(11/096) Torture and Ill-Treatment in Prison…

It is learned from the news coverage of November 9, 2021 that, phone conversation of a prisoner (İlyas Arat) in Balıkesir Bandırma T Type Prison, with his family was interrupted by the correction officers on the grounds that he has his hands in his pockets.

It is learned from the news coverage of November 9, 2021 that, in Izmir Kırıklar F Type Prison No 1, hot and cold water is given to prisoners in limited amounts and hot water is not given regularly.

(11/097) Meeting Request with Abdullah Öcalan Not Responded…

It is learned that the appeal made on November 9, 2021 to chief public prosecutor’s office in Bursa by PKK leader Abdullah Öcalan’s lawyers in order to visit him was not responded.

(11/098) Detained Syrian Journalist in Istanbul…

It is learned from the news coverage of November 9, 2021 that, Syrian journalist Majed Shama, who has been detained and was in a repatriation center in Antep, is released. Majed Shama was detained for reporting on social media videos of Syrian asylum seekers in Turkey.

31 people have been detained in relation to these videos and they have been taken to Istanbul Directorate of Migration Management for deportation.

(11/099) Detained Political Party and Association Executives, and City Council Member in Siirt…

5 people (Solidarity Association of Prisoners’ Families [TUAY-DER] co-chair Haydar Çağlı, Siirt city council member Musa Kurhan, the Peoples’ Democratic Party [HDP] former provincial executives Zeki Çalapkolu and Halil Akın, and Fırat Çakar) who were detained in house raids in Siirt, on the grounds of ‘making propaganda for an illegal organisation’, on November 9, 2021 are released after statement procedures on the same day.

(11/100) Police Officers on Trial in Istanbul…

The first trial of the case against 3 police officers for performing strip search on Mücella Yapıcı and Cansu Yapıcı, who were detained during Gezi Park protests in 2013, is held at Istanbul Heavy Penal Court No 11 on November 9, 2021.

The indictment demands sentence for defendant police officers at least 3 years up to 12 years on the charge of ‘torture’.

Mücella Yapıcı stated the following at the trial: “Harassments first started in the detention vehicle. Especially my young women friends experienced grave things. (…) They made me lift my breasts with hands. They said ‘hunker down’, and ‘cough’. This is torture. (…) They did not give my medications on time. They gave them in the evening although I had to take them once a day.”

Cansu Yapıcı stated the following: “We were detained while we were going to an officially open public park. They said ‘This is nothing yet, we will do many more things to you’ (…) I was in the first ward and there was no female officer. A female officer arrived after 2 or 3 days. We were taken for detailed search. They said ‘Take off your clothes’, and I asked ‘Why?’. They said ‘This is how the things work here. Do not be ashamed’. They took my t-shirt off, and said ‘Your lawyers are informed, this is normal procedure’. They took my underwear off (…) We noticed that there were cameras in the restroom. And it was a great problem to use the restrooms after that. We were not being taken to the women’s restroom. (…) I knew the medication routine of my mother, she has to take some medications once an hour. When we said this, they said ‘Are we your maids?’. Although she had to take her medications once an hour, they just gave them in the mornings and evenings.”

Defendant police officer L. M. joined the trial via sound and vision system. After defence hearings the court decided to issue a warrant for defendant officer S. E. K. and adjourned the trial to February 10, 2022.

(11/101) Istanbul Metropolitan Mayor on Trial…

The first trial of the case against Istanbul Metropolitan Mayor Ekrem İmamoğlu, on the grounds of insulting members of the Supreme Election Committee, is held at Istanbul Anadolu Penal Court of First Instance No 7 on November 9, 2021.

Ekrem İmamoğlu did not join the trial on excuse. The court adjourned the trial to January 2022.

(11/102) Journalists on Trial in Istanbul…

The trial of the case against 4 people including Etkin News Agency editor Semiha Şahin and reporter Pınar Gayıp, on Istanbul Heavy Penal Court No 23 is held on November 9, 2021.

The indictment demands sentence for 4 people on the charge of ‘being an illegal organisation member’. The court adjourned the trial to March 10, 2022.

(11/103) Journalist on Trial in Ankara…

The first trial of the case against Sibel Hürtaş, on the grounds of ‘prevention of public duty by resisting the police’ is held at Ankara Penal Court of First Instance No 37 on November 9, 2021. Sibel Hürtaş was detained by torture and ill-treatment while she was reporting on the bar associations’ protests in Ankara.

Sibel Hürtaş stated the following at the trial: “I am a journalist and I was there to report on the protest. I believe the indictment has the names of the accused and the complainants wrong. I was the one prevented from performing their duty. The police blocked me from performing my public duty as a journalist. I was subjected to torture and ill-treatment during detention and in the detention vehicle. I filed a criminal complaint against the police officer mentioned here. I received a medical report proving that I could not work for 2 days due to violence.”

The court decided to issue a warrant for 3 complainant police officers who did not attend the trial and adjourned the trial to April 12, 2022.

(11/104) Journalist on Trial in Diyarbakır…

The final trial of the case against journalist Ayşe Kara, on the charge of ‘being an illegal organisation member’ is held at Diyarbakır Heavy Penal Court No 5 on November 9, 2021. The court acquitted Ayşe Kara.

(11/105) Journalist and Other People on Trial in Istanbul…

The trial of the case against 34 people including journalist Sadiye Eser is held at Istanbul Heavy Penal Court No 6 on November 9, 2021.

The indictment demands sentence for 34 people on the grounds of ‘being an illegal organisation member’ and ‘making propaganda for an illegal organisation’.

After defence hearings the court adjourned the trial to February 25, 2022.

(11/106) Lawyer on Trial for Social Media Posts in Hatay…

The trial of the case against lawyer Hakan Mazman, on the charge of “insulting the President” in his social media post about July 15 Coup Attempt, is held at Hatay Iskenderun Penal Court of First Instance No 2 on November 9, 2021. After defence hearings the court adjourned the trial to November 30, 2021.

(11/107) Person on Trial in Diyarbakır…

The trial of the case against Makbule Özbek, a 72-year-old Peace Mother, through an investigation against Democratic Society Congress (DTK) is held at Diyarbakır Heavy Penal Court No 8 on November 9, 2021.

Makbule Özbek attended the trial. After defence hearings the court adjourned the trial to December 2, 2021.

(11/108) Police Officer on Trial in Diyarbakır…

Şahin Öner has lost his life after being hit by an armoured police vehicle on February 10, 2013 in Diyarbakır, during protests about anniversary of PKK leader Abdullah Öcalan’s being taken to Turkey. The trial of the case against police officer S. K., driver of the armoured vehicle, on the charge of intentional killing, is held at Diyarbakır Heavy Penal Court No 1 on November 9, 2021.

The prosecutor declared legal opinion on the case and demanded sentence for the defendant police officer at least 2 years up to 6 years on the charge of ‘reckless killing’. The court adjourned the trial to November 23, 2021.

(11/109) Police Officer on Trial in Diyarbakır…

The trial of the case against police officer K. B., for the killing of Recep Hantaş, is held at Diyarbakır Heavy Penal Court No 7 on November 9, 2021. Recep Hantaş was killed by police fire while he was collecting waste paper in Diyarbakır on April 14, 2019.

The indictment demands 18 to 25 years of sentence on the charge of ‘murder with probable intent’ for the police officer.

It is learned that journalists were not allowed in the courtroom by the chief judge’s instruction. Ramazan Yılmaz stated the following in his witness hearing: “I used to collect waste material in the evening with my deceased friend. That day, we finished working, took our carts to the shop and went to the park to eat. The police came and they started to fire as soon as they arrived. We panicked and started to run. I tripped and fell. A police came near me, kick my waist and said ‘Hey chief, this one is alive. What should we do?’, and the chief said ‘Put him in the vehicle’. We were in working clothes, and wearing hoodies and caps since it was cold. But we had no sharp objects, we may be wearing protecting gloves. I do not accept my earlier statement at the police. They threatened me at the police station, they said ‘We will kill you like we did kill your friend’. One of the police officers were wearing black clothes and a cap. One could not recognize them as police officers judging their clothes. And they did not express themselves as police officers while they came to us.” And then police officer S. E. is heard as a witness. The court rejected recusation demand of the complainant lawyers and adjourned the trial to March 31, 2022.

It is learned that the theatre play “Death was Sleeping” which was to be staged at Emir Ali Cultural Center in Fatih district of Istanbul on November 9, 2021, is banned by Fatih Sub-Governorate’s Office on the grounds of public security.

(11/111) Detentions and Arrests in Alleged Link to Coup Attempt…

On November 9, 2021, 35 people are detained in operations covering 25 cities through an Ankara based investigation and 25 people are detained in Izmir.

(11/112) Trials in Alleged Link to Coup Attempt…

The final trial of the case against former brigadier general Serdar Atasoy is held at Ankara Heavy Penal Court No 32 on November 9, 2021. The court sentenced the defendant to 14 years and 2 months on the charges of ‘being an illegal organisation member’ and ‘fraud’.

(11/113) Covid-19 Pandemic…

The Ministry of Health declared that 196 people died due to Covid-19 pandemic and the daily number of Covid-19 cases is 28,662 as of November 9, 2021.

The death toll from Covid-19 in Turkey increased to 72,712 and total number of confirmed ill patients is 8,219,892 as of November 9, 2021.

It is learned that 2 health workers (pharmacist Şerif Soğur in Sakarya and dentist Fazile Sevin Yağcı in Istanbul) lost their lives due to Covid-19 on November 9, 2021.
