(01/020) Male Violence Monitoring Report…

According to the “Male Violence Monitoring Report” of Bianet published on January 4, 2023, at least 19 women and 3 children got killed by men in December 2022. It is also reported that at least 65 women were subjected to violence, 16 women were harassed, 6 women was raped and 29 children were abused by men in December 2022. In 2022, 327 women were murdered, 156 women were sexually harassed, 238 children were abused, 793 women were subjected to violence, 32 women were raped and 442 women were forced to sex work by men.

(01/021) Explosion in Aydın…

It is learned that 1 child (Cennet Yeldi, 15) who was injured in the explosion that was reported to have occurred during a tube change in a restaurant in Nazilli district of Aydın on December 30, 2022, lost her life in hospital on January 3, 2023. The number of the people died in the explosion raised to 8, and it is reported that 1 person (M. G.) was arrested in addition to 4 people.

(01/022) Soldiers Died in Konya…

It is learned that 2 soldiers died and 2 soldiers were wounded in the crash of a military vehicle on the Konya-Adana road on January 4, 2023.

(01/023) Person Subjected to Torture and Ill-Treatment of Police and Watchmen in Diyarbakır…

It is learned from the news coverage of January 3, 2023 that, a person whose name could not be learned was subjected to torture and ill-treatment of the police and watchmen who stopped this person for general information check in Yenişehir district of Diyarbakır on December 30, 2022.

(01/024) Torture and Ill-Treatment in Prison…

It is learned from the news coverage of January 3, 2023 that, the political prisoners in Trabzon Beşikdüzü T Type Closed Prison were prevented from video call rights.

It is learned from the news coverage of January 3, 2022 that, Dilan Yürüklü, a prisoner in Antalya L Type Prison was subjected to strip search at the entrance of the prison, was kept in a solitary cell and was forced to stand up in military order during roll-calls.

(01/025) Detained Person in Rize…

It is learned that Fındıklı district municipality Press and Public Relations Officer Gökmen Turna was detained in Rize by the gendarmerie on January 4, 2023 on the grounds of ‘inciting the public to hatred and hostility’, and was released on the same day after the statement procedures.

(01/026) Former Co-Mayors, City Council Members, Political Party Executives and Members in Ankara…

The first trial of the case at Ankara Heavy Penal Court No. 18 against 89 people including 18 arrestees, on the charges of ‘making propaganda for an illegal organisation’ and ‘establishing and leading an illegal organisation’ is held in the courtroom in Ankara Sincan Prison on January 2-3, 2023. It is learned that the demand of Şefik Çevik, who joined the trial from prison via sound and vision system, to make his defence in Kurdish was rejected on the grounds of lack of translators. It is learned that the lawyers demanded rejection of the case on the grounds of lack of venue of the court and that some of the defendants were already brought to the court in different cases on the same charges.

The court decided to release Mehmet Salih Zümrüt due to health issues and continue detention of 17 people. The court lifted the house confinement for Metin Kılavuz and ruled house confinement for Selami Turhan. The court rejected the demand of lawyers to drop the case, to release the arrested defendants, and to lift the decision for confiscating the assets of the defendants and adjourned the trial to January 12, 2023.

On April 12, 2022, 48 people including the Peoples’ Democratic Party (HDP) members and executives and former co-mayors and city council members were detained in house raids in Adana, Batman, Diyarbakır, İstanbul, İzmir and Mersin through an Ankara based investigation about the Kobâne protests which were held on October 6-8, 2014. 18 of the detainees (Abdullah Bozkoyun, Atalay Bayrak, Ayşe Kaçar, Berat Anli, Erdal Avci, Eyuphan Öcal, Fecri Tayfur, Gülşen Duran, Hasan Uğur Çat, Hüseyin Daş, Hüseyin Vural, Mehmet Koyuncu, Mehmet Sarih Zümrüt, Murat Kaçar, Mustafa Demir, Necat Parıldar, Nizamettin Onar, Zana Döner) were arrested on April 22, 2022. The court has decided to separate the case against 2 of the 91 people (HDP’s former Party Assembly member Pervin Oduncu and former accountant Zeki Çelik) who were investigated.

(01/027) Dedeoğulları Case…

It is learned that on January 3, 2023 the Penal Department No 1 of Konya Regional Court of Justice overturned the verdict of the Konya Heavy Penal Court No. 8 in the case regarding the racist attack against the Dedeoğulları family members in Konya on May 12, 2021, in which 7 people were injured, on the grounds that an incomplete sentence was given based on an insufficient report and a document that does not have the quality of evidence. On October 28, 2022, Konya Heavy Penal Court No. 8 has sentenced 9 people to jail sentences ranging from 1 year to 6 years for ‘deliberate injury’ and acquitted them for ‘violation of the immunity of residence’, and decided to release 2 arrested defendants.

(01/028) The Council of State Case on Istanbul Convention…

It is learned that on January 3, 2023 the Council of State Administrative Litigation Chambers approved the rejection of the case filed in the 10th Chamber of the Council of State for the annulment of the “Council of Europe Convention on Preventing and Combating Violence Against Women and Domestic Violence”, known as the Istanbul Convention, with the Presidential Decision dated 20 March 2021.

(01/029) The Constitutional Court Decision on Ill-Treatment…

It is learned from the news coverage of January 3, 2023, that the Constitutional Court concluded on the application of the Labour Party (EMEP) Disciplinary Board member Fevzi Ayber, who was detained and subjected to physical violence of the police intervening in the press declaration held in Ankara on November 4, 2016 to protest the detention of parliamentary members including former HDP co-chairs Selahattin Demirtaş and Figen Yüksekdağ. It is learned that the Constitutional Court ruled that the material and procedural aspects of the ban on ill-treatment were violated, as well as the right to hold meetings and demonstrations, and decided that Fevzi Ayber should be paid 50,000 Turkish Liras for non-pecuniary damage.

(01/030) The Constitutional Court Decision on Freedom of Assembly and Demonstration…

It is learned from the news coverage of January 4, 2023, that the Constitutional Court concluded on the application of 3 people (Eğitim-Sen Batman branch secretary Nureddin Şimşek, SES Batman branch co-chair Deniz Topkan and executive member Cihan Tüzün) who were fined in accordance with the Misdemeanour Law for participating in the faxing action organized by KESK, despite the ban of events decision of the Governorate’s Office on November 7, 2018. The Constitutional Court ruled that “Fundamental rights and freedoms can only be limited by law, without affecting their essence, depending on the reasons specified in the relevant articles of the Constitution. These restrictions cannot be contrary to the word and spirit of the Constitution, the requirements of the democratic social order and the secular Republic, and the principle of proportionality”. The court decided that the freedom of assembly and demonstration was violated.

(01/031) Ban of Access to Web Contents…

It is learned that the news reports about a stockbroker, against whom several criminal complaints have been made by the Capital Markets Board (CMB) for allegedly engaging in manipulative transactions, published on https://www.cumhuriyet.com.tr/ and https://www.sozcu.com.tr/ websites are banned to access on the grounds of violation of personal rights by Sakarya Penal Court of Peace No. 1 on January 3, 2023.
