It is learned from the news coverage of 16 September 2024 that 2 militants died in a clash between security forces and HPG militants in the Gara area of the Iraqi Kurdistan Regional Government (KRG) on 6 September 2024.

(09/145) Torture and Other Ill-Treatment in Urfa…

It is learned from the news coverage of 16 September 2024 that 1 person was subjected to physical violence by 2 police officers on the street and was detained in the Viranşehir district of Urfa. The name of the person and the reason for detention could not be learned. Viranşehir District Governorate announced that an administrative investigation was initiated against the police officers.

(09/146) Torture and Other Ill-Treatment in Prison…

It is learned from the news coverage of 16 September 2024 that the number of prisoners in Tokat T Type Prison is over capacity and the water supply is cut off at night until morning since the beginning of summer, so prisoners have to meet their needs by collecting water in buckets.

It is learned from the news coverage of 17 September 2024 that prisoners sentenced to heavy life imprisonment in Muğla Bodrum S Type Prison are allowed to ventilate for only one hour a day, cannot use their right to ten hours of social and cultural activities, their room change requests are not accepted, the petitions they wrote about violations in prison were not given a registration number and were not forwarded to the relevant departments, personal notes of prisoners were seized during ward searches, they were prevented from subscribing to magazines and the number of books they could get from the library was limited to five.

According to the news coverage of 17 September 2024, prisoners with urgent and/or chronic health problems in Muğla Bodrum S Type Prison were taken to infirmary late and did not receive adequate treatment in the prison infirmary, some ill prisoners were kept in single rooms despite their chronic health problems, Kutbettin Menteş (60, m) was not given a companion although he had difficulty in meeting his needs on his own after angioplasty operation, and a prisoner named Serbest Akbaş was kept in unhygienic conditions after eye surgery and was not given the medication he needed to use.

It is learned that the appeal made on September 17, 2024, to the chief public prosecutor’s office in Bursa by lawyers in order to visit their clients PKK leader Abdullah Öcalan, Ömer Hayri Konar, Hamili Yıldırım and Veysi Aktaş in İmralı Prison was not responded.

It is learned from the news coverage of 16 September 2024 that a group of people protesting about Palestine during President Recep Tayyip Erdoğan’s speech at a program organised by the Presidency of Religious Affairs in Istanbul on 14 September 2024, were taken out of the hall by security guards.

(09/150) A March Prevented by the Police in Diyarbakır…

It is learned from the news coverage of 16 September 2024 that, the march called by Dicle Amed Women’s Platform and Diyarbakır Network for Struggle Against Violence, from Diyarbakır Courthouse to Dağ Kapı Square on 16 September 2024, to commemorate the second anniversary of the death of Jîna Mahsa Amini in Iran due to torture and ill-treatment of the police, was prevented by police barricades. It is reported that the barricades were opened afterwards and the march was held.

(09/151) Journalists and Another Person on Trial in Istanbul…

The retrial of the case against 3 people including Etkin News Agency (ETHA) editor Semiha Şahin and ETHA reporter Pınar Gayıp, was held at Istanbul Heavy Penal Court No 23 on September 16, 2024. The indictment demands a sentence for 3 people on the charges of ‘being a member of an illegal organization’ and ‘making propaganda for an illegal organization’. The court separated the case against Semiha Şahin on the grounds that there is an ongoing case against her at Istanbul Heavy Penal Court No 13 on the charge of ‘making propaganda for an illegal organization’, merged the case against Pınar Gayıp on the charge of ‘making propaganda for an illegal organization’ with the current case and adjourned the trial to December 4, 2024.

(09/152) Person on Trial in Mersin…

On 16 September 2024, the first trial of the case against 1 person, Oktay Avcu, who was detained on the charge of ‘insulting the President’ with the instruction of the prosecutor’s office after he went to Mersin Courthouse on 24 May 2023 to file a criminal complaint against the President for the videos shown at AKP rallies, and was released on 25 May 2023 on house confinement with judicial control conditions, started at Mersin Penal Court of First Instance No 21. The court ruled to send Oktay Avcu to a hospital for determination of his criminal capacity and adjourned the trial. It is also reported in the news that the judicial control measure of house confinement for Oktay Avcu continued for 9 months starting from 25 May 2023.

(09/153) Person on Trial in Diyarbakır…

It is learned from the news coverage of September 17, 2024, that at the final trial of the case against Satiye Ok, member of Socialist Women’s Assemblies (SKM) Central Executive Board (MYK), at Diyarbakır Heavy Penal Court No 8, the court sentenced Satiye Ok to 6 years and 3 months on the charge of ‘being a member of an illegal organization’.

(09/154) The Constitutional Court Decision on Torture and Ill-Treatment in Prison…

It is learned from the news coverage of 16 September 2024 that, the Constitutional Court (AYM) evaluated the case about a prisoner named Naif Bal being subjected to physical violence by correction officers and ruled that the procedural aspect of the prohibition of treatment incompatible with human dignity was violated on the grounds that the public officers who were accepted to have committed the offense of intentional injury were not punished with a proportionate sanction and that Naif Bal should be paid 25 thousand TL non-pecuniary damages.

Although the medical report that Naif Bal received from the Medical Department of the Penal Execution Institution after the torture and ill-treatment he was subjected to stated that there was a 3-4 cm ecchymotic abrasion on the outer surface of the right eyebrow and that the injury was mild enough to be remedied by simple medical intervention, the disciplinary investigation conducted by the prison administration against the correction officers E. A. and F. B. ruled that there was no ground for disciplinary action on the grounds that there was no evidence other than the allegations of the convicts. Naif Bal was sentenced to 1-year imprisonment for ‘insulting a public officer because of his duty’ and 4 correction officers were sentenced to 100 days judicial fine for ‘simple injury by exceeding the limit in the authority to use force’ and the announcement of the verdict was deferred. After the verdict became final, the Constitutional Court evaluated the individual application of Naif Bal and ruled on 11 September 2019 that ‘the prohibition of treatment incompatible with human dignity was violated’.

It is learned from the news coverage of September 17, 2024, that, through an investigation by Ankara Chief Public Prosecutor’s Office, 29 people were detained in operations covering 19 cities, on the grounds of ‘being a member of an illegal organization’, using Bylock and conducting organization activities for Security Directorate.
