(10/134) Operations and Attacks…

The Ministry of National Defence announced that 1 soldier (Kürşat Sert) died in a clash between security forces and HPG militants in the rural areas of Çatak district of Van on October 14, 2022.

It is learned from the news coverage of October 14, 2022 that, 4 militants died in clashes between the Turkish Armed Forces units and HPG militants in Zap area of the Iraqi Kurdistan Regional Government on June 11, July 1, July 25 and August 11, 2022.

(10/135) Child Injured by Police Vehicle Crash in Hakkari…

On October 14, 2022, a 17-year-old child (H. A.) was injured after being hit by a police vehicle in Yüksekova district of Hakkari. It is learned that H. A. was first taken to Yüksekova Public Hospital and then admitted to Van Regional Training and Research Hospital.

(10/136) Torture and Ill-Treatment Under Custody in Hakkari…

It is learned that 7 women who were detained by the police intervening the march held in Yüksekova district of Hakkari on October 9, 2022, on the anniversary date of PKK leader Abdullah Öcalan’s being taken out of Syria; were subjected to torture and ill-treatment including strip search.

The Peoples’ Democratic Party (HDP) Hakkari central district co-chair Sinem Seven stated the following to the press: “Despite the cold and rainy weather, we were kept in the detention vehicle for hours with the doors open. Even though we said it was cold, they did not care. The doors were left open on purpose until we were taken to the hospital. Some of our friends were on their periods. We asked for sanitary pads, they were given too late. Hearing this, a policewoman got angry with the other officers and said, “Why did you give it to them, let them do whatever they want” (…) While we were being taken to the detention room, they demanded that all our clothes be taken off for a body search. Even though we said that ‘detailed search’ was a crime, they forced us. I was beaten and threatened and kept in a cold room for hours there because I said I would not accept strip search. While I was taken to the detention room, a police officer walked up to me and said ‘I will break those fingers’ because I was greeting my friends there.”

HDP’s provincial co-chair Hümeyra Armut stated the following: “We were all beaten at the police station and subjected to strip search. When we went to the detention room, even though we asked for a blanket many times due to the cold weather, the blanket was not given. We asked for water for hours, we were not given water (…) Strip search is an insulting practice and we were forced into this practice.”

(10/137) Person Died in Prison…

It is claimed in the news reports on October 14, 2022 that, the body of Süphan Çabuk, a prisoner who was kept in Rize Kalkandere L Type Prison and died in hospital on October 12, 2022; had marks of physical violence and bruises. It is also stated in the news reports that the autopsy report was not given to the family.

It is learned from the news coverage of October 14, 2022 that, Naci Kaya, a prisoner in Edirne F Type Prison, was subjected to physical violence for rejection strip search.

It is learned from the news coverage of October 14, 2022 that, the penalty of prevention from certain activities and from paid work 1 month, which was imposed on 36 prisoners in Diyarbakır Women’s Prison on the grounds of going on a hunger strike, was cancelled by Diyarbakır Court of Execution.

(10/139) Detained Journalists in Konya…

2 journalists (Jinnews reporter Dilan Babat and Mezopotamya News Agency reporter Fırat Can Arslan) were detained by the gendarmerie, as they were reporting on the funeral in Gölyazı village of Cihanbeyli district of Konya on October 13, 2022; held for Jineology Research Center member and Jineology magazine editor Nagihan Akarsel who was shot in Sulaymaniyah in the Iraqi Kurdistan Regional Government on October 3, 2022. Detained journalists are released after statement procedures on the same day.

(10/140) Detained Journalist in Istanbul…

Arti TV reporter Meral Danyıldız, who was covering the news during the demolition of houses on the grounds of urban transformation in Tozkoparan neighbourhood of Güngören district of Istanbul on October 14, 2022, was detained. Meral Danyıldız was released on the same day.

(10/141) Detained Newspaper Distributor and Other People in Diyarbakır…

It is learned that 7 people including a distributor Yeni Yaşam newspaper (Zilan Dağ, Sarya Ertaş, Bedri Çiftkuran, Fermandar Kardeş, Ferit Bademkıran, Mazlum Kardaş, Berdan Çelik) were detained in house raids in Diyarbakır on October 14, 2022. The reason for detention is unknown.

(10/142) Deniz Poyraz Case…

The trial of the case against Onur Gencer, for killing Deniz Poyraz in the armed attack against Izmir office of the Peoples’ Democratic Party (HDP) on June 17, 2021, is held at Izmir Aliağa Şakran Prison Compound on October 14, 2022. The case was opened at Izmir Heavy Penal Court No. 16 and was moved due to security reasons.

The indictment demands heavy life imprisonment and jail sentence up to 7 years for Onur Gencer on the charges of ‘intentional killing’, ‘violation of immunity of residence’ and ‘qualified damage to buildings, premises or moveable property owned or used by a political party, a professional organization having the status of a public institution or a higher federation of such’.

It is learned that the court board ruled to allow only lawyers with power of attorney to the courtroom, and not to allow lawyers with authorization certificates. The gendarmerie intervened with pressurized water, pepper spray and shields against the lawyers and others who wanted to enter the courtroom. It is reported that the lawyers who were taken into the courtroom were not allowed to enter with their computers and mobile phones. It is learned that the court rejected the lawyers’ request for recusation and the trial continued after the lawyers left the courtroom. The court adjourned the trial to December 27, 2022.

(10/143) Former HDP Co-Chair on Trial…

Former HDP co-chair Selahattin Demirtaş was sentenced to 2 years and 6 months on the charge of ‘targeting public officials involved in the fight against terrorism’ and was acquitted on the charge of ‘threat by taking advantage of the power to invoke fear derived from a criminal organisation’ in the case at Ankara Heavy Penal Court No. 25, for his expressions about Ankara Chief Public Prosecutor of the time. The local court’s verdict was overturned by the Penal Chamber No. 21 of Ankara Regional Court of Justice. The retrial of the case is held on October 14, 2022. Selahattin Demirtaş joined the trial via sound and vision system from prison. The court sentenced Selahattin Demirtaş to 2 years and 6 months on the charge of ‘targeting public officials involved in the fight against terrorism’ and acquitted on the charge of ‘threat by taking advantage of the power to invoke fear derived from a criminal organisation’.

The case was opened with the allegation that Selahattin Demirtaş threatened and targeted Yüksel Kocaman, Ankara Chief Public Prosecutor back then, by of his words in his defence at the trial of the case at Ankara Heavy Penal Court No. 19 on January 7, 2020.

(10/144) Journalist on Trial in Istanbul…

The final trial of the case against Gerçek Gündem news portal executive editor Faruk Eren and editor Furkan Karabay, for the news report “The ‘Istanbul’ detail of the ‘Antalya’ operation in the judiciary: What does appointed prosecutors show?”, is held at Istanbul Penal Court of First Instance No. 30 on October 13, 2022. The court sentenced 2 journalists to 2 years and 3 months each on the charge of ‘insulting a public official over their duty’. The court did not postpone the sentences.

(10/145) Person on Trial in Istanbul…

The final trial of the case against a person named Mert Karadağ, for the demonstration to protest the rector appointed to Boğaziçi University by the President, is held at Istanbul Penal Court of First Instance No. 55 on October 13, 2022. The court sentenced Mert Karadağ to 5 months on the charge of ‘violating the Law on Meetings and Demonstrations’.

(10/146) Correction Officers on Trial in Adana…

The trial of the case against 2 correction officers (C. G. and H. A.) on duty in Adana Kürkçüler F Type Prison for the torture against and other ill-treatment of the prisoner named Şehmuz Emen is held at Adana Penal Court of First Instance No. 23 on October 13, 2022. The defendant correction officers did not join the trial. The indictment demands sentence for the correction officers on the charge of ‘excessive use of force’ and ‘injury’. After defence hearings, the court adjourned the trial to December 8, 2022.

(10/147) Proposal to Amend the Press Law…

The Draft Law Amending the Press Law and Some Laws was accepted by the General Assembly of the Grand National Assembly on October 14, 2022. The bill proposes that those who “disseminate false information publicly in a way that may disturb the public peace” will be punished with imprisonment from one year to three years, internet news sites are also included in the scope of periodicals, and the declarations for broadcast ban decisions are submitted to the Press Announcement Agency instead of the Chief Public Prosecutor Offices. It is also stated in the bill that the Press Advertisement Agency would apply to the court “to determine that it does not qualify as a news website” about the websites that do not comply with the publication bans, in case the application to the court is accepted, official announcements rights and press card rights for employees of these websites will be revoked. In addition, the press cards will be issued by a 9-member commission, 2 of which represents the Directorate of Communications, and will be given in five types as duty-bound, temporary, temporary, free and permanent. It is also proposed in the amendment in question, press cards will be given to applicants on the condition that “they have not been convicted of crimes against national defence, crimes against state secrets, espionage crimes and terrorism crimes”.

(10/148) Detentions and Arrests in Alleged Link to Coup Attempt…

It is learned that 6 people are detained in operations covering 4 cities through an Ankara based investigation and 18 people are detained in Edirne in an alleged attempt to illegally flee abroad on October 13, 2022.
