18 – 20 March 2023 Daily Human Rights Report

(03/161) Refugees Died under Custody in Hatay

It is learned from the news coverage of March 17, 2023 that, 8 Syrian, of which 2 are children, were taken under custody while they were trying to enter Turkey, that they were subjected to torture and other ill treatment at the border post they were taken and that 2 people were killed as a result of torture. It is informed that 6 Syrian were sent back to Syrian and of the 6 Syrians, 2 is being treated at the intense care unit. It is learned that Hatay Reyhanlı Public Prosecutor opened an investigation regarding these deaths, that 6 military personnel detained and of these 6 people 3 were arrested and 3 were released by the court on judicial control condition.

(03/162) Suspicious Death in Hakkari…

It is learned that a person called Kajin Dereli had been found dead in a parked car with a shot on his head in Yükseova district of Hakkari on March 17, 2023.

(03/163) Flood in Adıyaman and Urfa…

As a result of the floods that occurred on March 15, 2023, it was learned that as of March 20, 2023, 19 people, 3 in Adıyaman and 16 in Urfa, lost their lives.

(03/164) Earthquakes in Antep and Maraş…

According to the information recorded by Boğaziçi University Kandilli Observatory and Earthquake Research Institute, on February 6, 2023, an earthquake with a magnitude of 7.7 in Şehitkamil district of Antep which struck at 04:17 local time and an earthquake with a magnitude of 7.5 in Ekinözü district of Maraş which struck at 13:24 local time killed at least 49,589 people as of March 18, 2023.

The Minister of Family and Social Services made a statement on March 20, 2023 and declared that a total of 1,915 unaccompanied children were registered in the system, 1,718 of them were identified and given to their families, 110 children were in the hospital, 85 children were in the institutions of the ministry, and 42 children could not be identified.

(03/165) People Subjected to Physical Violence of Watchmen in Hatay…

It is learned from the news coverage of March 18, 2023, that two people named H. K. and M. K. were subjected to physical violence of watchmen while trying to take their personal belongings from their apartments which were collapsed by the earthquake. It is mentioned that two people got medical reports which testify the physical violence and that 2 people made a complaint about the watchmen.

(03/166) Prosecutions and Detentions for Social Media Posts…

The General Directorate of Security announced that prosecutions were initiated against 745 people and 185 people were detained, 45 people were arrested for their social media posts about the earthquakes in Antep and Maraş, as of March 16, 2023.

(03/167) Torture and Ill-Treatment in Prison…

It is learned from the news coverage of March 17, 2023 that, at Manisa T Type Prison 20 prisoners are held at wards for 8 people and that due to this fact some of the prisoners sleep on floor.

(03/168) Meeting Request with Abdullah Öcalan Not Responded…

It is learned that the appeal made on March 17, 2023 to the chief public prosecutor’s office in Bursa by families and tutelary of PKK leader Abdullah Öcalan, and Ömer Hayri Konar, Hamili Yıldırım and Veysi Aktaş in Imralı Prison, in order to visit them was not responded.

(03/169) Interventions to Newroz Celebrations…

It is learned that people who came to the Newroz Celebration held in İstanbul on March 19, 2023 with traditional clothes were not let in. İt is reported that they were later let in on the grounds that “the instruction has changed.”

Police forces intervened people who are leaving. Governorate of Istanbul announced that 224 people were detained on the grounds that “they were carrying illegal flags and shouting illegal slogans.” It is learned from the news coverage that, there were children and lawyer among people who were detained. 224 people, of which 46 were children, were released on March 20, 2023.

After the Newroz celebration in Mardin on March 19, 2023, police intervened people who march and detained 45 people using physical violence.

Police intervened a group who came to the Newroz Celebration held at İzmir Gündoğdu Square on March 19, 2023 for the flag this group carries. Police detained 3 people using physical violence. 1 person is released on the same day. 2 people are sent to court for ‘making propaganda of an illegal organisation’ on March 20, 2023 and released by the court with a ban on leaving the country

(03/170) Detained HDP Executive in Bursa…

Peoples’ Democratic Party (HDP) Bursa provincial co-chair Mehmet Dilek is detained on March 20, 2023. The reason of the detention was not learnt. İt is learned that Mehmet Dilek was taken to İstanbul and after statement procedures was released on the same day.

(03/171) Journalists Detained in Urfa…

Two journalist, one reporter of Jinnews reporter Gülistan Dursun, who were detained while  covering the justice watch held by Şenyaşar family, is released on March 17, 2023.  Court acquitted the journalists.

(03/172) People Detained in Urfa…

3 people are detained in Viranşehir district of Urfa on March 19,2023. It is learned that 1 person (Özkan İnak) is released on the same day by the court on judicial control condition and 2 people are still under custody.

(03/173) Journalist on Trial in Istanbul…

The final trial of the case against journalist Fırat Fıstık and Gerçek Gündem editor-in-chief back then Ozan Buz, upon the complaint of Mehmet Naci İnci the appointed rector of Boğaziçi University, is held at Istanbul Penal Court of First Instance No. 46 on March 17, 2023. Court acquitted the journalists.

(03/174) Actress on Trial in Uşak…

The final trial of the case against actress Farah Zeynep Abdullah for her social media posts about  Musa Orhan, a specialized sergeant on trial for allegedly sexually assaulting a child, is held at Uşak Banaz Penal Court of First Instance on March 9, 2023. Court fined Farah Zeynep Abdullah 1.300 TL for ‘insulting.’

It is learned from the news coverage of March 17, 2023 that, proceedings demanding lift of impunity of 3 parliamentary members are prepared.

Parliamentary members subjected to proceedings are:

  • HDP İstanbul MP Hüda Kaya
  • HDP İstanbul MP Musa Piroğlu
  • Labor Party of Turkey (TİP) Hatay MP Barış Atay.

It is learned that news reports about delivering of execution files of a firm to the son sonof a former minister published on https://halktv.com.tr, https://www.sozcu.com.tr, https://www.gazeteduvar.com.tr are banned to access on the grounds of violation of personal rights by Ankara Gölbaşı Court of Peace on March 15, 2023.

It is learned that news reports about a statement of gendarme on the earthquake rescue works published on https://artigercek.com is banned to access on the grounds of violation of personal rights by Ankara Penal Court of Peace No. 6 on March 16, 2023.

It is learned that news reports about former minister Berat Albayrak published on https://www.gercekgundem.com, https://www.yenicaggazetesi.com.tr, https://t24.com.tr are banned to access on the grounds of violation of personal rights by Rize Court of Peace on March 17, 2023.

It is learned that news reports about Free Case Party’s (HÜDAPAR) supporting the “Cumhur Alliance” published on https://www.birgun.net, https://diken.com.tr, https://tr.euronews.com, https://www.cumhuriyet.com.tr, https://www.odatv4.com and a social media post are banned to access ruled to be deleted on the grounds of violation of personal rights by İstanbul Court of Peace No. 8 on March 17, 2023.

It is learned that Etkin News Agency’s website https://www.etha50.com is banned to access on the grounds of ‘protection of national security and public order’ by Van Penal Court of Peace No 1 on March 17, 2023.

(03/177) Limitation on Books…

It is learned from the news coverage of March 17, 2023 that the Board of Protection of Minors from Harmful Publications of the Ministry of Family, Labour and Social Services decided that “Head Inspector Nevzat: Whores of the Temple” published by Yapı Kredi Publishing and “Sexing Chery” published by Sel Publishing to be subject to the limitations in Article 4 of Law No. 1117 on the grounds that “they are of a nature to have a harmful effect on the spirituality of those under the age of 18”. According to these limitations, it will be mandatory to print the “Harmful to minors” stamp or sign on the front covers of the books in question, and the books will not be sold in open exhibitions; advertisements or announcements cannot be made in any media and they will not be allowed into schools and similar places.

(03/178) License of Broadcaster Not Extended…

It is learned from the news coverage of March 17, 2023 that the application made by Deutsche Welle to extend its working licence is rejected by the Ministry of Industry and Technology on the ground that “the field of activity is not chosen properly” and that due to this Deutsche Welle’s office in Turkey will be closed.

(03/179) Detentions and Arrests in alleged Link to Coup Attempt…

It is learned that 47 people were detained in operations covering 5 cities through an İzmir based investigation on March 19, 2023.
