(09/058) The Mazlum Turan Case…
The final hearing in the case brought against police officer Süleyman Esenboğa in connection with the death of a child named Mazlum Turan (16, male) in 2015 took place on 9 September 2026 at the Diyarbakır Criminal Chamber of the Diyarbakır Regional Court of Appeal No.1. The court sentenced the defendant police officer to 1 year and 6 months’ imprisonment and a 1-year suspension from duty, and deferred the pronouncement of the sentence.
In 2019, the Mardin Heavy Penal Court No. 1 had sentenced police officer Süleyman Esenboğa to 3 years’ imprisonment for the offence of “causing death through negligence”, but had reduced the sentence to 1 year, 10 months and 15 days by applying “discretionary reduction” and “good behaviour reduction”. Following appeals by the Turan family’s lawyers and the prosecutor, the decision was overturned and police officer Esenboğa was retried at the Mardin Heavy Penal Court No. 5. The court sentenced Esenboğa to 12 years’ imprisonment for the offence of “murder resulting from intentional wounding with a firearm”, before reducing the sentence to 10 years. The Diyarbakır Criminal Chamber of the Diyarbakır Regional Court of Appeal No.1, which assessed Mazlum Turan’s killing as an “unavoidable error”, had ruled that “there were no grounds for imposing a sentence” on Süleyman Esenboğa. Following an appeal against this decision by the Court of Appeal, the First Criminal Chamber of the Court of Cassation overturned the ruling on the grounds that “an error had been made in the assessment of the evidence”.
