(11/098) Asylum Seekers Died in Ankara…

It is learned from the news coverage of November 10, 2022 that, 5 people who were reported to be Afghan citizens were found stabbed to death in a house in Altındağ district of Ankara.

(11/099) Torture and Ill-Treatment in Prison…

It is learned from the news coverage of November 10, 2022 that, Nagehan Yüksel a prisoner who was transferred from Istanbul Bakırköy Women’s Prison to another prison in Eskişehir was subjected to strip search at the entrance of prison.

It is learned from the news coverage of November 10, 2022 that, the visitors reported by journalists Serdar Altan, Mehmet Ali Ertaş, Ömer Çelik, Zeynel Abidin Bulut and Mazlum Güler who were arrested on June 16, 2022 and were put in Diyarbakır High Security Prisons No. 1 and 2, were removed from the visitors’ list on the grounds of “being objectionable”.

It is learned that the appeal made on November 10, 2022 to chief public prosecutor’s office in Bursa by the lawyers of PKK leader Abdullah Öcalan, in order to visit him was not responded.

(11/101) Detained Person in Mersin…

It is learned that a person named Serhat Erbey was detained in Mersin on November 10, 2022. The reason for detention is unknown.

(11/102) CHP MP on Trial…

The final trial of the case against the Republican People’s Party (CHP) Group Deputy and Sakarya MP Engin Özkoç, upon the complaint of the President is held at Ankara Civil Court of First Instance No. 27 on November 27, 2022. The court sentenced Engin Özkoç to pat a compensation of 30,000 Turkish Liras.

(11/103) Istanbul Metropolitan Mayor on Trial…

The trial of the case against Istanbul Metropolitan Mayor Ekrem İmamoğlu, on the grounds of insulting members of the Supreme Election Committee, after cancellation of election results in Istanbul on March 31, 2019, is held at Istanbul Anadolu Penal Court of First Instance No. 7 on November 11, 2022. The prosecutor declared legal opinion on the case and demanded sentence of 1 year 3 months and 15 days up to 4 years and 1 month for Ekrem İmamoğlu on the charge of ‘successive insult against public officers working as a board’ and political ban. The court rejected the request of Ekrem İmamoğlu’s lawyers that Necati Özkan and Murat Ongun to be heard as witnesses and adjourned the trial to December 14, 2022.

(11/104) Lawyers on Trial in Istanbul…

On September 15, 2020, Penal Department No 16 of the Court of Cassation has approved the verdict of Istanbul Heavy Penal Court No 37 for 17 lawyers, all members of Progressive Lawyers’ Association (ÇHD) and Peoples’ Law Office (HHB); and reversed the verdicts against 2 lawyers (ÇHD chair Selçuk Kozağaçlı and HHB member Barkın Timtik). The court has ruled consolidation of the case against 2 lawyers with another case on Istanbul Heavy Penal Court No 18. The retrial of the case is held between November 7 and 10, 2022.

The court did not permit any lawyers other than 5 lawyers to make any defence or declaration at the trial held on November 10, 2022 and ordered the gendarmerie to empty the courtroom as its decision was objected.

On November 11, 2022, the court declared final verdict and sentenced Özgür Gider, Rahim Yılmaz, Selda Yılmaz, Alper Tunga Saral, Gülbin Aydın, Güray Dağ, Efkan Bolaç, Serhan Arıkanoğlu, Nazan Betül Vangölü Kozağaçlı, Güçlü Sevili and Sevgi Özer Sönmez to 6 years and 3 months each; Oya Aslan to 10 years and 6 months; Selçuk Kozağaçlı and Barkın Timtik to 12 years each on the charge of ‘being an illegal organisation member’. The court sentenced Selçuk Kozağaçlı, Barkın Timtik, Nazan Betül Vangölü Kozağaçlı, Gülbin Aydın, Güçlü Sevimli, Şükriye Erden, Özgür Yılmaz, Naciye Demir, on the charge of ‘making propaganda for an illegal organisation’ and deferred the announcement of the verdict. The court dropped the case against Ebru Timtik who lost her life during the proceedings, and decided to continue detention of Selçuk Kozağaçlı, Barkın Timtik and Oya Aslan.

Istanbul Heavy Penal Court No 37 has sentenced Ayşegül Çağatay, Yağmur Ereren, Didem Baydar Ünsal, Yaprak Türkmen to 3 years and 9 months each and Ahmet Mandacı and Zehra Özdemir to 3 years 1 month and 15 days each, on the charge of ‘knowingly and willingly aiding an illegal organisation’. The local court has separated the cases against Oya Aslan and Günay Dağ; and sentenced Özgür Yılmaz and Ebru Timtik to 13 years and 6 months each; Behiç Aşçı and Şükriye Erden to 12 years each; Engin Gökoğlu, Aytaç Ünsal and Süleyman Gökten to 10 years and 6 months each; Aycan Çiçek and Naciye Demir to 9 years each for ‘being an illegal organisation member’. The Court of Cassation has approved the local court’s verdicts except for 3 lawyers (Barkın Timtik, Selçuk Kozağaçlı and Ezgi Çakır).

Lawyers from the ÇHD and HHB were detained on November 8, 2017 and were arrested on November 13, 2017. The court has released 17 lawyers on September 14, 2018 however, 6 of them (Selçuk Kozağaçlı, Ahmet Mandacı, Aytaç Ünsal, Aycan Çiçek, Engin Gökoğlu and Behiç Aşçı) were arrested again upon prosecutor’s appeal on September 16 and 17, 2018. Oya Aslan was arrested on December 27, 2019.

(11/105) People on Trial in Ankara…

The retrial of the case against 13 students of the Middle East Technical University (METU), for protesting the road construction in the campus forest, is held on November 10, 2022; as the verdicts of Ankara Penal Court of First Instance No. 23 were overturned by the Ankara Regional Court. The court sentenced 13 people to jail sentences from 20 days to 8 months and converted these sentenced to penalty fine.

(10/106) Proceedings Against Parliamentary Members…

It is learned from the news coverage of November 10, 2022 that, 3 proceedings demanding lift of impunity of 3 parliamentary members are submitted to the Grand National Assembly.

Parliamentary members subjected to proceedings are:

  • CHP Mersin MP Ali Mahir Başarır,
  • CHP Ordu MP Seyit Torun
  • CHP Istanbul MP Turan Aydoğan.
