(09/047) Operations and Attacks in Southeast…

It is learned from the news coverage of September 5, 2018 that 1 militant died in a clash between security forces and HPG militants in rural areas of Kozluk district of Batman on August 31, 2018.

It is learned from the news coverage of September 5, 2018 that a forest fire started in the area between Güleç and Zerikan villages of Mazgirt district of Tunceli.

(09/048) Prevention of IHD Committee in Tunceli…

A committee of Human Rights Association (IHD) executives visiting Kutudere area on September 5, 2018 in Pülümür district of Tunceli in order to inspect the forest fires, is prevented by gendarmerie based on “instructions of the governor”. Raci Bilici, co-deputy of IHD, marked in his statements in the news reports that they wanted to meet the governor about the prevention however their demand was not responded.

(09/049) Torture and Ill-Treatment in Prison…

It is learned from the news coverage of September 5, 2018 that Mehdi Boz, an ill prisoner from Elazığ T Type Prison was subjected to physical violence of the wardens. It is stated in the news reports that Mehdi Boz submitted an appeal to prison administration about the violations of rights, and was subjected to physical violence by the wardens who tried to choke him and threatened him to death. It is also stated in the news reports that Mehdi Boz fainted due to violence and was taken to prison infirmary however, was not examined by the doctor on charge and was again subjected to physical violence by the wardens in infirmary. It is learned that Mehdi Boz was prevented from visit rights for 13 months because he rejects to be forced to carry ID’s in prison and was prevented from communication rights for 4 months due to disciplinary penalties given to him.

People’s Law Office made a declaration on social media on September 5, 2018 and announced that Deniz Şah and Emrah Yayla, two prisoners from Bolu F Type Prison were subjected to physical violence by the wardens and were handcuffed behind their backs and put in padded cells where they were not given water for 1 day.

(09/050) Prevention of Right to Health in Prison…

It is learned from the news coverage of September 5, 2018 that, Dicle Bozan, an ill prisoner with an amputated leg, has shrapnel pieces in her body and has her intestines out of her body, is prevented from right to health. It is stated in the news reports that Dicle Bozan is kept in Elazığ Women’s Prison and needs to be taken into operation immediately was transferred to Elazığ Public Hospital 5 times so far, however she was taken back to prison without being operated with excuses such as “doctor is not here”, “doctor is in another operation”, “the machine is broken” etc.

Dicle Bozan has started a hunger strike on April 20, 2018 with 3 prisoners in Menemen R Type Prison where she was transferred from Elazığ, because of being prevented from right to health. Dicle Bozan was transferred to Elazığ Women’s Prison on May 16, 2018.

(09/051) Lawyers on Hunger Strike in Prison…

On September 5, 2018, 17 lawyers from Progressive Lawyers Association and People’s Law Office, ended their hunger strike they started on September 3, 2018. Lawyers went on a hunger strike demanding to attend the first trial of the case against them which will be held on September 10, 2018. The hunger strike ended upon the court’s cancellation of the decision of hearing via sound and vision system and approving to have all arrested lawyers in the courtroom.

(09/052) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling for a while to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on September 5, 2018 at 13.30 and 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on September 5, 2018, 2 people (Mehmet Dersulu and Mahmut Konuk) and at 18.00 2 people (Nazan Bozkurt and Emir Karakum) were detained.

Thus in total 4 people were detained due to press declaration intended to be held in Yüksel Street on September 5, 2018. It is learned that detainees were released the same day.

(09/053) Police Intervention Against a Protest in Istanbul…

Türkan Albayrak, who was dismissed from her job at Sarıyer district Health Department, on the grounds of ‘personnel security investigation’ and ‘archive search’, on August 3, 2018; made a press declaration to regain her job on September 4 and 5, 2018 and attempted for a sit-in protest in front of Health Department. The police intervened the sit-in and detained Türkan Albayrak and 3 people supporting her on September 4, 2018 and detained Türkan Albayrak and 2 people supporting her on September 5, 2018. It is learned that detainees were released the same day.

(09/054) Police Raid to Journalists’ House in Istanbul…

On September 5, 2018, the police raided the house of Yeni Demokrasi newspaper employees. It is learned that nobody was detained and the police seized journalists’ belongings such as newspapers, magazines, etc.

(09/055) Police Raid to Journalist’s House in Diyarbakır…

It is learned from the news coverage of September 5, 2018 that in Kayapınar district of Diyarbakır, the house of journalist Gülistan Korban, who works for Azadi TV channel which was closed down by state of emergency decree, is raided by the police on September 5, 2018. It is reported that Gülistan Koban was not at home and thus was not detained, however his father Ahmet Korban was detained on the grounds of a “report to the police”, after the search in the house. It is stated in the news reports that Gülistan Korban’s brother Metin Korban’s house was also raided and he was subjected to physical violence by the police.

(09/056) Detained People in Diyarbakır…

4 people including an infant (Mülkiye Yetkin, Yahya Yetkin, R.T. (2, m) and Abdullah Daşlık) who were detained on September 3, 2018 in an operation to Çitlibahçe village of Hazro, after the curfew in Hazro and Lice districts of Diyarbakır, are released after statement procedures at Hazro Gendarmerie Station, on September 5, 2018.

(09 /057) The Cases Against Academics Who Are the Signatories of the Petition “We will not be a party to this crime!”…

The separate cases against 2 academicians (Research Assistants Şenay Çınar and Zeynep Arıkan from Boğaziçi University) for signing the petition “We will not be a party to this crime!” on Istanbul Heavy Penal Court No 37 for ‘making propaganda for an illegal organisation’ is held on September 5, 2018. The lawyers demanded immediate acquittal, otherwise consolidation of the case with the case on Istanbul Heavy Penal Court No 13 and legal proceedings to be continued based on Article 301 of Turkish Penal Code. The court decided to ask Istanbul Heavy Penal Court No 13 for related documents in order to continue trial according to Article 301 of Turkish Penal Code, and rejected other demands, and adjourned the trial to February 12, 2019.

(09/058) General Secretary of Revolutionary Youth Associations on Trial…

The case against Berkay Ustabaş, general secretary of Revolutionary Youth Associations (DGD) and a sociology student in Istanbul University, and against Helin Bölek, on Istanbul Heavy Penal Court No 26, is held on September 5, 2018. Berkay Ustabaş attended the trial via sound and vision system from Kırıkkale F Type Prison. It is learned that the chief judge interrupted by saying “You are committing a crime” Helin Bölek, who is also arrested, after her expressions “Berkin Elvan is killed by the police by order of the state” in her defence. The court took lawyer Çiğdem Akbulut, who objected her client to be interrupted. It is reported that the court board made a pause and lawyers were taken out of the courtroom after the pause.

After defence hearings the court decided to continue detention for Berkay Ustabaş and Helin Bölek, to send the demand of recusation to the higher court, to re-take defence of Helin Bölek and adjourned the trial to November 1, 2018.

The indictment demands sentence for Berkay Ustabaş and Helin Bölek on the charges of ‘organising and leading illegal meetings and demonstrations’, and ‘being an illegal organisation member’.

Berkay Ustabaş was arrested on January 5, 2018 at Çağlayan Courthouse where he has been to give statement. Helin Bölek was detained in a raid to İdil Cultural Center on November 21, 2016 and was arrested by the court on November 23, 2016.

(09/059) Detentions and Arrests in Alleged Link to Coup Attempt…

15 of 23 people including 6 mayors and 2 lieutenants who were detained on August 29, 2018 through an Ankara based investigation on Gendarmerie Command personnel, are arrested by the court on September 5, 2018. 8 people are released, provided that 7 of them are on juridical control conditions.

2 of 4 people who were detained on September 5, 2018 in an alleged attempt to illegally flee to Greece are arrested by the court. It is learned that 2 people are still under custody.

(09/060) Trials in Alleged Link to Coup Attempt…

The final trial of the case against 21 defendants including 3 arrestees, on Eskişehir Heavy Penal Court No 4 is held on September 5, 2018. The court sentenced 1 defendant to 15 years for ‘being an illegal organisation member’, and then reduced the sentence to 4 years and 2 months due to effective remorse laws. The court sentenced 2 arrested defendants to 6 years and 3 months each for ‘being an illegal organisation member’. The court released 3 arrested defendants according to the verdict. The court sentenced 6 defendants to 6 years and 3 months each and 1 defendant to 5 years for ‘being an illegal organisation member’; and sentenced 11 defendants to 3 years 1 month and 15 days.

The final trial of the case against 19 defendants including 9 arrestees on Kastamonu Heavy Penal Court is held on September 5, 2018. The court sentenced 13 defendants to jail penalties differing from 3 years to 12 years for ‘being an illegal organisation member’. The court separated the cases of 6 defendants and released 1 defendant.

(09/061) Special Security Zone in Hakkari…

Hakkari Governorate made a declaration on September 5, 2018 and announced 30 areas with given coordinates in central, Çukurca, Şemdinli and Yüksekova districts as special security zones between September 6 and September 30, 2018.

(09/062) Blocked News on the Internet…

It is learned from the news coverage of September 5, 2018 Bakırköy Penal Court of Peace blocked access to 10 news reports on several websites published in March 2015 about personal assets of CEO of KİPTAŞ. It is reported that the reason of court’s decision is ‘discrediting’.

(09/063) Rejection of Inquiry Motion for Torture Allegations…

It is stated in the news coverage of September 5, 2018 that, the inquiry motion submitted by Fatma Kurtulan, HDP group deputy chair, demanding investigation of torture and ill-treatment allegations about Tarsus T Type Prison, by an inquiry committee within the Grand National Assembly, is rejected by the speaker’s office on the grounds that some expressions in the motion are “rude and hurtful”.
