(07/214) State of Emergency is Lifted…

The state of emergency announced on July 20, 2016, is lifted on July 18, 2018 as of 01.00. According to the first article of the law proposal for regulations after state of emergency, which was submitted to the Grand National Assembly of Turkey, governors will have “the power of limiting entrance and exit to certain places in the city up to 15 days, in the case that there are serious signs of disturbance or possibility of disturbance of public order and security in a way that would block or interrupt usual course of the life”. According to other articles of the law proposal, objections to arrest and demands of released will be concluded in 90 days; electronic search in personal computers which was dependent on judge’s decision could be carried out by the decision of prosecutors; dismissals from public service will be dependent on particular approval of the ministers who are responsible to the President, dismissals of military personnel will be dependent on the Minister of Defence’s approval, and those who had been dismissed in state of emergency situation and employed back will not have compensation rights; the legal limit for detention for collective crimes will be 4 days and could be extended two times to 12 days, the limit for individual crimes will be 2 days and could be extended twice to 6 days; passports of dismissed public personnel and their spouses could be terminated by the approval of the Minister of Interior for 3 years.

(07/215) Person Subjected to Police Violence in Van…

It is learned from news coverage of July 18, 2018 that a person named Vehbi Aslan was subjected to physical violence by the police in İpekyolu district of Van, on July 15, 2018. Vehbi Aslan stated in the news reports as following: “Two police officers came to me with their guns. They wanted me to put my hands up. And then they wanted me to lean on a transformer unit. After leaning on the transformer unit they checked my ID and made a body search. And then they took me near the security cabin across the AKP provincial office. Then made me walk around 20-30 meters and took me to a room, hit me with an undefined object at the back of my neck, and I fell down. One of them started to kick me. They beat me for 10 minutes.”

It is reported that Vehbi Aslan had a medical report evidencing the physical violence and will make an official complaint against the police officers.

1 police officer (Ahmet Altun) who was wounded in a clash that took place in a house raid in Van on July 15, 2018, died in hospital on July 18, 2018.

(07/217) Prevention of Prisoner’s Right to Health…

It is learned from news coverage of July 18, 2018 that, Merve Aydoğan, a prisoner with celiac disease in Tarsus Women’s Prison, is prevented from her right to health. It is stated in the news report that, Merve Aydoğan’s referring to the hospital is prolonged; she is sent back to prison without being medically examined at the hospital because she rejects to be examined in handcuffs; and diet meals that are proper for celiac disease are not given to her.

(07/218) Rejection to Meeting Request with Abdullah Öcalan…

It is learned that the appeal made on July 18, 2018 to chief public prosecutor’s office in Bursa by PKK leader Abdullah Öcalan’s lawyers in order to visit their client was rejected the same day on the grounds of limitations for prisoners in accordance with the law on the execution of sentences and security measures (law no 5275). With the last rejection, it was the 766th time that appeals for visiting Öcalan have been rejected so far. Abdullah Öcalan has met his lawyers on July 27, 2011 for the last time.

(07/219) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling for a while to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on July 18, 2018 at 13.30 and 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on July 18, 2018, 3 people (Gülnaz Bozkurt, Mahmut Konuk and Derviş Lermi) and at 18.00 2 people (Derviş Lermi and İlker Işık) were detained.

Thus in total 5 people were detained due to press declaration intended to be held in Yüksel Street on July 18, 2018. It is learned that detainees were released the same day.

(07/220) Co-Mayor on Trial in Muş…

Figen Yaşar, co-mayor of Bulanık district of Muş, has been released by the court on July 17, 2018, on a trial of the case against her on Muş Heavy Penal Court. Upon the prosecutor’s objection to release, Figen Yaşar is detained at her house in Van on July 18, 2018.

(07/221) HDP MP On Trial…

The case against HDP Diyarbakır MP Saliha Aydeniz, on the charge of ‘leading an illegal organisation’ on Diyarbakır Heavy Penal Court No 10, is held on July 18, 2018. The prosecutor demanded legal proceeding to be ended, as per Article 83 of the Constitution which regulates legislative impunity. The court rejected the demand, on the grounds that the judging is carried on Article 14 of the Constitution, which defines the cases out of scope of Article 83, and adjourned the trial to December 28, 2018.

(07/222) Former Co-Chair of HDP on Trial…

The case against 8 people including Figen Yüksekdağ, former co-chair of HDP (People’s Democratic Party), on the charge of ‘leading an illegal organisation’ and ‘being a member of an illegal organisation’, on Adana Heavy Penal Court No 9, is held on July 18, 2018. After defence hearings the court adjourned the trial.

(07/223) Former Co-Chair of HDP on Trial…

The case against Selahattin Demirtaş, former co-chair of HDP (People’s Democratic Party), on Ankara Heavy Penal Court No 19, is held on July 18, 2018. Selahattin Demirtaş did not attend the trial. The court decided to continue detention and adjourned the trial to August 28, and 29, 2018.

(07/224) Prosecuted CHP Chair and CHP MP’s…

It is learned from news coverage of July 18, 2018 that, Ankara Public Prosecutor’s Office initiated an investigation on CHP Chair Kemal Kılıçdaroğlu, on the charge of ‘insulting the President’, for sharing the cartoon “Tayyips Kingdom” on social media.

An official legal application upon President Tayyip Erdoğan’s complaint to the prosecutor’s office is made against 72 MP’s of CHP, who also shared the same cartoon on their social media accounts.

The lawsuit for mental anguish against the cartoon “Tayyips Kingdom” has been rejected by Ankara Penal Court of First Instance No 1.

(07/225) Detentions and Arrests in Alleged Link to Coup Attempt…

On July 18, 2018, 5 military members on active duty in Balıkesir and 7 people through a Kayseri based investigation are detained.

132 of 221 people including military members on active duty, who were detained through an Istanbul based “pay phone” investigation, are detained by the court on July 18, 2018. 89 people, 5 of which are on juridical control conditions, are released.

13 of 22 military personnel who were detained in Mardin, are arrested by the court on July 18, 2018. 9 people, 5 of which are on juridical control conditions, are released.

1 sergeant from Turkish Land Forces Command, who was detained in Ankara through a Samsun based investigation, is arrested by the court on July 18, 2018.

Former provincial deputy police chief of Karaman, S. K., who was dismissed by the state of emergency decree, is arrested by the court on July 18, 2018.

Salih Zeki Yiğit, who was brought to Turkey by a National Intelligence Service operation in Ukraine on July 12, 2018, is arrested by the court on July 18, 2018.

It is learned from news coverage of July 18, 2018 that, Ukrainian authorities were not aware of the operations of Turkish National Intelligence Service to capture 2 people abroad and to bring them to Turkey through “Fethullahist Terrorist Organisation / Parallel State Structure”.

(07/226) Trials in Alleged Link to Coup Attempt…

The case against USA citizen and priest Andrew Craig Brunson, for ‘committing crime on behalf of an illegal organisation but not being a member’, and ‘espionage’ on Izmir Heavy Penal Court No 2 is held on July 18, 2018. After defence and witness hearings, the court decided to continue detention for Brunson and adjourned the trial to October 12, 2018.

The final trials of the separate cases against 3 people for leaking the questions of Public Personnel Selection Exam in 2010, on Ankara Heavy Penal Court No 2 is held on July 18, 2018. The court sentenced 1 defendant to 10 years and 6 months and 1 defendant to 6 years and 3 months for ‘being an illegal organisation member’. The court also sentenced 1 defendant to 3 years 1 month and 15 days and fine penalty for ‘chain fraud towards public institutions’. The court acquitted 1 defendant.

(07/227) Book Being Pulled off Shelf…

It is learned from news coverage of July 18, 2018 that distribution and sale of the book “12 Eylül Karanlığında Dört İdam Bir Tanık” [4 Executions 1 Witness in the Darkness of September 12] of Akın Bodur, a reporter of Cumhuriyet newspaper, is banned by Batman Penal Court of Peace No 1 on April 2017, on the charge of ‘making propaganda for an illegal organisation’. It is reported that, ban decision was made after a house raid in Batman where the book was found and seized, and writer and publisher of the book were not notified about the ban. It is learned that Akın Bodur’s lawyer appealed to the supreme court.
