It is learned from the news coverage of December 13, 2023, that 1 militant died in a clash between the security forces and HPG militants in rural areas of the Dargeçit district of Mardin on December 3, 2023.

It is learned from the news coverage of December 13, 2023, that 1 militant died in a clash between the security forces and HPG militants in rural areas of the Kemah district of Erzincan on November 17, 2023.

It is learned from the news coverage of December 15, 2023, that 3 militants died in clashes between the Turkish Armed Forces (TSK) units and HPG militants in the Qandil area of the Iraqi Kurdistan Regional Government (IKBY) on March 10, 2023.

It is learned from the news coverage of December 17, 2023, that 3 militants died in the clashes between the Turkish Armed Forces (TSK) units and HPG militants in the Metina area of IKBY on October 2, November 28, and December 3, 2023.

It is learned from the news coverage of December 24, 2023, that 1 militant died in a clash between Turkish Armed Forces units and HPG militants in the Metina area of IKBY on December 8, 2023.

It is learned from the news coverage of December 25, 2023, that 4 militants died in a clash between the Turkish Armed Forces units and HPG militants in the Zap region in IKBY on December 22 and 23, 2023.

It is learned from the news coverage of December 26, 2023, that M.S.K., a prisoner in Izmir F Type Prison No 2, was not given the orthopedic chair he should use by the prison administration.

It is learned that the appeal made on December 26, 2023, to the chief public prosecutor’s office in Bursa by the lawyers of PKK leader Abdullah Öcalan to visit him was not responded to.

(12/235) Detained Association Executives and an Activist…

On December 26, 2023, 6 people were detained in house raids in Izmir on the allegations of ‘making propaganda for an illegal organization’. The names of the detainees are Tevgera Jinên Azad (TJA) activist Emine İnan, co-chairs of Anadolu Association for Assistance and Solidarity with Those Who Lost Their Relatives (ANYAKAYDER) Rahime Turan and Mikail Fidan, association executives Zarife Sungur, Ayfer Yıldırım, Fevziye Pülat.

(12/236) Detained People in Diyarbakır…

37 of 60 people, including 5 children, who were detained on December 24, 2023, in Diyarbakır after the 1st Youth Assembly Congress of Peoples’ Equality and Democracy Party (DEM Parti) were released after statement procedures at the police on December 25, 2023. 8 of the 23 people whose detention for one more day period was extended were released on December 26, 2023, after statement procedures at the prosecutor’s office. 1 of the 15 people (Mihriban Şorli) who were referred to the court on the charge of “resisting to prevent duty” was arrested for the same reason. The court released the other 14 people on judicial control condition.

The names of those released are as follows: H.A., B.A., F.Z., A.Ç., M.D.Ç., Melek Bayav, Zilan Yücel, Hayriye Filiz, Aziz Şahin, Alican Söğüt, Nuroj Türk, Hevin Türk, Muhammed Yusuf Demir, Sinan Süt, Berivan Bayar, Berdan Çelik, Azat Aktaş, Özcan Güneş, Cihat Arutay, Mizgin Çakır, Bünyamin Doğan, Mehmet Şen, Ferdi Erat, Selahattin Eyyübi, Ersin Metin, Heja Kayan.

(12/237) People Arrested in Istanbul…

B.T., S.Y.G., N.K. and F.G. were detained on December 25, 2023, in the Bakırköy district of Istanbul on the grounds of a street interview for a social media channel. B.T. and S.Y.G. were arrested by the court on the same day on the charges of ‘insulting the President’ and ‘inciting the public to hatred and hostility’.

The Ministry of Interior announced on December 26, 2023, that 208 people were detained on the allegations of ‘being a member of an illegal organization,’ ‘making propaganda for an illegal organization’, and ‘financing an illegal organization’ through operations conducted in 32 cities.

(12/239) The Nezir Tekçi Case…

The retrial of the case against retired Colonel Ali Osman Akın and Lieutenant Colonel Kemal Alkan on the allegations of ordering the killing of Nezir Tekçi, who disappeared under custody in Hakkari in 1995, on the grounds that he did not reveal the whereabouts of the PKK militants, continued on December 25, 2023, at Eskişehir Heavy Penal Court No 1. The court rejected the request to lift the judicial control conditions on the defendants and adjourned the hearing to March 8, 2024.

At the final hearing of the case against retired Colonel Ali Osman Akın and Lieutenant Colonel Kemal Alkan on the charge of “intentional killing brutally or through torment” at Eskişehir Heavy Penal Court No 1 on September 11, 2015, the court acquitted the defendants. On March 27, 2018, after the Court of Cassation’s Penal Chamber No. 1 upheld the acquittal, the lawyers of the Tekçi family applied to the Constitutional Court (AYM). The Constitutional Court ruled that the procedural aspect of Article 17 of the Constitution, which regulates the right to life, had been violated and sent the case file to Eskişehir Heavy Penal Court No. 1 for retrial.

The indictment against journalist Nimet Ölmez for ‘insulting’ Justice and Development Party (AKP) Hakkari Provincial Chair Zeydin Kaya in a social media post was accepted by Hakkari Penal Court of First Instance No 1 on December 25, 2023.

Istanbul Chief Public Prosecutor’s Office launched an investigation against journalist Can Ataklı on December 25, 2023, on the charge of ‘inciting or insulting the public to hatred and hostility’. The reason for the investigation was Can Ataklı’s posts on various social media platforms about the soldiers who died in the operations of the Turkish Armed Forces within the borders of the IKBY.

It is learned from the news coverage of December 25, 2023, that an investigation was initiated against academic Zeliha Gizem Sayın, a lecturer at Kadir Has University Faculty of Law, after the video footage of her argument with students about putting shoes in the corridor of the university instead of the shoe rack was published on social media.

(12/243) Removal of Containers of Civil Society Organizations in Adıyaman…

On December 15, 2023, it was learned from news coverage of December 15, 2023 that containers for earthquake victims belonging to the Disaster Management and Solidarity Association, Rosa Women’s Association, Rengarenk Umutlar Association, Children’s Studies Association, and Ferat Association in Adıyaman were removed by AFAD on the order of the governorate.

(12/244) Naming of a Primary School After Esat Oktay Yıldıran in Izmir…

It is learned from the news coverage of December 26, 2023, that the name of Esat Oktay Yıldıran, Internal Security Commander of Diyarbakır E Type Prison, where serious and grave human rights violations, including torture and ill-treatment, took place after the military coup of September 12, is given to a primary school in the Buca district of Izmir.

Access to https://artigercek.com, https://www.diken.com.tr, https://www.sozcu.com.tr news reports on a special operations police officer killing his wife and then committing suicide was banned on the grounds of ‘violation of personal rights’ by Elazığ Penal Court of Peace No. 2 on December 25, 2023.

It is learned from the news coverage of December 26, 2023, that 88 news reports about the President’s lawyer on various websites were banned from access on the grounds of ‘violation of personal rights’ by the Istanbul Penal Court of Peace No 6 on December 21, 2023, and the content was ordered to be deleted.

It is learned from the news coverage of December 26, 2023, that the contents of https://www.tele1.com.tr, https://flashhabertv.com/canli-yayin.html, https://halktv.com.tr websites where the name of the MIT Director is mentioned, were banned from access by Istanbul Penal Court of Peace No 5 on December 21, 2023, and the contents are ordered to be deleted.
