(08/154) Civilian Wounded Due to Explosion in Tunceli…

On August 21, 2018, a civilian named Gönül Parlak was seriously wounded due to an explosion on the pathway between Ramazan and Doğantaş villages of Nazimiye district of Tunceli.

(08/155) Operations and Attacks in Southeast…

It is learned from the news coverage of August 17, 2018 that, 6 militants died in a clash between security forces and HPG militants in rural areas of Osmaniye on July 11, 2018; 1 militant died in a clash between security forces and YJA STAR militants in rural areas of Tunceli on August 14, 2018.

It is learned from the news coverage of August 25, 2018 that, 1 HPG militant died in a clash between security forces and HPG militants in rural areas of Mardin on July 24, 2018; 1 HPG militant died in a clash in rural areas of Van on August 7, 2018; 3 HPG militants died in a clash in rural areas of Tunceli on August 15, 2018; 1 soldier died in a clash in rural areas of Doğubayazıt district of Ağrı on August 21, 2018; 1 soldier died and 2 soldiers were wounded in a clash in rural areas of Karlıova district of Bingöl on August 25, 2018.

It is learned from news coverage of August 26, 2018 that, 4 HPG militants died in a clash in rural areas of Şırnak on August 7, 2018; 2 militants died in a clash in rural areas of Hakkari on August 17, 2018.

It is learned from the news coverage of August 26, 2018 that the forest fire in rural areas of central district of Tunceli is spreading around.

 

It is learned from the news coverage of August 26, 2018 that a fire started in forestland of Cudi Mountain after cannon shots made from Hisar Military Station in Silopi district of Şırnak. It is stated in the news reports that military operation is still proceeding and no actions are taken to put out the fire.

(08/156) Person Being Subjected to Police Violence in Ağrı…

It is learned from the news coverage of August 17, 2018 that, Murat Sarı, who had been detained in house raids in Hürriyet neighbourhood in Ağrı’s Doğubayazıt district on August 15, 2018, has a crack at his skull due to butt stroking of the police. It is stated in the news reports that Murat Sarı was taken under operation without noticing his family.

Murat Sarı stated the following: “When the police raided the house where I live, they hit me at the head with a gun stroke as I open the door. My head started to bleed, they got me on the ground, handcuffed me behind my back and left me as such for 20 minutes. They reacted against my mother speaking Kurdish. They took me to the next house. After 2 hours they took me to the hospital. And told there that I hit myself to the door”.

(08/157) Person Being Subjected to Police Violence in Diyarbakır…

It is learned from the news coverage of August 22, 2018 that Osman Gökalp, a tailor in Diyarbakır had a quarrel with a police officer in his shop; and was subjected to physical violence, handcuffed behind his back and detained by the police team coming to the shop afterwards. It is reported that Osman Gökalp was taken to the police station and legal actions were taken against him on the charge of ‘insulting the President’. It is learned that Osman Gökalp applied to Human Rights Association (IHD) Diyarbakır branch.

Osman Gökalp stated the following about the police violence he was subjected to: “I told them I have a heart disease, I told that my heart functions at 30 per cent, but they did not listen. My hands got bruised due to being handcuffed behind my back, I have wounds at my shoulders and knees. They forcefully took me to Yenişehir Police Station. They tried to take my statement under oppression for three and a half hours”.

(08/158) People Being Subjected to Police Violence in İstanbul…

It is learned from the news coverage of August 23, 2018 that, Ebubekir Demir and Ferhat Atılğan, 2 people who were in a car and stopped by the police for ID check in Bahçelievler district of Istanbul, were subjected to physical violence by the police. It is reported that Ebubekir Demir’s brother Ramazan Demir was also subjected to physical violence at the police station where he went to see his brother. It is learned that Ebubekir Demir, Ramazan Demir and Ferhat Atılğan were referred to the court on the charge of ‘resisting a police officer’, and were released by the court with a ban on leaving the country whereas no legal actions were taken against the police officers.

Ebubekir Demir stated the following on the police violence they were subjected to: “Motorcycle police units stopped us and asked our ID’s. We submitted our ID cards. One of the police officers said ‘Your name is not Ebubekir’, and told me another name that I do not remember. I said ‘You can take us to the station and check for it’. Another police officer said ‘Will you teach us how to do our job’ and punched me. They started to beat me at the back seat of the car. Beating continued on the way to the station and at the station as well. We were subjected to curses. I got angry because of the curses and I lost control of myself and hit the window at the station with my head. I fainted. When I regain consciousness a police officer was hitting my chest with his feet. They showed me a picture and asked whether this person is related to me or not. I told them that I do not know this person. They hit my wounded head. My brother came to the police station and asked why they beat us, then they beat him too. We blacked out in the yard of the station due to being beaten. They spilt water on us to recover us. I will press charges against the police officers”.

(08/159) Person Being Forced to be Informant in Adana…

It is learned from the news coverage of August 22, 2018 that, Halil Şaşmaz, who had been detained in Adana on August 14, 2018 on the grounds of ‘planning a protest’, was forced to be an informant by 6 people who claim themselves to be intelligence officers at Police Headquarters where he was taken under custody. Halil Şaşmaz stated that the police told him “We know you well. We have been watching you for 2 years. Do not consider as police, we are intelligence officers. The cases we have will waste your youth. Stand by the state. The state will help you (…) Do not waste our time. Do not play with us. If you do not accept you lose your youth. You go to prison” and threatened him.

(08/160) Ill Prisoner Died in Prison…

Retired professor Sabri Çolak (69), for whom a medical report states that he cannot stay in prison, died in Van High Security Closed Prison on August 24, 2018.

Sabri Çolak was arrested through “Fethullahist Terrorist Organisation / Parallel State Structure Investigations” on July 27, 2016; and on April 17, 2018, was sentenced to 7 years and 6 months for ‘being an illegal organisation member’.

It is stated in the news reports that Sabri Çolak had a heart disease.

(08/161) Torture and Ill-Treatment in Prison…                                  

It is learned from the news coverage of August 17, 2018 that, some prisoners in Elazığ High Security Prison No 2 were taken out of their wards and put in single cells.

It is learned from the news coverage of August 20, 2018 that, Peace and Democracy Party (BDP) Tunceli former co-chair Amber Kürtgözü Bakıray, who is being kept in İzmir Şakran Women’s Prison was prevented from using her right to be released on probation based on disciplinary penalties given her in different prisons that she was kept before. Amber Bakıray was arrested on September 28, 2011 and was sentenced to 9 years. Amber Bakıray was supposed to be released on July 26, 2018 according to probation conditions however she was still being kept in prison based on a solitary confinement given to her in Burhaniye Prison because of rejecting to be in military order in roll-calls. It is stated in the news reports that Amber Bakıray has skin cancer.

It is learned from the news coverage of August 20, 2018 that political prisoners in Adana Kürkçüler F Type Prison were forced to have visits in the same place with prisoners of ISIS and “Fethullahist Terrorist Organisation / Parallel State Structure Cases”. It is also stated in the news report that prisoners who protest this were subjected to disciplinary proceedings and were being punished.

It is learned from the news coverage of August 22, 2018 that, one-hour visit right of Aytaç Ünsal, a lawyer from People’s Law Office and his spouse Didem Baydar Ünsal who are kept in Burhaniye T Type Prison, was reduced to monthly half an hour.

It is learned from the news coverage of August 22, 2018 that, Aynur Gazioğlu, who is kept in Tekirdağ T Type Prison with her 2 years-old child, was sentenced to solitary confinement for 10 days. It is stated in the news reports that Aynur Gazioğlu had a discussion with a warden because of a mistake in her request of baby food and she was sentenced to 10 days of solitary confinement after a disciplinary proceeding. It is reported that her lawyers appealed to the judge of execution.

It is learned from the news coverage of August 23, 2018 that, 16 prisoners in A-5 ward of Diyarbakır T Type Prison No 1 were banned from activities for 1 month because of ‘attempting to throw the newspapers from their ward to A-4 ward’. It is stated in the news reports that 2 prisoners were taken to the disciplinary board, and they wanted to defence themselves in Kurdish as well as rejecting to defence themselves in military order; and thus were taken back to their wards. It is stated in the news reports that the disciplinary punishment was given without allowing the prisoners to defence themselves and the demand of 2 prisoners to defence themselves in Kurdish was registered as “they wanted to give statement in an unknown language”.

It is learned from the news coverage of August 23, 2018 that prisoners in Izmir F Type Prison No 2 were subjected to arbitrary and offending impositions of wardens and gendarmerie officers during transfers to courthouse and hospital and because of this they cannot arrive at courthouses and hospitals; thus cannot use their right to health and right to a fair trial.

(08/162) Prevention of Infant’s Right to Health in Prison…

It is learned from the news coverage of August 21, 2018 that 13 months old baby A. Y., who has asthma and who is kept in Urfa T Type Prison No 2 with her mother Esma Yılmaz, has oesophageal reflux due to medication given to her. It is stated in the news reports that A. Y. has bronchitis along with asthma and reflux; and that Esma Yılmaz applied to the hospital for health problems of her baby and asked for a medical report however her demand was rejected.

(08/163) Rejection to Meeting Request with Abdullah Öcalan…

It is learned that the appeal made on August 17, 2018 to chief public prosecutor’s office in Bursa by PKK leader Abdullah Öcalan’s sister and brother along with the families of Hamili Yıldırım, Ömer Hayri Konar and Veysel Aktaş in order to visit, was rejected the same day on the grounds of limitations for prisoners in accordance with the Law on the Execution of Criminal and Security Measures Number 5275. With the last rejection, it was the 89th time that appeals for visiting Öcalan have been rejected since September 11, 2016.

(08/164) Coercion to Uniforms and Reactions Against This…

The press declaration of TAYAD (Prisoner’s Families’ Solidarity Association) members attempted to be held in Sakarya Street in Ankara on August 18, 2018 against uniform coercion in prisons is prevented by the police. It is reported that 2 people (Halil İbrahim Şener and Kubilay Iğdır) were detained in police intervention.

(08/165) Police Intervention Against Saturday Mothers’ Protest in Istanbul…

Police intervened into the 700th weekly gathering of Saturday Mothers who rally every Saturday at Galatasaray Square in Istanbul for their relatives who were disappeared under custody, and detained 47 people including Emine Ocak and Maside Ocak, mother and sister of Hasan Ocak, who was one of disappeared people. It is reported that the police committed violence against HDP and CHP MP’s, and choked HDP MP Garo Paylan to intervene. Beyoğlu sub-governorate announced that the protest to be held on August 25, 2018 is banned upon instruction of the Minister of Interior.

It is learned that 47 people who were detained are released the same day after statement procedures.

It is learned that the police broke the arm of Aydın Aydoğan, who has also been wounded during Gezi protests in 2013. Aydın Aydoğan stated the following: “Police turned to me and told ‘Take this jerk’. At that time police intervention started and I felt down. Police hit my arm with a club and broke my arm. Then my friends there tried to take me out of there. While we were leaving the police fired plastic bullets.”

It is learned that, DHA news agency reporter Özgür Deniz Kaya was also wounded by 2 plastic bullets with pepper spray hit him at the leg, while he was interviewing an MP. It is reported that Özgür Deniz Kaya applied to Taksim Research and Education Hospital and had a medical report evidencing the physical violence he was subjected to.

(08/166) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling for a while to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on August 17, 18, 19, 20, 21, 22, 23, 24, 25 and 26, 2018 at 13.30 and 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on August 17, 2018, 3 people (Alev Şahin, Emre Ünlü and 1 more person) and at 18.00 4 people (Acun Karadağ, Alev Şahin, Mahir Kılıç and Emre Ünlü) were detained.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on August 18, 2018, 3 people (Alev Şahin, Emre Ünlü and Gülnaz Bozkurt) and at 18.00 2 people (Emre Ünlü and Gülnaz Bozkurt) were detained.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on August 19, 2018, 3 people (Mehmet Dersulu, Emre Ünlü and Alev Şahin) and at 18.00 2 people (Acun Karadağ and Alev Şahin) were detained.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on August 21, 2018, 4 people (Mehmet Dersulu, Emre Ünlü, Derviş Lermi and Mahmut Konuk) and at 18.00 4 people (Nazan Bozkurt, Derviş Lermi, Gülnaz Bozkurt and Emre Ünlü) were detained.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on August 22, 2018, 4 people (Mahmut Konuk, Mehmet Dersulu, Derviş Lermi and Emre Ünlü) and at 18.00 3 people (Derviş Lermi, Emre Ünlü and Armağan Özbaş) were detained.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on August 23, 2018, 2 people (Derviş Lermi and Gülnaz Bozkurt) and at 18.00 2 people (Derviş Lermi and Acun Karadağ) were detained.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on August 24, 2018, 3 people (Alev Şahin, Nazan Bozkurt and Derviş Lermi) and at 18.00 4 people (Alev Şahin, Derviş Lermi, Nazan Bozkurt and Gülnaz Bozkurt) were detained.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on August 25, 2018, 3 people (Alev Şahin, Nazan Bozkurt and Derviş Lermi) and at 18.00 4 people (Nazan Bozkurt, Alev Şahin, Derviş Lermi and Armağan Özbaş) were detained.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on August 25, 2018, 3 people (Derviş Lermi, Alev Şahin and Nazan Bozkurt) and at 18.00 3 people (Mehmet Dersulu, Alev Şahin and Nazan Bozkurt) were detained.

Thus in total 62 people were detained due to press declaration intended to be held in Yüksel Street on August 17, 18, 19, 20, 21, 22, 23, 24, 25 and 26, 2018. It is learned that detainees were released the same day.

The police intervened the protestors in front of Human Rights Monument Yüksel Street on August 20, 2018, who rally to regain their jobs from which they had been dismissed by state of emergency decrees, and detained Mahmut Konuk. It is learned that Mahmut Konuk was released the same day.

FOSEM reporter Banu Torun, who was detained on August 15, 2018 by the police using physical violence against her in Ankara, where she had been to report on “I Want My Job Back!” protest in Yüksel Street, is arrested by the court on August 18, 2018.

(08/169) Detained Co-Mayor in Adıyaman…

Hüseyin Yuka, co-mayor of Kömür town in central district of Adıyaman, People’s Democratic Party (HDP) Gerger district co-chair Mahmut Özdemir and Hasan Tunç, who were detained on August 16, 2018, after the clash between security forces and HPD militants where 4 soldiers died, are arrested by the court on the charge of ‘aiding and abetting an illegal organisation’ on August 20, 2018.

(08/170) Detained Members and Executives of HDP in Ankara…

8 people including HDP provincial and district executives who were detained in Ankara on August 14, 2018 are released by the court on August 17, 2018, provided that 1 of them on juridical control conditions. It is reported that 8 people were detained because of attending a commemoration of Sakine Cansız in 2017, Kurdish politician who was killed in an attack in Paris. The names of detained and released people are: HDP Ankara executive Mahmut Emin Avcı, HDP Ankara Women’s Assembly Spokesperson İpek Gür, HDP Çankaya district co-chair Ramazan Karakoç, Keçiören district executive Figen Öncü, Altındağ district co-chair Asya Kaya, Peace mothers Kadriye Ozgan and Münibe Koç and Gülhan Akıncı.

Kadir Beştaş, a member of HDP, who was detained on August 15, 2018 in Mersin along with 15 people, and for whom the detention period was extended twice, is arrested by the court on August 21, 2018 on the charge of ‘being an illegal organisation member’. 3 people has been arrested and 11 people including 7 on juridical control conditions were released through the same investigation previously.

(08/172) Detained DBP Executive and Other People in Urfa…

17 people including Democratic Regions Party (DBP) Suruç district executive Nuh Ceyran are detained in house raids in Ceylanpınar, Suruç and Bozova districts of Urfa on August 18 and 20, 2018. The names of detainees known so far are: Mehmet Polat, Nur Ceyran, Salih Dağ, Cuma Demir, Mehmet Tavas, Muhittin Kara, Hasan Kara, Mehmet Kara, Mirkan Kara, Mehmet Çelik, İsa Dökmen, Naci Timurtaş, Fidel Gümüş.

6 of 24 people including DBP Doğubayazıt district co-chair, who were detained in Doğubayazıt, Diyadin, Patnos and Eleşkirt districts of Ağrı on August 15, 2018 are arrested by the court on August 17, 2018. 2 people are released on juridical control conditions. It is learned that 16 people are still under custody and DBP Doğubayazıt district co-chair Fatma Oral is arrested.

5 people, who were detained in house raids in Ankara on August 15 and 16, 2018, on the charge of making propaganda for an illegal organisation on social media posts, are released by the court on August 17, 2018. 2 of them (Mehmet Zeki Altın and Cemil Kaş) are released on juridical control conditions.

(08/175) Detentions and Arrests…

13 people including 2 children, who were detained in Adana on August 14, 2018, are released by the court on August 17, 2018, provided that 3 of them will be under house arrest. The names of released people are: Halit Şaşmaz (house arrest), Barış Aydın, Serhat Tatlı, Salih Filiztek, Mahmut Kaplan, Baver Şahin, Seyir Muhammed (house arrest), Murat Çoban, Yusuf Kaya, Bilal Çelebi, Ramazan Şimşek, Emre Ertuğrul (house arrest) and Baran Gül.

It is learned that 4 people including 2 children who were detained on August 21, 2018 in Şırnak, for grazing their herds in military forbidden zone, are arrested by the court on August 22, 2018 on the charge of ‘aiding and abetting an illegal organisation’. The names of arrested people are: Osman Güngen, Reşit Güngen, İ.G. (16) and M.G. (16).

On August 23, 2018, a person named Osman Kaya is detained in house raids in Damlabaşı village of Güçlükonak district of Şırnak. It is reported that Osman Kaya was taken to Şırnak Gendarmerie Command however the reason for detention is unknown.

It is learned that a person named Yılmaz A. is detained at Hamzabeyi border check point in Edirne on August 25, 2018. It is learned that Yılmaz A., who was claimed to be an executive of Democratic Society Center in Marseille, France, was arrested by the court on August 26, 2018. It is stated in the news reports that Yılmaz A. has come to Turkey on July 18, 2018 for condolence service of his father.

A person named Tarık Ş. is detained for insulting the President in Ereğli district of Zonguldak on August 26, 2018.

(08/177) Former HDP MP on Trial…

Penal Department No 4 of Gaziantep Regional Court reversed the sentence of 7 years and 6 months given to Gülser Yıldırım, former HDP Mardin MP, by Mardin Heavy Penal Court No 3 on the charge of ‘being an illegal organisation member’. It is learned that the case is sent to Mardin Heavy Penal Court No 3 for re-trial.

(08/178) HDP Executive on Trial…

The case against Gülsüm Ağaoğlu, central executive board member of HDP, on Tekirdağ Heavy Penal Court No 3 for a speech she made in Newroz celebration in Ergene district of Tekirdağ on March 21, 2018, is held on August 17, 2018. It is learned that a committee from HDP to monitor the trial was not allowed in the court room for security reasons. Ağaoğlu attended the trial via sound and vision system. After defence hearings the court released Gülsüm Ağaoğlu on juridical control conditions and adjourned the trial to September 1, 2018.

(08/179) HDP Executives and University Students on Trial in Isparta…

The final trial of the case against 21 people (2 provincial executives of HDP and 19 university students) on Isparta Heavy Penal Court No 2 is held on August 17, 2018. During previous trials, Hasan Kılıç, a university student who benefited from effective remorse laws, has stated that his testimony was taken under torture and he refuses the testimony.

Hasan Kılıç has stated the following in his defence: “My previous testimony is false, groundless and invalid; it is the result of torture I was subjected to for days and of being psychologically unhealthy. I refuse the testimony, which I was forced to sign under psychological pressure. They tortured me for days in prison and then took me to the prosecutor’s room, and told ‘whether you sign it be a living death’ and I signed it because I was not thinking in a healthy way”.

The court sentenced 19 people including Hasan Kılıç who clarifies that his testimony was taken under torture to jail penalties differing from 12 years and 10 days to 1 year and 3 months for ‘being an illegal organisation member’, ‘acting on behalf of an illegal organisation’, ‘making propaganda for an illegal organisation’, and ‘carrying guns for crime’. The court acquitted 2 people.

The names of sentenced people are:  Cengiz Akkaya (12 years 10 days); Hasan Kılıç (8 years 1 month 15 days); Firazpir Özbay and Metin Gül (7 years 6 months); Nadir Şin (6 years 10 months 15 days jail sentence and 1000 Turkish Liras fine); Fırat Birer, İsmail Göçeri, Kerem Yalınkaya, Orhan Yılmaz, Razaman Kızıltoprak, Serhat Göze, Seyit Kasım, Yılmaz Ay, Serhat Akpulat, Davut Ermanoğlu and Damla Erdem (6 years 3 months); Hatice Durmuş (1 year 9 months); Ahmet Şen (1 year 5 months 15 days); Şeyhmus Yaklav (1 year 3 months).

(08/180) Detentions and Arrests in Alleged Link to Coup Attempt…

On August 17, 2018 10 people are detained in Istanbul.

2 of 7 people who were detained on August 13, 2018 through a Malatya based investigation are arrested by the court on August 17, 2018. 5 people are released on juridical control conditions.

On August 19, 2018, 4 people including a former police officer who was dismissed by a state of emergency decree, are detained in Edirne in alleged attempt to illegally flee to Greece.

Former deputy governor of Şırnak, A. E., who was detained in Gaziantep is arrested by the court for ‘using ByLock’ on August 19, 2018.

2 people who were detained in Edirne in alleged attempt to illegally flee to Greece are arrested by the court on August 19, 2018.

On August 24, 2018, 5 people including a former police officer and a former teacher who were dismissed by state of emergency decrees, are detained in Edirne in alleged attempt to illegally flee to Greece.

Former deputy governor of Mardin, T. K. E., who was detained in Gaziantep is arrested by the court for ‘using ByLock’ on August 24, 2018.

On August 25, 2018, 5 people are detained in Edirne in alleged attempt to illegally flee to Greece.

(08/181) Trials in Alleged Link to Coup Attempt…

The case against 126 defendants including 1 fugitive, for the incidents at Turkish War Colleges Command in Istanbul during July 15 coup attempt, on Istanbul Heavy Penal Court No 26 is held on August 17, 2018. The court sentenced 35 defendants including major general Selim Mert, army staff college commander and major generals Hasan Nevzat Taşdeler and Recep Yüksel, to heavy life imprisonment and 67 defendants to life imprisonment for ‘attempting to demolish the constitutional order’. The court sentenced 10 defendants to 12 years for ‘being an illegal organisation member’ and acquitted 13 defendants.

The final trial of the case against 17 people including 7 arrestees on Kayseri Heavy Penal Court No 4 is held on August 17, 2018. The court sentenced 17 defendants to jail penalties differing from 5 years to 8 years and 9 months. The court decided to arrest 2 defendants upon the verdict.

The final trial of the case against 28 former teachers who were dismissed by state of emergency decrees on Adana Heavy Penal Court No 2 is held on August 17, 2018. The court sentenced 26 defendants to jail penalties differing from 2 years and 1 month to 7 years and 6 months. The court acquitted 2 defendants and decided to arrest 2 defendants upon the verdict.

The final trial of the case against an arrested person, Abdülsamet Serin, on Adana Heavy Penal Court No 2 is held on August 17, 2018. The court sentenced the defendant to 8 years and 9 months for ‘being an illegal organisation member’.

Ankara Governorate closed down Mutlu Halkevi in Mamak district of Ankara on August 17, 2018 on the grounds of “unpermitted educational activity”. Ankara Governorate has sealed Batıkent, Seyran Umut, Keçiören branches of Halkevleri and Ethem Sarısülük Library in Mamak for the same reason.

Şırnak Governorate made a declaration on August 18, 2018 and announced that 66 areas with given coordinates in Beytüşşebap and Uludere districts are special security zones as of August 18, 2018 to September 1, 2018.

Hakkari Governorate made a declaration on August 18, 2018 and announced that 30 areas with given coordinates in central, Çukurca, Şemdinli and Yüksekova districts are special security zones as of August 22, 2018 to September 5, 2018.
