(12/114) Student was Attacked in Ankara…

It is learned from the news coverage of December 10, 2019 that, Ulaş Can Taylan Arguç, a student of Ankara University Faculty of Languages History and Geography, was attacked by 3 people and has a cheekbone fracture due to attack. It is reported that Arguç had a medical report evidencing the attack and made an official report to the police.

(12/115) Torture and Ill-Treatment in Prison…

It is learned from the news coverage of December 10, 2019 that, Azim Yacan, co-mayor of Ipekyolu district of Van, who was transferred to Erzurum H Type Prison from Van T Type Prison under coercion on December 2, 2019, was kept in a solitary cell for 3 days there, and then was put into a single ward and his demands to be put in another ward was rejected. Azim Yacan was detained on November 8, 2019 and was arrested on the charges of ‘being an illegal organisation member’ and ‘making propaganda for an illegal organisation’.

(12/116) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling 1127 days to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on December 10, 2019 at 13.30, and at 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on December 10, 2019, 2 people (Acun Karadağ and Mahmut Konuk) and at 18.00 2 people (Acun Karadağ and Nazan Bozkurt) were detained.

Thus in total 4 people were detained due to press declaration intended to be held in Yüksel Street on December 10, 2019. It is learned detained people were released on the same days they were detained.

(12/117) Detained People in Ağrı…

It is learned that 2 people (Maksut Yalçın and Fettah Yalçın) are detained in Ağrı on December 10, 2019. It is reported that 2 people are brothers of Murat Kaya, who was killed after police and gendarmerie operation to Soğukpınar village of Tutak district on December 6, 2019.

(12/118) Çorlu Train Crash Case…

The case against 4 officials of Turkish State Railways (TCDD) about the train crash on July 8, 2018, in Çorlu district of Tekirdağ where 25 people died and 328 people got wounded, is held on Çorlu Heavy Penal Court No 1 on December 10, 2019. 4 officials of TCDD on trial are: Turgut Kurt, railway maintenance manager at TCDD Regional Directorate No 1 Halkalı Railway Maintenance Directorate No 14; Özkan Polat, railway maintenance and repair chief at Çerkezköy Maintenance and Repair, Celaleddin Çabuk, line maintenance and repair official at Railway Maintenance Directorate and Çetin Yıldırım, chief in charge of bridges who has signed the annual inspection report issued on May 2018.

The indictment demands jail sentence from 2 years to 15 years for defendants on the charge of ‘reckless killing and injury’.

It is learned that the chief judge banned journalists from entering the courtroom with computers and lawyers’ appeal to it was rejected by the court board. The court decided to continue judicial control conditions for defendants and adjourned the trial to April 21, 2020.

The case against People’s Democratic Party (HDP) former Mardin MP Gülser Yıldırım and, Davut Bozan, Mesut Amak, Ayşe Bozan, Ercan Güneş, Genco Akman, Abdulkadir Aktaş on Mardin Heavy Penal Court No 2 is held on December 10, 2019. Gülser Yıldırım joined the trial via sound and vision system from Kandıra F Type Prison. The court adjourned the trial to February 18, 2020.

(12/120) People on Trial in Adana…

The final trial of the case against 96 people including People’s Democratic Party (HDP) Hakkari MP and Democratic Society Congress (DTK) co-chair Leyla Güven and journalist Seyithan Akyüz on the charges of ‘being an illegal organisation member’ and ‘making propaganda for an illegal organisation’ is held at Adana Heavy Penal Court No 5 on December 10, 2019. The court acquitted 96 people on the charge of ‘making propaganda for an illegal organisation’; and acquitted 69 people on the charge of ‘being an illegal organisation member’. The court sentenced 27 people including Seyithan Akyüz and Leyla Güven to 6 years and 3 months each for ‘being an illegal organisation member’.

(12/121) Political Party Executives on Trial in Mardin…

The case against DBP provincial co-chairs Leyla Bozkurt and Şeyhmuz Sun, HDP Party Assembly members Alaattin Semir Zuğurli and Sedat Ay, and HDP provincial co-chair Ali Sincar is held at Mardin Heavy Penal Court No 4 on December 10, 2019. The court decided to continue detention of 5 people and adjourned the trial to February 21, 2019.

Those 5 people were detained in house raids in Nusaybin and Kızıltepe districts of Mardin on July 24, 2019 and were arrested on July 30, 2019.

(12/122) The Case Against People Evacuated from Nusaybin…

The case against 70 people who were detained and then arrested on May 26, 2016, after being evacuated from the buildings they were stuck in during the curfew on Nusaybin district, is held on December 10, 2019 on Mardin Heavy Penal Court No 4. The court has decided to separate the case for each defendant and to start proceedings all over again with new case files on April 5, 2019. The court sentenced 1 person (Fırat Çiftçi) to heavy life imprisonment on the charge of ‘disrupting the unity and integrity of the state’ and 29 years 6 months on the charge of ‘attempt to intentional killing’, ‘damage to property’, and ‘possession or exchange of hazardous substances without permission’.

It is learned from the news coverage of December 10, 2019 that the final trial of the case Furkan Sevim, a student of Anadolu University, was held at Eskişehir Heavy Penal Court No 5 on December 3, 2019 and the court sentenced Furkan Sevim to 7 years and 6 months on the charge of ‘being an illegal organisation member’ and to 2 years and 3 months on the charge of ‘making propaganda for an illegal organisation’. It is stated in the news reports that Furkan Sevim was reported to Presidency’s Communication Centre (CIMER) for his social media account and was detained in a house raid in 2018.

(12/124) Non-Prosecution Verdict on Violence Against Parliamentary Member…

It is learned from the news coverage of December 10, 2019 that Batman Public Prosecutor’s Office decided non-prosecution about the investigation on the police intervention to a press declaration on May 13, 2019 in Batman where People’s Democratic Party (HDP) MP Feleknas Uca’s arm was broken. It is reported that Batman Penal Court of Peace No 2 rejected the appeal.

(12/125) Detentions and Arrests in Alleged Link to Coup Attempt…

8 of 13 people who were detained in operations covering 7 cities through an Istanbul based investigation on December 6, 2019, are arrested on December 10, 2019. 5 people are released 4 of which are on judicial control conditions.

On December 10, 2019, 10 people are detained in Ankara through an investigation on ministries of National Education and Family, Labour and Social Services.

Izmir Police Directorate announced on December 10, 2019 that during security checks between 2-8 December 2019, 407 people are detained on warrants and 55 of them are detained through investigations in alleged link to coup attempt.

Ertuğrul Çekin, Spokesman of Ministry of Justice and Strategy Development Department chair announced on December 10, 2019 that 271 of 289 cases in relation to coup attempt have ended.

(12/127) Constitutional Court Decision on Ban on Ill-Treatment…

It is learned from the news coverage of December 10, 2019 that Constitutional Court concluded on individual appeal of Hasan Fırat who got wounded due to rubber bullet used by the police in intervention against people at Berkin Elvan’s funeral on March 12, 2014. Hasan Fırat has got wounded at back, head and leg and has made official complaints against Prime Minister, Minister of Interior, Director of Security, Istanbul Governor and Istanbul Director of Security and against police officers. The court decided that ban on ill-treatment was violated and Hasan Fırat should be paid a compensation of 10.000 Turkish Liras.

(12/128) ECHR Decision on Osman Kavala…

European Court of Human Rights concluded on appeal of Osman Kavala on December 10, 2019. Osman Kavala was arrested on November 1, 2017 and appealed to ECHR on June 8, 2018. ECHR decided that Article 5 (clauses 1 and 4) and Article 8 of The Convention because of arrest on political causes without reasonable doubt and Constitutional Court’s not concluding on the appeal in a reasonable time and ruled immediate acquittal of Osman Kavala.
