(01/025) Male Violence Monitoring Report…

According to the “Male Violence Monitoring Report” published by Bianet on January 4, 2024, at least 30 women and 1 child were killed by men across Turkey in December 2023. It is also stated that men inflicted violence on at least 38 women, harassed 5 women and abused 5 children. Accordingly, 333 women and 28 children were killed by men in 2023; 745 women were subjected to violence; 355 women were harassed; 371 women were forced into sex work; 128 children were abused.

It is learned from the news coverage of January 3, 2024, that 1 militant died in clashes between Turkish Armed Forces units and HPG militants in Besta area of Iraqi Kurdistan Regional Government on July 12, 2023.

It is learned from the news coverage of January 3, 2024, that Kerim Yalçın, a soldier on duty in Samsun Kavak S Type Prison, was found dead in his house. It is claimed in the news reports that the soldier shot himself while cleaning his gun.

It is learned from the news coverage of January 3, 2024, that prisoners in Ağrı Patnos L Type Prison were not given hot water, the drinking water given to prisoners was dirty and books belonging to prisoners were seized during ward searches.

It is learned from the news coverage of January 3, 2024, that Mehmet Ali Uğur, an ill prisoner in Ağrı Patnos L Type Prison, was not given food suitable for his diet.

(01/030) The Case of Can Atalay…

Following the violation decision of the Constitutional Court on the application of TİP Hatay MP Can Atalay, who was sentenced to 18 years in prison for ‘aiding the overthrow of the government’ at the Gezi Trial’s final hearing on April 25, 2022 and whose sentence was upheld by the Court of Cassation’s Penal Department No. 2, the Istanbul Heavy Penal Court No. 13 sent the file to the Court of Cassation’s Penal Department No. 3 on the grounds that the Court of Cassation has the authority to decide. The Penal Chamber 3 decided on the case on November 8, 2023, and refused to comply with the Constitutional Court’s violation decision on the grounds that it violated the constitution and exceeded its authority, and ruled to file a criminal complaint against the members of the Constitutional Court who issued the violation decision. The second individual application made to the Constitutional Court by the lawyers of Can Atalay was discussed by the General Assembly of the Constitutional Court on December 21, 2023, and it was decided by a majority of votes that the right to be elected and to engage in political activity and the right to personal liberty and security were violated. Istanbul Heavy Penal Court No. 13 decided to send the file back to the Court of Cassation for a decision on Can Atalay. On January 3, 2024, the Court of Cassation’s Penal Chamber No. 3 rejected the implementation of the Constitutional Court’s decision, stating that it had “no legal value” and decided to write to the Grand National Assembly of Turkey to revoke Can Atalay’s parliamentary deputy status.

(01/031) Journalist on Trial in Istanbul…

The final hearing of the case against journalist Fatih Altaylı for an article he wrote was held at Istanbul Penal Court of First Instance No 22 on January 3, 2024. The court sentenced Fatih Altaylı to 7 months for ‘insulting successively’. The court also ruled that there is no deferment of the announcement of the verdict.

(01/032) People on Trial in Ankara Due to Social Media Posts…

The trial of the case against 30 people, 10 of whom are arrested, including Süha Çardaklı and Serkan Kafkas, administrators of “Ajans Muhbir” account, started on January 3, 2024, at Ankara Penal Court of First Instance No 7 on the grounds of social media posts on refugees. The indictment demands a sentence for the defendants on the charges of ‘provoking the public to hatred, hostility or degrading’ and ‘publicly disseminating misleading information’. Following the defences, the court ruled for the release of 10 arrested people and adjourned the trial to May 20, 2024.

It is learned from the news coverage of January 3, 2024, that an investigation was initiated against Gazete Duvar reporter Osman Çaklı, on the grounds of ‘making propaganda for an illegal organisation’ through his news reports and social media posts about the cutting down of trees in Akbelen Forest in the Milas district of Muğla; and that the journalist went to Istanbul Beyoğlu District Security Directorate and gave his official statement.

(01/034) Investigation Against Journalists on Strike…

It is learned from the news coverage of January 3, 2024, that journalists on strike at Sputnik Turkey Bureau were called by the police to give statements on the grounds of ‘violating Law No 2911 on Meetings and Demonstrations’ upon the complaint of employer representatives.

(01/035) Person Arrested Due to Social Media Posts…

On January 4, 2024, 1 person was detained in Osmaniye on the grounds of insulting Atatürk in social media posts. The name of the detained person could not be learned.

(01/036) Ban of Access to Web Content…

It is learned from the news coverage of January 3, 2024, that Ekşi Sözlük’s applications on App Store and Google Play were banned from access on the grounds of protection of public order.

It is learned that the news reports on https://www.rudaw.net/turkish, https://artigercek.com, https://haber.sol.org.tr websites about hateful posts of a lecturer from Ağrı İbrahim Çeçen University about the Roboski Massacre are banned to access on the grounds of violation of personal rights by Ağrı Penal Court of Peace on December 30, 2023.

It is learned that a news report about a Deputy Minister of Justice, which was published on https://halktv.com.tr website, was banned to access on the grounds of violation of personal rights by Istanbul Penal Court of Peace No. 7 on January 3, 2024.
