(08/043) Operations and Attacks…

The Ministry of National Defence announced on August 5, 2022 that, 1 soldier (Infantry Sergeant Reşat Engin) who has been injured in an attack to a military base in the Claw-Lock operation area of the Turkish Armed Forces units in the Iraqi Kurdistan Regional Government, died in hospital.

It is learned from the news coverage of August 7, 2022 that, 3 HPG militants died in a clash between the Turkish Armed Forces units and HPG militants in Zap area in the Iraqi Kurdistan Regional Government on April 22, 2022.

(08/044) People Subjected to Police Violence in Mardin…

It is learned that a group of children, including children in the 15 July Martyrs Park in Artuklu district of Mardin, were subjected to physical violence by the police on the grounds that they were wearing scarves about the imprisoned Furkan Foundation chair Alpaslan Kuytul on August 5, 2022, and 3 people were detained.

(08/045) Torture and Ill-Treatment Under Custody in Istanbul…

The People’s Law Office declared that 2 people (Hüseyin Kütük and Ferdi İşçi) who were detained in Sultangazi district of Istanbul on August 5, 2022 were subjected to torture and ill-treatment at the police station.

(08/046) Attack on Reporter in Kırıkkale…

Reporter Arif Kocabıyık of the YouTube channel Ilave TV, announced that they were attacked by 3 people who got out of a vehicle in Kırıkkale, where they went to shoot on August 7, 2022. It is learned that Arif Kocabıyık filed a criminal complaint about the attack.

(08/047) Attack on Journalist in Istanbul…

Journalist Latif Şimşek, who participated in a program on TV100 channel on August 7, 2022, was subjected to physical violence by the Democratic Party Ordu MP Cemal Enginyurt’s personal bodyguard. It is learned that an investigation was launched by the Istanbul Chief Public Prosecutor’s Office regarding the incident, and the bodyguard was detained and arrested by the court.

(08/048) Attack on Head of Cemevi in Istanbul…

It is learned that Selami Sarıtaş, the Vice President of the Federation of Alevi Foundations and the Head of Kartal Cemevi, was attacked by unknown persons in front of his house on August 6, 2022.

(08/049) Meeting Request with Abdullah Öcalan Not Responded…

It is learned that the appeal made on August 5, 2022 to chief public prosecutor’s office in Bursa by families and tutelary of PKK leader Abdullah Öcalan, and Ömer Hayri Konar, Hamili Yıldırım and Veysi Aktaş in Imralı Prison, in order to visit them was not responded.

(08/050) Torture and Ill-Treatment in Prison…

It is learned from the news coverage of August 5, 2022 that, in Diyarbakır High Security Prison No. 2, prisoners can use only 50 minutes for contact visit which should be one and half an hour; their social, cultural and sports rights were restricted; the food given to prisoners is inadequate and of poor quality; and the electricity bills paid by prisoners are high.

It is learned from the news coverage of August 5, 2022 that, ill prisoner Fevzi Fidan in Elazığ High Security Prison No. 2 was subjected to torture and ill-treatment of the correction officers.

It is learned from the news coverage of August 5, 2022 that, ill prisoner Mehmet Salih Filiz in Muğla Bodrum S Type Prison was subjected to torture and ill-treatment of the correction officers on July 2, 2022, when he wanted to see the prison administration to demand medical treatment.

It is learned from the news coverage of August 5, 2022 that, the report “Journalism Between Four Walls” sent by the Dicle Fırat Journalists Association to journalist Fatih Özgür Aydın held in Adana F Type Closed Prison, was not given on the grounds that the association was not included in the “list of associations working in the public interest”.

It is learned from the news coverage of August 6, 2022 that, a large number of pistol bullets were fired outside the working hours over the open-door area of the wards in Maraş Elbistan E Type Closed Prison.

It is learned from the news coverage of August 6, 2022 that, the prisoners in Diyarbakır Women’s Closed Prison were threatened by the correction officers on the grounds that they were looking through the door bars.

(08/051) Prevention of Right to Health in Prison…

It is learned from the news coverage of August 6, 2022 that, Mardin Kızıltepe Police Department Anti-Terror Branch stated that “postponement of sentence may cause danger for public security”, regarding the application for a postponement of the execution made to the Bakırköy Chief Public Prosecutor’s Office for Serdal Yıldırım, a 98 percent disabled ill prisoner held in Istanbul Metris R Type Prison.

(08/052) Hunger Strike in Prison…

It is learned from the news coverage of August 5, 2022 that, prisoners in Van High Security Prison went on a hunger strike in groups on August 1, 2022, to demand an end to right violations.

(08/053) Detained HDP Member and Other People in Diyarbakır…

It is learned that 9 people, including 2 children, who were detained for the slogans they chanted after the demonstration held by the Peoples’ Democratic Party (HDP) in Diyarbakır on August 6, 2022, are released after statement procedures on August 7, 2022.

HDP Çermik district co-chair Berat Can, who was detained at the road control in Ergani district of Diyarbakır on the same day, is released after statement procedures on August 7, 2022.

(08/054) Detained People in Mersin…

It is learned that 5 people (C. A. T., A. Ç., D. G., F. S. and A. T.) are detained in house raids in August 5, 2022, on the grounds of “preparing a protest”.

(08/055) Kobanê Case…

The trial of the case against 108 members and executives of HDP including former co-chairs, including 21 arrestees, is held at Ankara Heavy Penal Court No 22 between July 25 and August 5, 2022.

It is learned that the court board prevented the right to defence and the police in the courtroom intervened against the lawyers protesting the court; and that the defendant politicians who wanted to leave the courtroom were blocked by the gendarmerie, and one of the defendants, Nazmi Gür, fell ill. The court decided to lift the arrest warrant issued in Diyarbakır for Zeynep Karaman, and to lift judicial control conditions for Can Memiş, at the trial held on July 25, 2022.

It is learned that the microphone of the defendant politician Gültan Kışanak was turned off by the court board when he requested that Mesut Fırat, one of the witnesses in the file, not be heard, at the trial held on July 29, 2022. Despite her health condition, the court decided that Aysel Tuğluk’s defence be taken through sound and vision system on August 1, 2022.

It is learned that despite Aysel Tuğluk, who is suffering from dementia, said “I am not in a position to defend myself”, her statement and defence were taken by force, at the trial held on August 1, 2022. The court rejected the request for separation of the case against Aysel Tuğluk.

It is learned that the prosecutor declared legal opinion on the case on August 2, 2022 and demanded continuation of detention of the defendants on the grounds of “strong possibility of crime”.

On August 5, 2022, the court decided to release Aysel Tuğluk from prison and to continue detention of other arrested defendants. The court issued an arrest warrant for Berfin Özgü Köse on the grounds of violating judicial control conditions and adjourned the trial to be held between August 29 and September 9, 2022.

(08/056) Constitutional Court Decision on Ill-Treatment…

It is learned from the news coverage of August 6, 2022, that the Constitutional Court (AYM) decided on the individual application made by Mehmet Ali Çintan on the grounds that he was tortured and ill-treated in custody. The court ruled that the prohibition of ill-treatment guaranteed in Article 17 of the Constitution was violated in procedural terms. Mehmet Ali Çintan, was detained in a house raid in Mersin on August 29, 2016 and was subjected to torture and ill-treatment in Yenişehir District Police Department where he was taken. The criminal complaint filed to Mersin Chief Public Prosecutor’s Office resulted in non-prosecution, and his appeal was also dismissed. The Constitutional Court ruled that the verdict will be sent to Mersin Chief Public Prosecutor’s Office in order to eliminate the consequences of the violation and that Mehmet Ali Çintan should be paid 45,000 Turkish Liras for non-pecuniary damage.

(08/057) Constitutional Court Decision on Freedom of Though and Expression…

It is learned from the news coverage of August 5, 2022, that the Constitutional Court concluded the individual application of İlknur Uyan, who was given a one-month suspension and a disciplinary penalty in the investigation opened by Mersin University for the expressions “Trustee Rector” in a press statement she attended in 2017, The Constitutional Court stated “Even if the statements in the press release that are the subject of the application that the rector pledges allegiance to the government and that he is a trustee rector appointed by the government, not elected by the majority of academics, are found offensive and provocative for the rector, it is accepted that freedom of expression should be interpreted broadly in a way that allows for exaggeration and even provocation”. The court ruled that Uyan’s right to education was violated, the verdict should be sent to Mersin Administrative Court No. 2 for a retrial, and to pay İlknur Uyan 13,500 Turkish Liras for non-pecuniary damage.

It is learned that the website of Etkin News Agency https://www.etha44.com is banned to access by Diyarbakır Penal Court of Peace No. 4 on July 26, 2022, and  https://www.etha45.com is banned to access by Diyarbakır Penal Court of Peace No. 4 on August 3, 2022 on the grounds of “protecting national security and public order”.

It is learned that the website of Yeni Demokrasi newspaper https://www.yenidemokrasi29.net is banned to Diyarbakır Penal Court of Peace No. 4 on August 3, 2022 on the grounds of “protecting national security and public order”.

It is learned that the website of Kızıl Bayrak magazine https://kizilbayrak70.net/ is banned to Mersin Penal Court of Peace No. 4 on August 3, 2022 on the grounds of “protecting national security and public order”.

 (08/059) Covid-19 Pandemic…

The Ministry of Health declared on August 1, 2022 that 337 people died due to Covid-19 pandemic and the number of Covid-19 cases is 406,322 between July 25 and August 1, 2022.

The death toll from Covid-19 in Turkey increased to 99,678 and total number of confirmed ill patients is 16,295,817 as of August 1, 2022.
