12 February Daily Human Rights Report

(02/123) Torture and Ill-Treatment in Prison…

It is learned from the news coverage of February 12, 2019 that, Hüseyin Sürensoy, a prisoner kept in Kırıkkale F Type Prison was double-handcuffed while he was being taken to the hospital. It is stated in the news reports that Hüseyin Sürensoy’s handcuffs were not opened during medial examination, despite of the physician’s demand.

It is learned from the news coverage of February 11, 2019 that, Rıdvan Sayak, a prisoner kept in Kırıkkale F Type Prison was handcuffed behind his back by wardens during a ward search of January 29, 2019 and then his head was hit to the wall. It is reported that although he was bleeding from his nose due to the physical violence, Rıdvan Sayak was then put into a padded cell.

It is learned from the news coverage of February 11, 2019 that, 3 prisoners kept in Izmir Kırıklar F Type Prison No 1 were transferred to different prisons under coercion. It is reported that İbrahim Yağız was transferred to a prison in Kırıkkale and Kenan Ağcı was transferred to a prison in Bolu on January 31, 2019 and Mashar Güler was transferred to a prison in Adana on February 9, 2019.

(02/124) Prevention of Right to Health in Prison…

It is learned from the news coverage of February 11, 2019 that, 4 prisoners (Mesut Canbey, Ramazan Sayan, Nevin Gökçe and Zelal Başboğa) who are on hunger strike in Antalya Alanya L Type Prison were not provided medical examination and were not given vitamin B1.

(02/125) Prevention of HDP’s March…

The march of People’s Democratic Party (HDP) MP’s to support the hunger strike against isolation, which was to be held on Istiklal Street in Beyoğlu district of Istanbul on February 11, 2019 is prevented by the police. Upon prevention, HDP MP’s made a press declaration at Taksim Square.

It is learned that, after press declaration HDP MP’s attempted to march one by one towards Galatasaray Square but the police prevented their march with vests with Leyla Güven’s picture printed on. HDP MP’s made their march on Istiklal Street despite of preventions.

Süleyman Soylu, the Minister of Interior, made a speech on February 10, 2019 and declared, using sexist expressions, that marches and protests to be organized by HDP to support prisoners and Leyla Güven on hunger strike will not be allowed.

(02/126) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling 825 days to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on February 11, 2019 at 13.30 and 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on February 11, 2019, 2 people (Acun Karadağ and Nazan Bozkurt) and at 18.00 2 people (Mehmet Dersulu and Nazan Bozkurt) were detained.

Thus in total 4 people were detained due to press declaration intended to be held in Yüksel Street on February 11, 2019. It is learned that detainees were released the same day.

(02/127) Police Intervention Against a Protest in Ankara…

The police intervened the protestors in front of Çankaya Public Health Directorate on February 11, 2019, who rally to regain their jobs from which they had been dismissed by state of emergency decrees, and detained 2 people (Mahmut Konuk and 1 more person). It is learned that 2 people were released the same day.

(02/128) Proceeding Record Against HDP MP…

It is learned from the news coverage of February 11, 2019 that Diyarbakır Public Prosecutor’s Office submitted summary of records for two proceedings against HDP’s Diyarbakır MP Saliha Aydeniz, on the grounds that she participated in a campaign against isolation of Abdullah Öcalan and in a press declaration to protests detention of HDP members and executives.

(02/129) Publishing House Employees on Trial in Istanbul…

The case against Kasım Zengin, grant holder of Gün Publishing House and 20 of the employees, on Istanbul Heavy Penal Court No 26 is held on February 11, 2019. Gün Publishing House used to publish Özgürlükçü Demokrasi newspaper which was closed down by a state of emergency decree, and was disponed to Saving Deposit Insurance Fund (TMSF). The court decided to release 4 of 9 arrested defendants (Uğur Selman Kelekçiler, Musa Kaya, Mehmet Emin Sümeli and Cemal Tunç) and adjourned the trial to March 11, 2019.

Gün Publishing House was disponed to TMSF on March 28, 2018 and the employees who were detained on the same day were arrested on April 5, 2018. The prosecutor declared the legal opinion at the previous trial and demanded sentence for 12 people on the charge of ‘being an illegal organisation member’ and for 9 people on the charge of ‘knowingly aiding an illegal organisation’.

(02/130) Detained Person for ‘Insulting the President’ in Istanbul…

It is learned from the news coverage of February 11, 2019 that, Ali Şahin (75), was detained on the grounds of ‘insulting the President’, in a coffeehouse in Maltepe district of Istanbul. It is learned that Ali Şahin was referred to the court to be arrested, and he was then released on the condition that he would read and summarize 24 books including “The Birth of a Leader: Recep Tayyip Erdoğan”.

(02/131) Detentions and Arrests in Alleged Link to Coup Attempt…

On February 11, 2019, 20 of 57 people are detained on a warrant issued, in operations covering 14 cities through an Istanbul based investigation; and a former military member is detained on warrant in a house raid in Kırşehir.

8 of 24 people who were detained through an Izmir based investigation are arrested by the court on February 11, 2019. 16 people are released, and 14 of them are on judicial control conditions.

(02/132) Trials in Alleged Link to Coup Attempt…

The final trial of the case against İsmail Ergün, former member of the Supreme Court, is held on Penal Department No 9 of the Supreme Court on February 11, 2019. The court sentenced İsmail Ergün to 7 years and 6 months for ‘being an illegal organisation member’.

(02/133) March 31, 2019 Elections…

It is learned from the news coverage of February 11, 2019 that the electoral campaign house that HDP wanted to open in a tea garden in Batman is prevented by the municipal police.

It is learned from the news coverage of February 11, 2019 that, Cizre District Directorate of Security in Şırnak rejected the application of HDP to open a campaign office on Sanat Street. It is stated in the news reports that the rejection was based on refusal of the sub-governorate. It is also reported that Justice and Development Party (AKP) has a campaign office on the same street.

It is learned that a campaign event of HDP co-mayors in Nusaybin district of Mardin was attempted to be prevented by the police on February 11, 2019. It is stated in the news reports that the police prevented drums played on the grounds that it “disturbs the people” and removed HDP flags around. It is reported that Nusaybin Public Prosecutor’s Office initiated an investigation against 30 members and executives of HDP about the event. It is learned that HDP Nusaybin district co-chair Samiye Demir went to district police headquarters to give official statement.
