18 January 2023 Daily Human Rights Report

(01/134) Torture and Ill-Treatment in Prison…

It is learned from the news coverage of January 18, 2023 that, Hizan district’s former co-mayor İhsan Uğur who is kept in Diyarbakır High Security Prison No. 2 was subjected to disciplinary proceeding for speaking Kurdish with another person in the hospital where he was taken to, and that he was given the penalty of prevention from sports and conversation rights for 1 month.

It is learned from the news coverage of January 18, 2023 that, 2 prisoners in Antalya High Security Prison were forced to be handcuffed behind their backs while they were brought to the court, and they were subjected to physical violence of the correction officers and gendarmerie for rejecting it. It is also stated in the news reports that 2 prisoners who were injured were not taken to the prison infirmary and were put in solitary cells.

It is learned from the news coverage of January 17, 2023 that, prisoners in Kütayha Prison were not being taken to hospital for a month.

(01/136) Meeting Request with Abdullah Öcalan Not Responded…

It is learned that the appeal made on January 17, 2023 to chief public prosecutor’s office in Bursa by the lawyers of PKK leader Abdullah Öcalan, in order to visit him was not responded.

(01/137) Journalists on Trial in Istanbul…

The trial of the case against journalists Canan Coşkun and Barış Pehlivan, over a news report they made, is held at Istanbul Heavy Penal Court no. 34 on January 17, 2023. The indictment demands sentence for 2 journalists on the charge of “targeting officials taking part in the fight against terrorism”. After defence hearings the court adjourned the trial to May 9, 2023.

(01/138) People on Trial in Ankara…

The trial of the case against 8 people who were detained by the police intervening into the press declaration held in Ankara on August 12, 2020 to protest Turkey’s withdrawal from the Istanbul Convention, is held at Ankara Penal Court of First Instance No. 53 on January 17, 2023. The court accepted the request of a police officer, whose shirt was torn during the intervention, to join the case. After defence hearings the court adjourned the trial to April 12, 2023.

(01/139) HDP Executive and Other People on Trial in Batman…

The first trial of the case against the Peoples’ Democratic Party (HDP) former provincial co-chair Fatma Ablay and the Free Women’s Movement (TJA) activists Leyla Bayram and Şirvan Göçer, is held at Batman Heavy Penal court No. 2 on January 17, 2023. The indictment demands sentence for 3 people on the charge of ‘being an illegal organisation member’. After defence hearings the court decided to release 3 people and adjourned the trial.

Fatma Ablay, Leyla Bayram and Şirvan Göçer were detained on May 31, 2022 and were arrested by the court on June 3, 2022.

(01/140) Gezi/Çarşı Case…

The retrial of the case against 35 people including Beşiktaş football team’s fan club Çarşı group members, for the Gezi Park protests in 2013, is held on January 17, 2023, as the acquittal of the local court was overturned. The court adjourned the trial.

(01/141) Şenyaşar Family Case…

The first trial of the case against 19 people including 2 arrestees, regarding death of 3 members of Şenyaşar family, in the state hospital in Suruç district of Urfa on June 14, 2018, is held at Malatya Heavy Penal Court No. 5 on January 17, 2023.

The indictment demands sentence for the defendants on the charges of ‘killing more than one person’, ‘attempting to kill more than one person’, ‘damaging public property’, ‘concealing and destroying evidence of crime’, ‘violating workplace immunity’.

It is learned that the journalists were not allowed into the court room, and the court rejected intervention demands of Van, Diyarbakır, Siirt, Batman and Urfa bar associations. After defence and complainant hearings the court decided to continue detention of Celal Yıldız and Mikail Şimşek and adjourned the trial to March 15, 2023.

(01/142) Detentions and Arrests in Alleged Link to Coup Attempt…

It is learned that 37 people were detained in operations covering 10 cities through an Istanbul based investigation and 25 people were detained through 2 different investigations in Ankara on January 17, 2023.
