(12/297) Torture and Ill-Treatment Under Custody in Diyarbakır…

It is learned from the news coverage of December 26, 2019 that B. Y., who was detained by Diyarbakır Security Directorate Department of Anti-Smuggling and Organised Crime on December 25, 2019, was subjected to torture and ill-treatment under custody. It is reported that Berivan Turan, lawyer of B. Y., was prevented from seeing her client and lawyer Özgür Deniz İzgi who rejected to that was threatened by a police officer saying “I will smash your head into the window”.

(12/298) Children Were Subjected to Torture and Ill-Treatment at Workplace in Konya…

Worker Health and Worker Safety Council (ISIG) revealed on December 26, 2019 that, E. A. Y. (15) who was working for a spare parts trader in Karatay district of Konya was hung from the ceiling with a chain pulley, and was wet by chemical compound water by store owner (M. C.). It is reported that H. H. Y. (17), brother of E. A. Y. who was also working there was also subjected to physical violence of M. C. on December 5, 2019. It is learned that an investigation is initiated against M. C. on the charge of ‘intentional injury’.

(12/299) Journalist Was Harassed by Police…

Berivan Altan, who was detained on November 26, 2019 and was released on December 2, 2019, made a press declaration about harassment of police, at Human Rights Association (IHD) on December 26, 2019. Berivan Altan stated the following: “Harassment is a practice which is implemented on almost everybody who has been detained in the last 5 years. I was also subjected to it while I was under custody for 8 days since November 26, 2019. And I was also harassed after being released”.

(12/300) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling 1143 days to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on December 26, 2019 at 13.30, and at 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on December 26, 2019, 2 people (Acun Karadağ and Merve Demirel) and at 18.00 3 people (Nazan Bozkurt, Merve Demirel, Melek Çetinkaya) were detained.

Thus in total 5 people were detained due to press declaration intended to be held in Yüksel Street on December 26, 2019. It is learned detained people were released on the same days they were detained.

(12/301) Police Intervention to a Protest in Düzce…

On January 26, 2019 the police intervened the press declaration of Alev Şahin in order to regain her job from which she was dismissed by a state of emergency decree, in front of Justice and Development Party (AKP) provincial office and detained her. It is learned that Alev Şahin was released on the same day.

(12/302) Diyarbakır JITEM / Musa Anter Case…

The consolidated case on Musa Anter’s killing in Diyarbakır in 1992 and activities of JITEM (Gendarmerie Intelligence and Anti-Terror Unit) in Diyarbakır is held on December 26, 2019 on Ankara Heavy Penal Court No 6. The case known as “JITEM Main Case” on Diyarbakır Penal Court No 1 and the case of Musa Anter’s killing has been consolidated by the Supreme Court’s decision on January 29, 2016.

Journalist Ferit Aslan, who is heard as witness, said that on September 20, 1992, when Musa Anter was killed, he was working for Söz newspaper and they went to crime scene upon a notice and were stopped by a group of armoured people in a Toros brand white car and stated the following: “They got off the car and asked us who sent us and who informed us about the killing. They beat us. Two of my teeth were broken. (…) And then one of them got in our car and wanted us to follow their car. When we got out of the city they put our driver in the trunk. (…) Their driver had plaster on his right hand, and was shifting gears with his left hand. (…) At around 4 a.m. they left us at Malatya and Adıyaman border. They told us to leave directly or they would kill us. (…) Mahmut Yıldırım’s name is mentioned in relation to several unsolved murder but only one photograph of him was on press. Mahmut Yıldırım’s son wrote a book 17 years after this murder and there were published around 10 photographs of Mahmut Yıldırım. When I saw those photographs I thought that, the person who had plaster on his hand and broke my two teeth, and was called as ‘Director’ by other ones was Mahmut Yıldırım.

The court adjourned the trial to March 25, 2020.

(12/303) Journalist on Trial in Tekirdağ…

The first trial of the case against journalist Rıfat Doğan, for he shot photographs during the trial of the case on train crash which happened on July 8, 2018 in Çorlu district of Tekirdağ, is held at Çorlu Penal Court of First Instance No 4 on December 25, 2019. The prosecution case of Çorlu Public Prosecutor’s Office state the following: “In case you pay the fine of 900 Turkish Liras in related to the charges against you, in 10 days as of date of notification and submit the payment receipt to the prosecutor’s office, a case will not be opened against you. However, in case you do not do the payment a case will be opened.” The court adjourned the trial to January 28, 2020.

(12/304) Journalist and Executives of HDP and DBP on Trial in Istanbul…

The case against 19 people including journalist Haydar Ergül and executives of HDP and DBP is held on Istanbul Heavy Penal Court No 22 on December 26, 2019. The court decided to lift judicial control conditions on Haydar Ergül, Eşref Yaşar, Aygül Turhan, Mustafa Elma, Münevver İlingi and Aysel Diler and decided to continue ban on leaving the country for 19 people and adjourned the trial to May 14, 2020.

(12/305) Publishers on Trial in Istanbul…

The final trial of the case against owner of Umut Publishing House and executive of Yön Printing House, for publishing all writings of İbrahim Kaypakkaya, is held at Istanbul Heavy Penal Court No 36 on December 26, 2019. The court sentenced owner of Umut Publishing House to 2 years and 2 months, and executive of Yön Printing House to 10 months for ‘making propaganda for an illegal organisation’.

(12/306) Association Executives on Trial in Adana…

The final trial of the case against Gıyasettin Gümüş, Adana branch chair of KURDI-DER which was closed down by a state of emergency decree, and executives Abdülkerim Aslan, Fatma Doğan, İsa Bulut and Mehmet Reşit Gültekin, on the charge of ‘making propaganda for an illegal organisation’, is held at Adana Heavy Penal Court No 11 on December 26, 2019. The court acquitted 5 people.

(12/307) Prevention of HDP Congress in Eskişehir…

It is learned from the news coverage of December 26, 2019 that the owner of the place which was hired by People’s Democratic Party to held its congress at Inönü district of Eskişehir, was threatened by the police in order to prevent the congress. It is reported that the congress was held on a street of the district.

(12/308) Trials in Alleged Link to Coup Attempt…

The final trial of the case against Kahraman Demirez is held at Istanbul Heavy Penal Court No 30 on December 26, 2019. The court sentenced the defendant to 8 years and 9 months for ‘being an illegal organisation member’.

The final trial of the case against former deputy chair of Supreme Court of Judges and Prosecutors, is held at Penal Department No 9 of Supreme Court on December 26, 2019. The court sentenced the defendant to 8 years for ‘being an illegal organisation member’ and reduced the sentence to 2 years and 6 months according to effective remorse law.

(12/309) Constitutional Court Decision on Ban of Access…

It is learned from the news coverage of December 26, 2019 that Constitutional Court concluded on the appeal of Wikimedia Foundation about ban of access to Wikipedia on April 29, 2017.  The court ruled that ban of access is violation of freedom of expression and decided to send the verdict to Ankara Penal Court of Peace No 1.

(12/310) Restriction of Books…

It is learned from the news coverage of December 26, 2019 that, Committee for Prevention of Children from Obscene Publications under Ministry of Family, Labor and Social Services decided to restrict 3 books according to Law 117 – Article 4. According to these restrictions, these 3 books have to be labelled as “harmful to children”, and cannot be openly displayed, cannot be advertised and cannot be in schools and other places of children. Restricted books are: Cinsellik-Cinselliği Keşfediyoruz by Defne Ongun Müminoğlu, İçim Dışım Gökkuşağı by Mehmet Güler and Kin Kanatlılar by Adem Özbay.

(12/311) State of Emergency Procedures Investigation Commission Appeals…

State of Emergency Procedures Investigation Commission made a declaration on December 26, 2019 and announced that 126.300 people applied to the committee and the committee finalised applications of 98.300 people. The committee accepted appeals of 9.600 people and rejected appeals of 88.700 people.
