beren Atıcı, Ahmet Cengiz, Hüseyin Akyüz and Umit Tekin were detained on 17 January 2017 and were released with a judicial control condition on 24 January 2017. The prosecutor office objected the release. Tekin was detained on 6 February 2017 in Ceylanpinar again and was arrested. Akyüz and Cengiz were detained on 5 February 2017 again. While Akyüz as released with a judicial control condition, Cengiz was arrested.
According to the news appeared in press on 8 February 2017, Tekin was subjected torture in Ceylanpınar Police Headquarter. There, he was beaten, his genital organs were squeezed. The police also poured cold water on him and made him wait naked. He was threatened by members of Police Special Forces.

HDP Agri MP Leyla Zana was detained upon an arrest warrant on 8 February 2017. Zana was taken to Diyarbakır Courthouse and after her statement had been taken, she was released.

The Co Mayor of Esendere sub-distirct Akif Kaya, who had been dismissed on 7 February 2017, was detained on 8 February 2017 by the gendarme forces during a house raid.

Emin Baran, board member of Urfa Bar, was arrested for ‘being a member of an illegal organisation’ on 8 February 2017 when he went to Urfa Public Prosecutor’s Office.
Baran’s office had been raided by the police forces and police had found the magazine Sizinti and the daily Azadiya Welat at his office. Because of these, an arrest warrant had been issued for him.

The HDP Co-Chair for Yuksekova, a district of Hakkari, Nurcan Yasar, DBP Co-Chair for Esendere sub-district, Mehmet Capraz and a person named Baki was detained on 8 February 2017 by the police forces during a house raid.
9 persons, including a child named B. D., was detained on 8 February 2017 at Menemen, a district of Izmir, for ‘making propaganda of an illegal organisation’ by police forces during house raids.
Osman Inal, the distributor of the dailies Rojeva Medya and Ozgurlukcu Demokrasi who had been detained on 5 February 2017, was arrested on 8 February 2017 for ‘being a member of an illegal organisation.’

According to the news appeared in press on 8 February 2017, Istanbul Public Prosecutor’s Office prepared an indictment against Zeycan Balcı Simsek and 9 other lawyers from CHD for ‘resisting the officer.’ In the event which the indictment is about, after the hearing of the case in which 22 lawyers from CHD were tried on 30 March 2017, police intervened the lawyer who had tried to make a statement and the backbone of Simsek had been broken by a kick.

HDP Sırnak MP Selma Irmak gave testimony at Diyarbakır Heavy Penal Court No 8 for the case known as KCK/TM Main Trial. Irmak was brought to the court from Silivri Prison. Irmak made her defense in Kurdish. Court adjourned the hearing to April 2017.

According to the news appeared in press on 8 February 2017, Diyarbakır Public Prosecutor’s Office prepared an indictment against HDP Co-Chair Selahattin Demirtas for ‘being a member of an illegal organisation’, praise crime and crimenal’, inciting people to ‘inciting people to hatred and enmity’, ‘inciting people to disobey the laws’, ‘participating illegal meetings’, ‘inciting to commit a crime openly.’

Istanbul Criminal Court of First Instance No 2 started on 7 February 2017 the case against Cumhuriyet reporter Canan Coskun for ‘insulting the Turkish nation, Turkish State, the institutions and organs of the state’ according to the Article 301 of Trukish Penal Court. After the defense, the court adjourned the hearing to 13 April 2017.
The Urfa Public Prosecutor’s Office prepared an incitement about 9 persons for delivering explosive parts to ISIS under the cover of onion. One of the defendants, Doğan Gunes, presented to the court some documents which said that the man with whom he was being tired was working for MIT. Canan Coskun had made news about this with a title ‘MIT come out of Onion.’
