(01/083) Student Subjected to Racist Attack at a University…

It is learned from the news coverage of January 10, 2024, that a student of Iğdır University was physically attacked by people claiming to be nationalists on the campus, on the grounds of wearing a pushi. It is reported that the student was verbally and physically attacked by the same people before, and that no investigation was conducted by the university rectorate although he reported the violations he was subjected to.

It is learned from the news coverage of January 10, 2024, that two students of Ankara University Faculty of Law were attacked in the cafeteria of the school by people claiming to be nationalists.

(01/085) People Detained in Mardin…

On January 11, 2024, gendarmerie conducted house raids in Artuklu and Savur districts of Mardin on the grounds of ‘making propaganda for an illegal organization’ and detained several people. The number and names of detainees are unknown.

(01/086) The Case Regarding Killing of Asylum Seekers in Izmir…

The trial of the case against Kemal Korukmaz, regarding the murder of Syrian asylum seekers Ahmed el Ali, Memnun Nebhan and Muhammed Hüseyin el Abdo by burning in their workplace in Güzelbahçe district of Izmir on November 16, 2021, was held at Izmir Heavy Penal Court No. 1 on January 10, 2024. Presenting his final opinion on the case, the prosecutor demanded 3 times aggravated life imprisonment for the defendant Kemal Korukmaz on the charge of “intentional premediated killing brutally or through torment”. The court adjourned the trial to March 20, 2024.

It is learned that the appeal made on January 11, 2024 to the chief public prosecutor’s office in Bursa by families and tutelary of PKK leader Abdullah Öcalan, and Ömer Hayri Konar, Hamili Yıldırım and Veysi Aktaş in Imralı Prison, to visit them was not responded to.

The hearing of the lawsuit filed against Prof. Dr. Şebnem Korur Fincancı, chair of the Central Council of the Turkish Medical Association (TTB) and board member of the Human Rights Foundation of Turkey (TİHV), by the Ministry of National Defence (MSB) for her statements to a news channel, was held on January 11, 2024, at Ankara Civil Court of First Instance No 2. The court adjourned the hearing to May 7, 2024.

The hearing of the new trial of 15 defendants (Ali Öz, Bekir Yokuş, Faruk Sarı, Gazi Günay, Hasan Durmuşoğlu, Mehmet Ayhan, Mehmet Ali Özkılıç, Muharrem Demirkale, Okan Şimşek, Onur Karakaya, Osman Gülbel, Şükrü Yıldız, Veysal Şahin, Volkan Şahin and Yavuz Karakaya), including former police officers from Trabzon Provincial Police Intelligence Department, regarding the murder of Hrant Dink was held on January 10, 2024, at Istanbul Heavy Penal Court No 14. The court rejected all requests of the Dink family lawyers and adjourned the hearing to March 27, 2024.

The trial of the case against Yeni Yaşam newspaper writer Ahmet Güneş, on the charge of ‘making propaganda for an illegal organization’ through his social media posts, was held at Istanbul Heavy Penal Court No 25 on January 11, 2024. The court acquitted Ahmet Güneş.

The trial of the case against Hüseyin Aykol, Co-Editor-in-Chief and Reyhan Çapan, Managing Editor of Özgür Gündem newspaper, which was closed down by a state of emergency decree, on the charges of ‘insulting the President’ and ‘making propaganda for an illegal organization’ through news reports and columns published in the newspaper, continued on January 11, 2024, at Istanbul Heavy Penal Court No 13. The court adjourned the hearing to April 18, 2024.

(01/092) The Constitutional Court Ruling on Bans of Access…

On 10 January 2024, the Constitutional Court (AYM), which evaluated the applications for the annulment of some articles of Law No. 5651, which authorizes the President of the Information and Communication Technologies Authority (BTK) to impose access blocking and content removal decisions, ruled that the imposition of access blocking and content removal decisions are unconstitutional. In this context, the Constitutional Court decided to annul Article 8/4 of Law No. 5651 on the grounds that it violates the presumption of innocence and Article 9 on the grounds that it is unconstitutional.

(01/093) DEM Party Executive who Lost His Life in Şırnak…

It is learned from the news coverage of January 11, 2024 that, village guard Sıddık Babat, one of the perpetrators of the armed attack in which Peoples’ Equality and Democracy Party (DEM Party) Şenoba district council member and party executive Ahmet Gün lost his life, was arrested on December 29, 2023; and Abubekir Babat was arrested after surrendering on January 5, 2024.

On December 11, 2023, in Şenoba rural area of Şırnak’s Uludere district, 4 people, including village guards, stopped the car of Ahmet Gün, DEM Party’s Şenoba Municipality Council Member and party executive, and his son Abdurrahim Gün, and attacked them with guns. Ahmet Gün was killed and his son Abdurrahim Gün was wounded in the attack. One of the perpetrators of the attack surrendered to the gendarmerie on the same day, while 3 defendants were being sought as part of the investigation launched into the incident.

Şırnak Governorate announced on January 10, 2024 that Gabar Mountain Region within the borders of central and Güçlükonak districts of Şırnak Province has been declared as a temporary special security zone for 15 days between January 11, 2024 and January 25, 2024 and access to the region is banned.

(01/095) Ban of Access to Web Content…

It is learned from the news coverage of January 10 and 11 that Istanbul Criminal Peace Judgeship No 7 ruled on January 8, 2024, to ban access to news reports on www.ifade.org.tr, www.diclefiratgazeteciler.org, https://gercekgazete.com and https://www.iha.com.tr about a former deputy police chief of Istanbul, on the grounds of violation of personal rights, and to delete these news reports.

It is learned that the news reports on www.mynet.com, www.haberler.com and https://www.yurtgazetesi.com.tr about a woman who was subjected to physical violence by the man she was married to while she was broadcasting live on an internet platform are banned to access by a decision dated January 10, 2024.
