(07/291) Person Died Due to Being Hit by a Police Armoured Vehicle in Kilis…

It is learned from news coverage of July 26, 2018 that, Ali Şab (69) a person with walking disability died due to being hit by a police armoured vehicle near Öncüpınar border check point in Kilis on July 14, 2018. It is stated in the news report that, Ali Şab was hit by an armoured vehicle while he was waiting in his wheelchairs in checkpoint area on his way back from Syria to Turkey, and that the vehicle has left the area after hitting him. It is learned that the police directorate initiated judicial and administrative investigation about the incident.

(07/292) Report on Violations of Rights of Women and Children…

Human Rights Association (IHD) Adana Branch Women Rights Commission made a press declaration on July 26, 2018 and announced the report on violations of rights of women and children. It is stated in the report that at least 120 women and 7 children were killed in the first 6 months of 2018; and 32 women were subjected to sexual assault, 102 women were subjected to sexual harassment and 189 children were subjected to sexual abuse.

(07/293) Torture and Ill-Treatment in Prison…

It is learned from news coverage of July 26, 2018 that, HDP Hakkari MP and Democratic Society Congress co-chair Leyla Güven, who is kept in Diyarbakır E Type Prison, was banned from visits for 1 month due to singing a Kurdish song. It is also stated in the news report that Leyla Güven needs to be transferred to hospital for eye surgery however she has not been transferred yet because she rejects to be in handcuffs during transfer.

It is learned from news coverage of July 26, 2018 that Dilan Poyraz, a member of Grup Yorum musical band, who is kept in Gebze Prison, was banned from communication for 2 years; and she is prevented from communication via letters and phone calls.

It is learned from news coverage of July 26, 2018 that, prisoners from Slivri Prison No 6 were subjected to physical violence of the gendarmerie. It is stated in the news report that, prison administration applied to judge of execution on the grounds that a note has been found by the wardens in the shared area of prisoners on July 17, 2018; and that judge of execution ordered the prison administration to enter into the wards. It is learned that gendarmerie handcuffed the prisoners in wards and took them out, and prisoners who reacted to it were subjected to physical violence, and their official complaints on prison administration and judge of execution was not put into process based on judicial recess.

(07/294) Ill Prisoner Being Prevented from Family Visit…

It is learned from news coverage of July 26, 2018 that, Koçer Özdal (70), an ill prisoner from Samsun Bafra T Type Closed Prison has been taken to Ankara Numune Hospital after his health condition gets worse and that his family were prevented from seeing him on the grounds of lacking permission of the prosecutor’s office.

(07/295) Rejection to Meeting Request with Abdullah Öcalan…

It is learned that the appeal made on July 27, 2018 to chief public prosecutor’s office in Bursa by PKK leader Abdullah Öcalan’s lawyers in order to visit their client was rejected the same day on the grounds of limitations for prisoners in accordance with the law on the execution of sentences and security measures (law no 5275). With the last rejection, it was the 775th time that appeals for visiting Öcalan have been rejected so far. Abdullah Öcalan has met his lawyers on July 27, 2011 for the last time.

(07/296) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling for a while to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on July 26, 2018 at 13.30 and 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on July 26, 2018, 4 people (Mehmet Dersulu, Gülnaz Bozkurt, İlker Işık and Mahir Kılıç) and at 18.00 4 people (Mahir Kılıç, Acun Karadağ, İlker Işık and Gülnaz Bozkurt) were detained.

Thus in total 8 people were detained due to press declaration intended to be held in Yüksel Street on July 26, 2018. It is learned that detainees were released the same day.

(07/297) Police Intervention Against a Protest in Ankara…

The police intervened the press declaration in front of Grand National Assembly, to protest detention and arrestment of 2 people in Armutlu Cemevi [Alevis’ worship house] and detention of Zeynep Yıldırım, Pir Sultan Abdal Culture Association Sarıyer branch chair and Armutlu Cemevi executive. It is learned that the police said “Know your place!” to members of parliament who support the protestors.

2 people, namely Cem Dursun and Meryem Özsöğüt has been detained by the police that raided Armutlu Cemevi, and then they were arrested by the court. Zeynep Yıldırım’s house were also raided by the police on July 24, 2018, and she was detained. It is learned that Zeynep Yıldırım is arrested by the court on July 26, 2018.

(07/298) People Detained in Van…

It is learned that 5 people from the same family (Makbule Özer, Hadi Özer, Medeni Özer, Übeydullah Özer and Emrullah Özer) who were detained on July 23, 2018 in Edremit district of Van, are released after procedures at the prosecutor’s office on July 26, 2018. It is learned that 1 person (Medya Aslan) who were a house guest and detained along with 5 people, is arrested for ‘being an illegal organisation member’.

(07/299) Journalist and Other People on Trial in Denizli…

The first trial of the case against Gökhan Öner, reporter of Mezopotamya News Agency which was closed down by a state of emergency decree, and Mehmet Diler, Erol Beler, Muhlis Kayar and Eyyüp Hansu on Denizli Heavy Penal Court No 2 is held on July 26, 2018. Gökhan Öner has been detained in Denizli on April 28, 2018 and has been arrested by the court. After defence hearings the court released Gökhan Öner on juridical control conditions; lifted juridical control on other defendants and decided to continue ban on leaving the country; and adjourned the trial to March 3, 2019.

(07/300) Constitutional Court’s Decision on Gender Reassignment Surgery…

It is learned from news coverage of July 26, 2018 that, Constitutional Court concluded on an appeal concerning rejection of gender reassignment process of an individual, and decided that making lack of reproductive ability an obligation for gender reassignment is a violation. Constitutional Court stated that the article which imposes lack of reproductive ability as a necessary condition for gender reassignment has been rescinded; and that the applicant’s right of personal inviolability, corporeal and spiritual existence of the individual guaranteed by Article 17 of the Constitution.

(07/301) Number of Individual Appeals to Constitutional Court…

Constitutional Court published the statistics on individual appeals made between September 23, 2012 to July 30, 2018. According to the statistics, 60 per cent of all appeals (176.951 appeals) are on violations of right to a fair trial. In addition, 37.294 people appealed for violation of property right; 13.439 people for violation of personal freedom and security; 7.704 people for violation of right to live; 5.250 people for violation of freedom of experience; 3.578 people for violation of prohibition of torture and ill-treatment; 3.022 people for violation of right to education; 2.163 people for violation of right to demonstrate; 1.316 people for violation of freedom of religion and conscience. It is also stated that, the number of individual appeals is 9.897 in 2013; 20.578 in 2014; 20.376 in 2015; 80.756 in 2016 when state of emergency was declared; 40.530 in 2017; and 17.892 in the first half of 2018.

(07/302) Number of Investigated Social Media Accounts…

The Ministry of Interior made a declaration on July 23, 2018 and announced that between July 16 to July 23, 2018, 403 social media accounts have been investigated and legal procedures have been initiated for 267 of them. The declaration published on website of the ministry mentioned these accounts as “making propaganda for illegal organisations, praising illegal organisations, declaring to be related to illegal organisations, publicly inciting hatred and hostility, insulting statesmen, intending against indivisibility of the state and public security, containing hate speech…”.

 

(07/302) Banned Book…

It is learned from news coverage of July 26, 2018 that ‘Kürdistan Tarihi’ [History of Kurdistan], the book published by Avesta Publishing, is banned by Ayvalık Penal Court of Peace. It is stated in the news report that, the first edition of the book has been banned by Istanbul State Security Court in 2000; and the court sentenced Abdullah Keskin, the owner of the publishing house, to jail penalty and fine which were postponed.

(07/303) Detentions and Arrests in Alleged Link to Coup Attempt…

A former police officer who was detained through the investigation on murder of Andrey Karlov, Russian Ambassador to Turkey, is arrested by the court on July 26, 2018.

(07/304) Trials in Alleged Link to Coup Attempt…

The final trial of the case against 45 people including former police officers, on Bursa Heavy Penal Court No 2 is held on July 26, 2018. The court sentenced 43 people to jail penalties differing from 3 years 1 month and 15 days to 8 years and 9 months for ‘being an illegal organisation member’. The court decided to defer the announcement of the verdict for 2 people on the grounds that they ‘provided information about the illegal organisation’, and acquitted 1 person.

The final trial of the case against 16 former police officers on Ankara Heavy Penal Court No 23 is held on July 26, 2018. The court sentenced 11 people to jail penalties differing from 7 years 6 months to 10 years for ‘being an illegal organisation member’ and decided to released 4 of them on juridical control conditions. The court separated the cases of 3 people and acquitted 2 people.

The final trials of the separate cases against 3 people for leaking the questions of Public Personnel Selection Exam in 2010, on Ankara Heavy Penal Court No 2 is held on July 26, 2018. The court sentenced 2 defendants to 6 years and 3 months and 1 defendant to 7 years and 6 months for ‘being an illegal organisation member’. The court also sentenced 1 defendant to 3 years 1 month and 15 days and fine penalty for ‘chain fraud towards public institutions’.

The case against 2 former sergeants who were dismissed by state of emergency decrees, on Kayseri Heavy Penal Court No 4 is held on July 26, 2018. The court sentenced 2 people to 7 years and 6 months each for ‘being an illegal organisation member’.

The final trial of the case against Ramazan Koçak, a former warden who was dismissed by a state of emergency decree, on Kastamonu Heavy Penal Court, is held on July 26, 2018. The court sentenced Ramazan Koçak to 8 years and 9 months for ‘being an illegal organisation member’.

(07/305) Curfew in Kulp…

Diyarbakır Governorate made a declaration on July 26, 2018 and lifted the curfew announced on July 25, 2018 by 11.00, on 1 village and 7 hamlets of Kulp district as of 16.00, July 26, 2018.
