(08/018) Torture and Ill-Treatment in Prison…

It is learned from news coverage of August 1, 2018 that prisoners in Bandırma T Type Closed Prison No 2 are suffering from health problems due to the waste of fertilizer factory and of chicken manufacturing plant near the prison compound. It is stated in the news reports that the prisoners sent a letter to Human Rights Association (IHD) and reported that they are forced to stay in an unhealthy environment due to undisposed waste.

(08/019) Legal Complaint About Pregnant Prisoners to Council of Judges and Prosecutors…

It is learned from news coverage of August 1, 2018 that HDP Kocaeli MP and Human Rights Inquiry Committee member Dr. Ömer Faruk Gergerlioğlu submitted a legal complaint to Council of Judges and Prosecutors, about continuation of detention of pregnant prisoners Elif Aydın from Gebze Closed Women’s Prison and Merve Aydeniz Çokyılmaz from Bakırköy Closed Women’s Prison. The complaint demands criminal prosecution and investigation on judges who decided to continue detention and on prosecutors who legally advised as such, on the charges of ‘misconduct’ and ‘false imprisonment’; although the provisions of The Law on the Execution of Sentences and Security Measures No 5275 are clear on this issue.

Konya Heavy Penal Court No 6 has decided to continue detention for Elif Aydın and Istanbul Heavy Penal Court No 30 has decided for Merve Aydeniz Çokyılmaz.

14th clause of Article 16 of The Law on the Execution of Sentences and Security Measures No 5275 states as following: “The execution of the prison sentence against a woman who is pregnant or who gave birth less than six months ago shall be postponed. If the child has died or has been given to someone else, the prison sentence shall begin to be executed two months after the date of birth”.

(08/020) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling for a while to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on August 1, 2018 at 13.30 and 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on August 1, 2018, 2 people (Mahmut Konuk and Gülnaz Bozkurt) and at 18.00 4 people (Gülnaz Bozkurt, Mahir Kılıç, Armağan Özbaş and Bülent Özgül) were detained.

Thus in total 6 people were detained due to press declaration intended to be held in Yüksel Street on August 1, 2018. It is learned that detainees were released the same day.

(08/021) Lawyer Detained in Istanbul…

Can Tombul, a lawyer from Law Office of the Oppressed is detained in Istanbul on July 31, 2018. It is reported that Can Tombul was taken to Istanbul Police Headquarters however the reason for detention is unknown.

(08/022) People Detained in Hakkari…

It is learned from news coverage of August 1, 2018 that 20 people are detained in Büyükçiftlik town of Hakkari’s Yüksekova district on July 31, 2018. It is learned that 20 people are taken to Büyükçiftlik Police Station however, the reason for detention is unknown.

(08/023) DBP Executive Detained in Mersin…

Democratic Regions Party (DBP) provincial executive Doğan Atay, who were detained in a house raid in Mezitli district of Mersin on July 31, 2018, is released by the court on juridical control conditions on August 1, 2018.

(08/024) Journalist on Trial in Istanbul…

The final trial of the case against Oğuz Güven, former editor in chief of Cumhuriyet newspaper’s website, on Istanbul Penal Court of First Instance No 2, for a cartoon he posted on the website, is held on July 31, 2018. The court sentenced Oğuz Güven to 6 months for ‘publicly inciting hatred and hostility’. Cumhuriyet writers Ceyda Karan and Hikmet Çetinkaya have published French humour magazine Charlie Hebdo’s cartoon on prophet Muhammed; and they have been sentenced to 2 years each on April 28, 2016. Oğuz Güven, who was website editor of the newspaper back then, have shared the cartoon while reporting about the trial.

(08/025) ESP Members on Trial in Istanbul…

The first trial of the case against 7 members of Socialist Party of the Oppressed including 6 arrestees, on Istanbul Heavy Penal Court No 36, for marching in Kadıköy district of Istanbul on January 31, 2018 to protest the military operation to Afrin by Turkish Armed Forces, is held on July 31, 2018. After defence hearings the court released 6 of the arrestees. Gökhan Güneş, who was also arrested was not released due to another case against him.

(08/026) High School Students on Trial in Istanbul…

It is learned from news coverage of August 1, 2018 that 2 high school students, Sadettin Köse and Birol Tutuş, who were detained and then arrested on June 5, 2018, on the charges of ‘making propaganda for an illegal organisation’ for writing “There is 1 message from the kettle” and “Hope is HDP” on the walls in Istanbul, are released by the court’s preceding judgment before trial based on monthly inquiry.

(08/027) Constitutional Court’s Decision of Compensation to HDP MP…

It is learned from news coverage of August 1, 2018 that Constitutional Court concluded the individual appeal of HDP Siirt MP Meral Danış Beştaş, on the grounds that she was unlawfully arrested. It is learned that Constitutional Court states that “(…) according to the evidence and documentation, it is concluded that investigating authorities could not present ‘strong indication of committing crime’ adequately in the concrete case. (…) Based on the reasons explained, it should be concluded that, according to 3rd clause of Article 19 of the Constitution, individual freedom and right of security is violated”. With that justification, Constitutional Court decided 20.000 Turkish Liras of immaterial compensation in favour of Meral Danış Beştaş.

Meral Danış Beştaş has been detained on January 28, 2017, for attending People’s Democratic Party’s (HDP) central executive board meeting and the protest against curfews in Sur district of Diyarbakır. Beştaş has been released the same day on juridical control conditions however, she has been arrested once again on January 30, 2017 and was released on April 21, 2017.

On August 1, 2018, Okan O., for whom a detention warrant was issued through a case on Eskişehir Heavy Penal Court No 4, is detained and arrested by the court.

(08/029) Trials in Alleged Link to Coup Attempt…

The final trial of the case against 20 former employees of Turkish Radio and Television, who were dismissed by state of emergency decrees, on Ankara Heavy Penal Court No 23 is held on August 1, 2018. The court sentenced 3 people to 8 years and 9 months each, 1 person to 8 years 1 month and 15 days, 4 people to 7 years and 6 months each and 1 person to 6 years and 3 months for ‘being an illegal organisation member’. The court sentenced 1 defendant who benefited from effective remorse law, to 1 year 6 months and 22 days. The court acquitted 1 person and separated the cases of 9 people.

(08/030) Access Blocked to News Reports on Web…

On August 1, 2018, Bakırköy Penal Court of Peace No 1 decided to block access to the news report of Cumhuriyet, published on March 18, 2017, about public tenders of Bağcılar Municipality which were won by Hasan Turan, an AKP MP of the previous parliament.

On August 1, 2018, Istanbul Penal Court of Peace No 3 decided to block access to several news reports on websites, about Fatih Oflaz, the media boss who was sentenced to 22 years and 6 months for systematic sexual abuse against his daughter.
