(07/180) State of Emergency Regulations…

It is learned from news coverage of July 16, 2018 that, a law proposal to lift the state of emergency announced on July 20, 2016, will be submitted to the Grand National Assembly of Turkey on July 18, 2018. According to the first article of the law proposal, governors will have “the power of limiting entrance and exit to certain places in the city up to 15 days, in the case that there are serious signs of disturbance or possibility of disturbance of public order and security in a way that would block or interrupt usual course of the life”. According to other articles of the law proposal, objections to arrest and demands of released will be concluded in 90 days; electronic search in personal computers which was dependent on judge’s decision could be carried out by the decision of prosecutors; dismissals from public service will be dependent on particular approval of the ministers who are responsible to the President, dismissals of military personnel will be dependent on the Minister of Defence’s approval, and those who had been dismissed in state of emergency situation and employed back will not have compensation rights; the legal limit for detention for collective crimes will be 4 days and could be extended two times to 12 days, the limit for individual crimes will be 2 days and could be extended twice to 6 days; passports of dismissed public personnel and their spouses could be terminated by the approval of the Minister of Interior for 3 years.

It is learned from news coverage of July 16, 2018 that, 7 militants died in a clash between security forces and HPG militants in rural areas of Bitlis on June 27, 2018; 2 militants died in a clash in rural areas of Kürtün district of Gümüşhane on July 15, 2018.

(07/182) Hunger Strike in Prison…

It is learned from news coverage of July 16, 2018 that Buse, a trans prisoner in Tekirdağ F Type Men’s Prison who has started a hunger strike, demanding gender reassignment surgery, interrupted hunger strike on July 13, 2018, Day 38. It is reported that Buse will restart hunger strike in case reassignment surgery is set back again and not being transferred to a prison in Istanbul.

(07/183) Prevention of MP’s Visit Rights in Prison…

It is learned from news coverage of July 16, 2018 that Eren Erdem, former CHP Istanbul MP who has been arrested and kept in Silivri Prison, is prevented by the Ministry of Justice from being visited by CHP Istanbul MP Mahmut Tanal.

(07/184) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling for a while to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on July 16, 2018 at 13.30 and 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on July 16, 2018, 2 people (Gülnaz Bozkurt and Mehmet Dersulu) and at 18.00 2 people (Gülnaz Bozkurt and Mehmet Dersulu) were detained.

Thus in total 4 people were detained due to press declaration intended to be held in Yüksel Street on July 16, 2018. It is learned that detainees were released the same day.

(07/185) Police Intervention Against Protest of Soma Massacre in Ankara…

The police intervened with pepper gas into the press declaration in front of The Council of Judges and Prosecutors held by families who march from Soma to Ankara, to protest the court decision of July 11, 2018 about the labour killing in a mine in Soma district of Manisa, where 301 miners died, on May 13, 2014. It is reported that the police attempted to detain some of the lawyers supporting the families, after the intervention.

(07/186) Children Wounded Due to Explosive Material in Kütahya…

It is learned from news coverage of July 16, 2018 that, 4 children were wounded due to explosion of a shell which they found in Fire Department’s yard in Tavşanlı district of Kütahya. It is reported that a hand of E. N. (16) is severed, and Ö. F. D. (16), H. Y. (13) and H. G. (9) were wounded due to the explosion. It is learned that Tavşanlı Public Prosecutor’s Office initiated an investigation on the incident.

(07/187) Murdered Child in Diyarbakır…

It is learned from news coverage of July 16, 2018 that, according to the investigation of Diyarbakır Public Prosecutor’s Office on death of Ö. K. (17), the riffle used in the incident has been debited on special task force in order to be used in Afrin operation of Turkish Armed Forces. Ö. K. has been killed by a shotgun near a police vehicle called “Ranger”, in Bağlar district of Diyarbakır on October 4, 2015. Diyarbakır Police Directorate responded to the prosecutor’s office which demanded the shotgun to be sent to criminal laboratory for ballistic examination, as following: “(…) Since it is reported that, the pump riffle coded as 12 Cal Mosberg J 28 1753 is submitted on debit to Special Task Force personnel charged for Zeytin Dalı operation, no examination has been done on the riffle”.

(07/188) Journalist Detained in Izmir…

On July 16, 2018, Hacı Söylemez, reporter of Mezopotamya News Agency, is detained in front of Izmir Forensic Medicine Institution where the funeral of Naci Dayangaç, who was killed in a police operation in Manisa, is taken. It is reported that Hacı Söylemez was taken to Çankaya Anti-Terror Department and was released the same day.

(07/189) People Detained in Izmir…

16 people who were detained in house raids in Menemen, Karabağlar and Konak districts of Izmir on July 10, 2018, are released on juridical control conditions by the court on July 16, 2018.

(07/190) People Detained in Suruç…

It is learned that a person named Mirkelam Akcan is detained in an office raid in Suruç district of Urfa on July 16, 2018. It is reported that Mirkelam Akcan is taken to Suruç District Police Directorate, while the reason for detention is unknown.

It is learned that a person named Mehmet Kayhan, in Suruç district of Urfa, was detained in a house raid, based on a finalised sentence given to him by the court, and then was arrested and sent to Urfa T Type Prison.

(07/191) Journalists on Trial in Istanbul…

The case against 23 people 13 of which are arrested including Etkin News Agency reporters İsminaz Temel and Havva Cuştan, lawyers Özlem Gümüştaş and Sezin Uçar from Law Office of the Oppressed, on Istanbul Heavy Penal Court No 27, started on July 16, 2018. During the trial, the chief judge Abdurrahman Orkun Dağ, learned that he was appointed to the Supreme Court, and thus Halit İçdemir is assigned in replacement of him. It is learned that the trial will be continued on July 17, 2018.

(07/192) Journalist on Trial in Istanbul…

The case against Cumhuriyet newspaper Ankara representative Erdem Gül, for his reports on the ammunition-laden intelligence agency trucks on Istanbul Heavy Penal Court No 14 is held on July 16, 2018. The court acquitted Erdem Gül on the charge of ‘obtaining and disclosing the state’s documents that require to be kept confidential’.

(07/193) Özgür Gündem Case…

The case against Celal Başlangıç, Öncü Akgül, Faruk Eren, Ertuğrul Mavioğlu, İhsan Çaralan, Fehim Işık, Celalettin Can, Ömer Ağın, Veysel Kemer, Dilşah Karakaya, Yüksel Oğuz and former co-editor in chief Hüseyin Aykol, for participating in “Editors-in-Chief on Watch” campaign of Özgür Gündem newspaper which was closed down by the state of emergency decree, on Istanbul Heavy Penal Court No 14 is held on July 16, 2018. After defence hearings the court adjourned the trial to October 10, 2018.

(07/194) DBP Co-chair on Trial…

The case against Mehmet Arslan, co-chair of DBP (Democratic Regions Party), for his declarations on Turkish Armed Forces’ operation to Afrin and for his speeches in several meetings and events, on Diyarbakır Heavy Penal Court No 10, on the charges of ‘being an illegal organisation member’ and ‘making propaganda for an illegal organisation’, is held on July 16, 2018. Mehmet Arslan has been arrested on February 8, 2018. Mehmet Arslan attended the trial via sound and vision system from Rize L Type Prison. The court decided to send the case to the prosecutor for legal opinion and adjourned the trial to September 21, 2018.

(07/195) Detentions and Arrests in Alleged Link to Coup Attempt…

2 of 4 people who were detained through a Samsun based investigation, are arrested by the court on July 16, 2018. 2 people are released provided that 1 of them is on juridical control conditions and 1 on home confinement. 4 people who have been detained earlier through the same investigation were released on juridical control conditions.

On July 16, 2018, 14 people detained in operations covering 9 cities through a Bursa based investigation, and 18 military members on active duty who were detained in operations covering 12 cities through a Zonguldak based investigation are referred to the court.

(07/196) Trials in Alleged Link to Coup Attempt…

The final trial of the case against Y. E., a former court clerk, on Adana Heavy Penal Court No 2 is held on July 16, 2018. The court sentenced Y. E. to 1 year 6 months and 22 days for ‘being an illegal organisation member’. It is learned that Y. E. benefited from effective remorse law.
