(03/228) Torture and Other Ill-Treatment in Prison…

It is learned from the news coverage of March 26, 2024, that Halil Muratoğlu, a prisoner in Samsun Kavak S Type Prison was sentenced to a ban on some activities, a ban on visits, and solitary confinement for 11 to 20 days.

(03/229) Meeting Request with Abdullah Öcalan not Responded to…

It is learned that the appeal made on March 26, 2024 to the Chief Public Prosecutor’s Office in Bursa by lawyers in order to visit their clients PKK leader Abdullah Öcalan, Ömer Hayri Konar, Hamili Yıldırım and Veysi Aktaş in İmralı Prison was not answered by Bursa Public Prosecutor’s Office.

It is learned from the news coverage of March 25, 2024, that the police intervened in the election activities of the Peoples’ Equality and Democracy Party (DEM Party) in the Bağlar district of Diyarbakır, on the grounds of ‘playing erbane’. It is reported that no one was injured or detained in the intervention and the DEM Party continued its election activities after negotiations with the police.

It is learned from the news coverage of March 25, 2024, that election posters of Filiz Gencan Akın, mayor candidate of the Republican People’s Party (CHP) in Edirne, were damaged by anonymous person or persons.The Governorate of Hakkari announced on November 25, 2024, that an investigation had been launched into the incident.

It is learned from the news coverage of March 25, 2024, that an investigation was initiated against Şükrü Erden, CHP mayoral candidate for Mustafakemalpaşa district of Bursa, on the grounds of ‘praising offence and offender’ for his statements on PKK leader Abdullah Öcalan; and that Şükrü Erden gave his official statement at the courthouse.

(03/231) Children and Another Person Arrested in Antep…

According to the news coverage of March 25, 2024, 2 of 5 people, including 2 children, who were detained for shouting slogans during a commemoration in the Şahinbey district of Antep, were released on judicial control conditions. K.Ö. (16), B.A. (17), and Ramazan Altıntaş were arrested on the charge of ‘being a member of an illegal organization’ and sent to prison.

(03/232) Investigation on the Killing of 7 People in Diyarbakır in 1991…

It is learned from the news coverage of March 26, 2024, that the investigation file reopened in 2020 by the Diyarbakır Public Prosecutor’s Office about 7 people who died and 2 people who were wounded when the gendarmerie opened fire on people attending a funeral in the Kulp district of Diyarbakır on December 24, 1991, was closed in 2023 with the decision of ‘no prosecution’ on the grounds of ‘statute of limitations’.

In the incident in which 7 people (Mehmet Nesin Altın, Neytullah Tekin, Hayrettin Demirtuyi, Felemez Bulut, Ömer Öztürk, Ömer Öztürk, Ali Miltaş and Şahin Tekin) were killed and 2 people (Mehmet Şah Tekin and Şeyhmus Altındağ) were wounded, the Kulp Public Prosecutor requested permission to prosecute those responsible with a summary sent to the Diyarbakır Chief Public Prosecutor’s Office on August 25, 1992, but no action was taken on the summary. Subsequently, on July 7, 1993, the Kulp Public Prosecutor’s Office issued a decision of non-jurisdiction and wrote to the provincial and district administrative boards for permission to investigate the gendarmerie personnel on duty in Kulp on the day of the incident, but there was no progress on the file until 2012. When lawyer Nahit Eren, currently the chair of the Diyarbakır Bar Association, filed a new criminal complaint petition, the decision of non-jurisdiction was lifted and the Diyarbakır Chief Public Prosecutor’s Office reopened an investigation on the charge of ‘killing more than one person for the same reason’. The statements of 37 non-commissioned officers and officers were taken within the scope of the investigation, and in 2014, while the investigation was ongoing, Nahit Eren applied to the Constitutional Court (AYM) on the grounds of ‘violation of the right to life’. On November 2, 2017, Diyarbakır Chief Public Prosecutor’s Office issued a decision of ‘non-prosecution’ in the investigation file, and Nahit Eren applied to the Constitutional Court for the second time in 2018 on the grounds of ineffective investigation. The Constitutional Court ruled that ‘the obligation to conduct an effective investigation within the scope of the right to life was violated’ in the application made in 2014, and following this, an investigation was reopened in 2020.

It is reported that Nahit Eren will apply to the Constitutional Court for the third time.

(03/233) Halkevleri Members on Trial…

The final trial of the case against 6 people, including Halkevleri chair Nebiye Merttürk, who were detained in the police intervention against Halkevleri members who gathered in front of the Ministry of National Education in Ankara on September 25, 2020, to submit their report to the Ministry of National Education, on the charge of ‘violating the Law on Meetings and Demonstrations No 2911’ was held at Ankara Penal Court of First Instance No 50 on March 26, 2024. The court acquitted 6 people.

(03/234) ESP Executive and Others on Trial in Ankara…

On March 25, 2024, the final trial of the case against 14 people, including Socialist Party of the Oppressed (ESP) Co-Chair Şahin Tümüklü, who were detained by using physical violence during the police intervention against a funeral they attended on August 9, 2022, and who were subjected to torture and ill-treatment under custody, on the charge of ‘violating the Law on Meetings and Demonstrations No 2911’ was held at Istanbul Gaziosmanpaşa Penal Court of First Instance. The court acquitted 14 people.

(03/235) People on Trial in Izmir…

On March 26, 2024, the final trial of the case against 21 people, who were detained during the police intervention against the students who wanted to petition Izmir Dokuz Eylül University Rectorate and hold a press statement against the remote education decision taken after the Maraş earthquakes on February 6, 2023, was held at Izmir Penal Court of First Instance No 28, on the charge of ‘violating Law No 2911 on Meetings and Demonstrations’. The court acquitted 21 people.

(03/236) HDP Provincial Co-Chair Released…

It is learned from the news coverage of March 25, 2024, that Demet Resuloğlu, the former Kırşehir provincial co-chair of Peoples’ Democratic Party (HDP) who was arrested on December 17, 2016, on the charge of ‘being a member of an illegal organization’, was released on March 4, 2024, following the reversal decision of Penal Department No 3 of the Court of Cassation.
