(10/191) Prisoner Who Lost His Life in Prison…
It is learned from the news coverage of October 14, 2024, that İbrahim Boğurcu (32, m), a prisoner who was arrested on October 10, 2024, and was kept in Mardin E Type Prison, was referred to a hospital on the grounds of a heart attack, but he was brought back to prison, and he had health problems again and lost his life in the hospital on October 13, 2024.

It is learned from the news coverage of 15 October 2024 that, 2 people (M.B.G. and C.B.) had an accident in the Çiğli district of Izmir due to the police firing at them for disobeying stop warning, and they got wounded. It is reported in the news that 2 wounded people were detained after treatment and an investigation was initiated.

It is learned that the appeal made on October 15, 2024, to the chief public prosecutor’s office in Bursa by lawyers in order to visit their clients PKK leader Abdullah Öcalan, Ömer Hayri Konar, Hamili Yıldırım and Veysi Aktaş in İmralı Prison was not responded.

The police intervened against the march of workers of Fernas Mine, owned by Justice and Development Party (AKP) Batman MP Ferhat Nasırlıoğlu, from Kurtuluş Park in the Çankaya district of Ankara to the Ministry of Energy and Natural Resources on October 14, 2024, as part of their resistance demanding occupational health and safety measures, average wages in the basin and recognition of union rights. It is reported that some workers were injured in the intervention and no one was detained. It is also stated in the news reports that the miners, who were prevented from marching, started a hunger strike in front of the police barricade.

It is learned from the news coverage of 14 October 2024 that, a group of male members of Ülkü Ocakları attempted to attack female students of Mülkiye Women’s Solidarity who were making a statement against femicides at Ankara University Faculty of Political Sciences and chanting ‘jin, jiyan, azadi’ (women, life, freedom) in Kurdish; and that the police intervened in the incident and detained 1 female student who was subjected to the attack. It is reported in the news that the detained female student was released after statement procedures on the same day. The name of the detained person could not be learned.

According to the news coverage of 14 October 2024, the gendarmerie intervened against the villagers protesting against the cutting down of trees for earthquake housing in Yeşiltepe (Gazikale) forest area of Adıyaman and detained 6 people. Detained people were released the same day after statement procedures. The names of the detained people could not be learned.

1 of the 6 people (Osman Demir) who were detained after the rally in Diyarbakır on October 13, 2024, and referred to the criminal peace judgeship on October 14, 2024, with the demand of arrest on the grounds of ‘making propaganda for an illegal organisation’, was arrested, 1 of them (Sezer Çakmak) was released on house confinement and 4 of them were released on judicial control conditions.

The Ministry of Interior announced on 15 October 2024 that 269 people were detained in operations conducted in 36 provinces on the allegations of ‘being a member of an illegal organization’.

On 14 October 2024, Pınar Gayıp, editor of Etkin News Agency (ETHA), who went to Istanbul Fatih Kocamustafapaşa Şehit Sinan Acar Police Station to give her statement through an investigation launched against her for her professional activities, was detained on the grounds of a warrant for her arrest in a different investigation file. The journalist was released by the Criminal Peace Judgeship on the same date.

15 people including journalist Serhildan Andan, board member of Dicle Fırat Journalists’ Association (DFG), who were detained in house raids in Diyarbakır on 11 October 2024 on the grounds of “a denunciation that they would stage demonstrations”, were released after statement procedures at the police on 14 October 2024.

3 members of DEM Party Youth Assembly, including 2 children [A.T. (17, m), Yusuf Mendeş (19, m), and A.Ö. (16)] who were detained on October 10, 2024, in Batman on the allegations of ‘making propaganda for an illegal organization’, were released by the criminal peace judgeship on judicial control conditions on October 14, 2024.

It is learned that Gökhan Genç, life defender and chair of Çifteköprü Village Agricultural Development Cooperative, was detained on October 14, 2024, at Borçka Gendarmerie Station where he went to give his statement through an investigation in Artvin, on the grounds of social media posts. Gökhan Genç was released by the Criminal Peace Judgeship on judicial control conditions on 15 October 2024.

The retrial of the case against Reporters Without Borders (RSF) Turkey Representative Erol Önderoğlu, writer Ahmet Nesin, former chair of Turkish Medical Association (TTB) Central Council and Human Rights Foundation of Turkey (TİHV) board member Prof. Dr. Şebnem Korur Fincancı, for participating in ‘Editor-in-Chief on Watch’ campaign to support Özgür Gündem newspaper which was closed down by a state of emergency decree, was held at Istanbul Heavy Penal Court No 13, after the acquittal verdict of the case at Istanbul Heavy Penal Court No 13 was reversed by Penal Department No 3 of Istanbul Regional Court of Appeals on November 1, 2020. The court adjourned the trial to 30 January 2025.

The first hearing of the case against journalists Esra Solin Dal, Mehmet Aslan and Erdoğan Alayumat for 126 news reports was held on 15 October 2024 at Istanbul Heavy Penal Court No 25. The indictment demands a sentence for the journalists on the charge of ‘being a member of an illegal organization’. After defense hearings, the court decided to wait for the result of another investigation file against Mehmet Aslan and Erdoğan Alayumat on the charge of ‘being a member of an illegal organization’. The court also ruled to lift judicial control measures against 3 journalists and adjourned the trial to 17 February 2025. It is reported that there is a confidentiality order on the new investigation file against Erdoğan Alayumat and Mehmet Aslan.
Esra Solin Dal, Mehmet Aslan and Erdoğan Alayumat were arrested on 26 April 2024 and on 21 May 2024, Istanbul Heavy Penal Court No 25 released the journalists on judicial control conditions.

It is learned that the acquittal verdict of former Interior Minister Mehmet Ağar, İbrahim Şahin, Korkut Eken, Ayhan Çarkın, Ayhan Akça, Ziya Bandırmalıoğlu, Ercan Ersoy, Ahmet Demirel, Ayhan Özkan, Seyfettin Lap, Enver Ulu, Uğur Şahin, Alper Tekdemir, Yusuf Yüksel, Abbas Semih Sueri, Lokman Külünk, Mahmut Yıldırım, Nurettin Güven, Muhsin Korman in the case opened at Ankara Heavy Penal Court No 1 was upheld by Penal Department No 1 of the Court of Cassation.

The trial of the case against 8 people who were detained with torture and ill-treatment during the police intervention against Socialist Labourers’ Party (SEP) members distributing leaflets for election campaigns in Yüksel Street in Ankara on May 4, 2023, was held at Ankara Penal Court of First Instance No 38 on October 14, 2024. The indictment demands a sentence for 8 people on the charges of ‘violating Law No 2911 on Meetings and Demonstrations’ and ‘damaging public property’. After defence hearings, the court adjourned the trial to 27 January 2025.

The final trial of the case against District Security Director Kadir Şen, Deputy Director Ahmet Tuğcu, TEM Branch Chief Ünal Uyar, police officers Mahmut Öztekin and Müslüm Bozkurt, demolition company owner Mahmut Çomoğlu, company employee Arif Kara and Fırat Abdülkerim Sezişli, who allegedly acted as intermediary between police officers and citizens, regarding the robberies and looting incidents during the curfew declared in Nusaybin district of Mardin on 14 March 2016, was held at Mardin Heavy Penal Court No 1 on 15 October 2024. The court sentenced police officers Mahmut Öztekin and Müslüm Bozkurt to 3 years and 4 months each for ‘taking a bribe’, company employee Arif Kara to 3 years and 4 months for ‘giving bribe’, acquitted then District Security Director Kadir Şen, Deputy Director Ahmet Tuğcu, TEM Branch Chief Ünal Uyar and Fırat Abdulkerim Sezişli, and dismissed the charges against Mahmut Çomoğlu due to his death.

It is learned from the news coverage of 14 October 2024 that, Mardin Public Prosecutor’s Office initiated an investigation against journalist Öznur Değer, on the grounds of ‘targeting a public officer involved in the fight against terrorism’ through a news report she made on 16 July 2024 about a law enforcement officer involved in torture, and that the journalist gave her official statement in Diyarbakır through the investigation.
(10/209) Constitutional Court Decision on Sentencing the Person Who Participated in a Protest Action to a Judicial Fine…
It is learned from the news coverage of October 14, 2024, that the Constitutional Court evaluated the individual appeal against the case against M.N.T., who was sentenced to a 6.000 Turkish Liras judicial fine for ‘making propaganda for an illegal organization’ at a protest in Diyarbakır in May 2014, and ruled that M.N.T.’s freedom of expression was violated. It is also reported in the news that the Constitutional Court decided to send a copy of the verdict to Ardahan Heavy Penal Court for retrial.

The Governorate of Şırnak announced on 14 October 2024 that all kinds of open-door meetings and demonstration marches, collective welcome and farewell ceremonies, press statements, sit-ins, rallies, rallies, tents, petition campaigns, opening stands, mass funeral ceremonies and cemetery visits, commemoration ceremonies, festivals, concerts, entertainment, play representations, demonstrations, etc., all kinds of audio and visual activities that can be done with sound broadcasting devices, all kinds of aerial activities such as wishing lanterns-balloons, drone-paramotor, etc., all kinds of aerial activities and distribution of flyers, stickers, brochures, etc., hanging banners and banners, etc., except for commercial activities of private legal entities with commercial identity, are banned for 3 days between 15 October 2024 and 17 October 2024 throughout the province.

It is learned from the news coverage of 15 October 2024 that, Bayraklı Municipality Assembly Member Latif Aydemir, elected from the Justice and Development Party (AKP), who took the floor in the October ordinary meeting of Izmir Metropolitan Municipality Assembly, used the following expressions: ‘I exempt our ladies, our women, but… Some of them, including ladies (and most of the men too), are as guilty of death as those who kill’. AKP Deputy Chair Hamza Dağ made a declaration on 14 October 2024 and announced that Latif Aydemir was referred to discipline with a demand for definite dismissal due to these statements.

(10/213) Report Prevented from Distribution in the Grand National Assembly of Turkey…
It is learned from the news coverage of 15 October 2024 that, the Grand National Assembly of Turkey (TBMM) Administrative Supervisor’s Office, responding to the official letter for the entry and distribution of the ‘Justice Report’ prepared by the Republican People’s Party (CHP) Aydın MP Süleyman Bülbül, decided that it is not appropriate to distribute the report through the TBMM on the grounds that it is ‘not related to party and legislative activities’.
