19 – 21 November 2022 Daily Human Rights Report

(11/164) Operations and Attacks…

The Ministry of National Defence announced on November 20, 2022 that, an air operation called “Claw-Sword” was launched against 89 targets in Syria and the Iraqi Kurdistan Regional Government.

It is learned from the news coverage of November 20, 2022 that, in the “Claw-Sword” operation of the Turkish Armed Forces, 1 journalist (Hawar News Agency reporter Îsam Ebdulah) died and 1 journalist was wounded. It is also claimed that a hospital in Kobanê district was also targeted.

It is learned that 1 soldier and 7 police officers were wounded in the missile attack allegedly from Syria to the Öncüpınar Border Gate in Kilis on November 21, 2022.

It is learned that 3 civilians including 1 child died and 3 people were wounded in the missile attack allegedly from Syria to Karkamış district of Antep on November 21, 2022. The names of 2 civilians are: Ayşenur Alkan, Hasan Karataş (5, m).

(11/165) Bomb Attack in Istanbul…

8 people are detained on November 19, 2022 in relation to the bomb attack in Istiklal Street of Beyoğlu district in Istanbul killed 6 people including 2 children, and wounded 81 people on November 13, 2022. 2 of the detainees are arrested by the court on November 20, 2022 which made the total number of arrestees 19.

17 of 51 people, including Ahlam Albashır, the Syrian citizen who was claimed to be the assaulter who have been detained earlier, were arrested by the court on November 17, 2022. 5 people were released provided that 3 of them will be on judicial control conditions, and the court has decided to deport 29 people.

(11/166) Person Forced to be Police Informant in Hatay…

It is learned from the news coverage of November 19, 2022 that, a person (R. B.) were threatened and forced to be police informant by persons who claim themselves as police officers in Hatay.

(11/167) Torture and Ill-Treatment in Prison…

It is learned from the news coverage of November 19, 2022 that, Bager Sayak, a prisoner in Ankara Sincan High Security Prison No. 1 was being kept in a solitary cell since October, 2021 and was taken out of his cell for one and a half hour a day. It is also stated in the news reports that Kurdish books and magazines sent to Ankara High Security Prison No. 1 were not given to the prisoners.

It is learned from the news coverage of November 21, 2022 that, Mehmet Ümit, a prisoner with one hand who was transferred to Konya Ereğli High Security Prison under coercion, was being kept in solitary cell.

(11/168) Prevention of Right to Health in Prison…

It is learned from the news coverage of November 20, 2022 that, Burhanettin Şahin an ill prisoner with cancer in Erzurum H Type Prison was not receiving medical treatment and his surgery was planned to January 13, 2023.

(11/169) Police Intervention to Protests in Adana, Izmir and Tunceli…

The police intervened in the press declaration held in Tunceli on November 20, 2022 to protest the “Claw-Sword” military operation of the Turkish Armed Forces into some regions of Syria and the Iraqi Kurdistan Regional Government. It is learned that 1 person (İsmail Anıl Salan) who was detained by the police was released after statement procedures at the police on November 21, 2022.

The police prevented the press declaration to be held for the same cause in front of Türkan Saylan Cultural Center in Konak district of Izmir on November 20, 2022. The press declaration was held outside of the Peoples’ Democratic Party (HDP) Izmir office where the police used physical violence against gathering people. It is learned that nobody was detained.

The police used physical violence to prevent the press declaration to be held for the same cause in Adana on November 21, 2022. It is learned that the police prevented journalists from recording and Evrensel newspaper’s reporter Volkan Pekal was subjected to physical violence of the police.

(11/170) Police Intervention to a Commemoration in Istanbul…

The police intervened in the sit-in in Kadıköy district of Istanbul on November 20, 2022 to commemorate those who lost their lives in the Suruç Massacre, and detained 19 people by using physical violence. Detained people are released after statement procedures at the police on the same day. It is learned that one person had a damaged eardrum and broken rib and one person has fainted in the detention vehicle due to the police violence. It is also stated in the news reports that the detainees were kept in handcuffs behind their backs for a long time.

(11/171) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration which was made within the scope of “I Want My Job Back Protest” in front of Human Rights Monument in Yüksel Street on November 18, 2022 and forced people away from the monument by using physical violence.

(11/172) Detained Child in Diyarbakır…

On November 19, 2022, a 17-year-old child (B. Ç.) was detained in a house raid in Diyarbakır, on the grounds of writing on the walls. It is claimed in the news reports that the police asked a 5-year-old child in the raided house “Are there any guns in your house? Do you like us?”.

(11/173) Investigation Against Journalist…

It is learned from the news coverage of November 19, 2022 that, Istanbul Public Prosecutor’s Office launched an investigation on the grounds of ‘inciting hatred and hostility among public’ against journalist Mehmet Selçuk Ada, for his social media post reading “They started the election campaign” regarding the bomb attack in Beyoğlu district of Istanbul.

(11/174) Lawyer on Trial in Izmir…

It is learned that the indictment of Izmir Public Prosecutor’s Office against lawyer Aryen Turan, a member of the Association of Lawyers for Freedom (ÖHD) was accepted by Izmir Heavy Penal Court No. 18 on November 18, 2022. The indictment demands sentence for Aryen Turan from 2 years and 6 months to 10 years on the charge of ‘knowingly and willingly aiding an illegal organisation’, over her expressions regarding the allegations of the use of chemical weapons during the Claw-Lock military operation of the Turkish Armed Forces in the Iraqi Kurdistan Regional Government and for the slogan “Jin jiyan azadi” in her speech at the Bar Association Congress. The first trial will be held on February 16, 2023.

Aryen Turan was detained on November 3, 2022 through the investigation against her and was released by the court with a ban on leaving the country and on judicial control conditions on November 4, 2022.

(11/175) Rights Defenders on Trial in Muğla…

The trial of the case on the charge of ‘resisting to prevent public duty’ and ‘insulting a public official’ against Füsun Ergün and Gülören Demir, who were forcibly moved away by the gendarmerie on 11 August 2021 from the protest against the lignite mine intended to be established in the Akbelen Forest in the Milas district of Muğla, is held at Milas Penal Court of First Instance No. 2 on November 21, 2022. It is learned that Bodrum Heavy Penal Court rejected the lawyers’ request for recusation and the lawyers objected this decision. The court adjourned the trial to February 2, 2023.

(11/176) Ban of Events in Cities…

Urfa Governorate’s Office made a declaration on November 20, 2022 and announced that all events such as press statements, assemblies, marches, hunger strikes, sit-ins, rallies, opening stands and tents, distribution of leaflets/brochures, hanging posters/banners are banned for 15 days as of November 21, 2022, on the grounds of “calls that are aimed at creating a discriminatory and misleading public opinion against cross-border operations”.

Bingöl Governorate’s Office made a declaration on November 21, 2022 and announced that all events such as press statements, assemblies, marches, hunger strikes, sit-ins, rallies, opening stands and tents, distribution of leaflets/brochures, hanging posters/banners are banned for 15 days as of November 21, 2022, on the grounds of “calls that are aimed at creating a discriminatory and misleading public opinion against cross-border operations”.

Van Governorate’s Office made a declaration on November 21, 2022 and announced that all events such as press statements, sit-ins, making surveys, opening stands and tents, collecting petitions, distribution of leaflets/brochures, hanging posters/banners are banned for 9 days as of November 21, 2022.

Bitlis Governorate’s Office made a declaration on November 21, 2022 and announced that all events such as open-door and indoor meetings, protests, sit-ins, demonstrations, human-chain marches, public talks, any kind of audio and visual public events with vehicles, hunger strikes, opening stand and tents, press statements, collecting petitions, flying lanterns and balloons, using aerial vehicles, commemorations, panel talks, conferences, festivals, theatre plays, pantomime shows, distribution of leaflets/brochures, hanging posters/banners are banned for 15 days as of November 21, 2022.
