(01/115) Prevention of Prisoners’ Right to Health in Prison…

It is claimed in the news reports of January 10, 2019 that, 18 prisoners in Tarsus T Type Closed Prison No 3 who were on hunger strike in turns, got food poisoning due to the meal given by the prison administration at the end of hunger strike. It is also reported that the prisoners were not taken to hospital.

It is learned from the news coverage of January 10, 2019 that Forensic Medicine Institution gave an “available to be kept in prison” report for ill prisoner Meles Tekin (73) in Elazığ Prison, and that Tekin was wanted to be taken into a gallbladder operation in prison and Tekin rejected that. It is also reported that Meles Tekin gets dialysis treatment in prison and her lawyers’ appeal for probation and house confinement were rejected.

It is learned from the news coverage of January 10, 2019 that People’s Democratic Party Diyarbakır MP Dersim Dağ, raised a parliamentary question to Abdulhamit Gül, the Minister of Justice, regarding the physical violence that 3 students od Munzur University were subjected to in Elazığ High Security Prison No 2 where they were taken after being arrested. HDP Youth Assembly council member Cengiz Fidan and, Şeyhmus Bakır and Muhammed Erkiz, were detained after a commemoration organized at the university campus and were arrested on December 22, 2018.

It is learned from the news coverage of January 10, 2019 that Mustafa Geylan, a prisoner kept in Elazığ High Security Prison No 2, were given 15 days of solitary cell penalty for keeping a clipping from Azadiya Welat newspaper and that Ahmet Okkan in the same prison were given 5 days of solitary cell penalty for the books he kept in ward, although the books were approved by the prison administration.

It is learned from the news coverage of January 10, 2019 that Berivan Bitmen, Merve Bolat and Maşallah Erbey, who are on hunger strike in Kayseri Bünyan Prison demanding an end to isolation of PKK leader Abdullah Öcalan, were penalised with prevention of visit rights for 2 months, as a result of disciplinary proceedings against them.

It is learned from the news coverage of January 12, 2019 that Semra Akan and Sabiha Önder, prisoners on hunger strike in Urfa T Type Prison No 2 were not given B1 vitamin by prison administration.

It is learned from the news coverage of January 12, 2019 that Orhan Can, Kemal Yiğit and Murat Budabak, who were transferred from Urfa T Type Prison No 2 to Rize Kalkandere L Type Prison under coercion, were subjected to physical violence of wardens at the entrance of prison for rejecting strip search. It is reported that that Kemal Yiğit was taken to hospital and no news were received of him.

It is learned from the news coverage of January 12, 2019 that Leyla Akyıldız, a prisoner kept in Bakırköy Women’s Closed Prison was referred to Okmeydanı Dental Hospital and was subjected to physical violence of the commander responsible of hospital attendance there, because of rejecting to medical examination in handcuffs.

It is learned from the news coverage of January 12, 2019 that Bahtiyar Kemal Hasan who is on hungers strike since December 16, 2018 in Van High Security Prison, was put into a solitary cell.

It is learned from the news coverage of January 12, 2019 that Ahmet Gerez, a prisoner who was transferred on January 3, 2019 from Oltu T Type Closed Prison to Trabzon Beşikdüzü T Type Closed Prison and who was subjected to physical violence at the entrance of prison was put into a solitary cell.

It is learned from the news coverage of January 10, 2019 that 226 prisoners in 49 prisons are on hunger strike demanding an end to isolation of PKK leader Abdullah Öcalan.

It is also learned from the news coverage of January 12, 2019 that Diyarbakır Medical Chamber applied to the Ministry of Health, to carry out the medical checks of Leyla Güven, HDP Diyarbakır MP and Democratic Society Congress (DTK) co-chair who is on hunger strike.

It is learned from the news coverage of January 10, 2019 that journalist Meltem Oktay, who is kept in Gebze M Type Prison has reported the hunger strike in prison in a letter and the letter was seized by prison administration on the grounds of being “inconvenient”.

(01/119) Rejection to Meeting Request with Abdullah Öcalan…

It is learned that the appeal made on January 10, 2019 to chief public prosecutor’s office in Bursa by PKK leader Abdullah Öcalan’s lawyers in order to visit their client was rejected the same day on the grounds of limitations for prisoners in accordance with the law on the execution of sentences and security measures (law no 5275). With the last rejection, it was the 780th time that appeals for visiting Öcalan have been rejected so far. Abdullah Öcalan has met his lawyers on July 27, 2011 for the last time.

The press declaration of TAYAD (Prisoner’s Families’ Solidarity Association) members attempted to be held in Sakarya Street in Ankara on January 12, 2019 against uniform coercion in prisons is prevented by the police. It is reported that 3 people (Bengisu Demirel, Taylan Sungur and Bülent Özgül) were detained in police intervention.

(01/121) Police Intervention Against Saturday Mothers’ Protest in Istanbul…

Police obstructed all the streets around Galatasaray Square in Istanbul to prevent Saturday Mothers who rally every Saturday for 23 years in the same place to gather for the 720th time on January 12, 2019. Upon police prevention, the group including parliament members, representatives of political parties, human rights defenders and artists along with families of disappeared people gather in front of Human Rights Association (IHD) Istanbul office and started to march. The police prevented the march too, thus, the group had a sit-in protest and made a press declaration there. It is learned that the police prevented the journalists reporting on the press declaration as well.

(01/122) Prevention of Human Rights Defenders’ Event in Istanbul…

 “F sit-in”, which is organized for the 355th time by Human Rights Association (IHD) Istanbul Branch Prisons Committee, to demand release of ill prisoners, on January 12, 2019, is prevented by the police. Human rights defenders who attempt to march to Galatasaray Square from IHD office are prevented by the police and made a press declaration in front of IHD office.

(01/123) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling 796 days to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on January 10, 11, 12, and 13, 2019 at 13.30 and 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on January 10, 2019, 2 people (Derviş Lermi and Nazan Bozkurt) and at 18.00 2 people (Derviş Lermi and Nazan Bozkurt) were detained.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on January 11, 2019, 4 people (Derviş Lermi, Alev Şahin, Acun Karadağ and Nazan Bozkurt) and at 18.00 3 people (Derviş Lermi, Alev Şahin and Nazan Bozkurt) were detained.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on January 12, 2019, 2 people (Derviş Lermi and Nazan Bozkurt) and at 18.00 2 people (Alev Şahin and Nazan Bozkurt) were detained.

Thus in total 19 people were detained due to press declaration intended to be held in Yüksel Street on January 10, 11, 12, and 13, 2019. It is learned that detainees were released the same day.

Türkan Albayrak, who was dismissed from her job at Sarıyer district Health Department, on the grounds of ‘personnel security investigation’ and ‘archive search’, on August 3, 2018; made a press declaration to regain her job on January 10, 2019, and attempted for a sit-in protest in front of Health Department. The police intervened into the sit-in and detained Türkan Albayrak. It is learned that Türkan Albayrak was released the same day. It is the 73rd time of detention of Türkan Albayrak.

On January 10, 2019, the police intervened into the group including HDP MP’s Semra Güzel, Remziye Tosun, Saliha Aydeniz and Musa Farisoğulları, marching to Diyarbakır E Type Closed Prison where HDP Hakkari MP and Democratic Society Congress (DTK) co-chair Leyla Güven is kept. It is reported that the police used clubs and pepper spray to intervene the group and detained 3 people. The names of detainees are unknown.

The police used physical violence to intervene the march of the group including HDP and Democratic Regions Party (DBP) executives to Diyarbakır E Type Closed Prison on January 12, 2019. It is reported that nobody was detained.

(01/126) Police Intervention Against a Protest in Batman…

On January 13, 2019 the police used physical violence to intervene into the march of the group including HDP Batman co-chair Berivan Helen Işık, DBP Batman co-chair Şükrü Tapkan, and HDP’s Batman co-mayor candidates Sabri Özdemir and Songül Korkmaz, to protest isolation of Abdullah Öcalan. Sabri Özdemir is detained by police intervention. It is learned that Sabri Özdemir was released after statement procedures at the police on the same day.

The police intervened into HDP Youth Assembly members who celebrate Serê Salê, new year according to the Julian calendar, in Sur district of Diyarbakır on January 13, 2019; and detained 8 people by physical violence. The names of detainees are: HDP Sur district co-chair Sevim Coşkun, HDP Youth Assembly members Canan Oğul, Havva Bilbik, Mustafa Suat Şenci, Şefika Yürük, Berxwedan Yeni, Murat Kılıç and Mustafa Şimşek. It is learned that detained people were taken to Diyarbakır Police Headquarters.

Police prevented on the grounds of governorate’s interdict the protest of We Want to Live Initiative who rally on 11st day of every month against femicide, abuse and rape, to be hold for the 37th time on January 11, 2019 in Kadıköy district of Istanbul.

(01/129) Police Intervention Against Workers’ Protest in Izmir…

The police used clubs and pepper spray to intervene into the protest in front of Izmir Metropolitan Municipality on January 11, 2019, organized by General Service Workers’ Union (Genel-İş) members employed by İZENERJİ company of Izmir Metropolitan Municipality, regarding their collective agreement. It is reported that several workers got injured due to police violence. 15 people including union managers and shop stewards are detained by the police.

The police intervened the protest of Okmeydanı Research and Education Hospital construction workers for not receiving their wages, which was to be held in front of the contractor Taş Yapı company on January 10, 2019. 4 workers are detained in police intervention. HDP Party Assembly members Bedriye Yorgun and İzzet Karadağ who were detained in Antalya on January 7, 2019, are referred to the court on January 10, 2019. İzzet Karadağ is arrested on the charge of ‘being an illegal organisation member’, Bedriye Yorgun is released on judicial control conditions.

Musician Ferhat Tunç is detained at Istanbul Atatürk Airport, on January 12, 2019, upon arriving there from Germany. It is learned that the reason of detention is a warrant issued through a Diyarbakır based investigation.

(01/141) Assaulted Trans Woman in Antalya by a Watchmen…

It is learned that a trans woman (name unknown) is assaulted by watchmen in Antalya on January 13, 2019 and was forcefully taken to a police station. It is also learned that the watchmen who attempted to fine the woman and then took her to the police station forcefully upon her rejection; and that the woman passed out at the police station due to being hit at the head and was taken to hospital.

HDP Urfa co-chair Aliye Kızıldamar, who went to the prosecutor’s office on January 12, 2019 to give official statement through an investigation opened for a speech she made at HDP Urfa office on December 6, 2018; is arrested by the court on the same day on the charge of ‘being an illegal organisation member’.

(01/143) The Cases Against Academics Who Are the Signatories of the Petition “We will not be a party to this crime!”…

The case against Professor Erdağ Aksel from Sabancı University for signing the petition “We will not be a party to this crime!” on Istanbul Heavy Penal Court No 24 for ‘making propaganda for an illegal organisation’ are held on January 11, 2019. The court decided to consolidation of the case with other cases against academicians and adjourned the trial to April 25, 2019.

The case against Assist. Professor Ali Alper Akyüz from Bilgi University for the same reason on Istanbul Heavy Penal Court No 25 is held on January 11, 2019. The court adjourned the trial to January 17, 2019.

The separate cases against 5 academicians (research assistants Kumru Çılgın and Yasin Barış Göğüş and Professor Ayşe Aslı Berkman from Mimar Sinan Fine Arts University; PhD student Dilek Çankaya and retired lecturer Saadet Sorgulu from Ankara University) for the same reason on Istanbul Heavy Penal Court No 36 is held on January 11, 2019. The court adjourned all trials to April 2, 2019.

The case against journalist Rojhat Doğru on Diyarbakır Heavy Penal Court No 8 on the charge of “disrupting the unity and integrity of the state” and “intentional injury” is held on January 10, 2019. Rojhat Doğru joined the trial via sound and vision system. The court decided to continue detention of Rojhat Doğru and adjourned the trial.

The case against journalist Kibriye Evren on Diyarbakır Heavy Penal Court is held on January 11, 2019. The court decided to continue detention of Kibriye Evren and adjourned the trial.

Kibriye Evren was detained and arrested on October 9, 2019 through an operation in Diyarbakır where 142 people were detained.

The final trial of the case against writer Perihan Mağden, journalists Tunca Öğreten, Orhan Şahin and Mehmet Çağlar Tekin, on the charge of “insulting the President” is held on Istanbul Penal Court of First Instance No 2 on January 10, 2019. The court fined Perihan Mağden and Tunca Öğreten 7.000 Turkish Liras each and acquitted Orhan Şahin and Mehmet Çağlar Tekin.

The journal Nokta was issued on September 2015 with the “Erdoğan Selfie” cover and was banned; Tunca Öğreten, editor of diken.com.tr web portal back then, interviewed Perihan Mağden on September 14, 2015, and the interview was published on Yurt newspaper. Perihan Mağden, Tunca Öğreten, and Orhan Şahin and Mehmet Çağlar Tekin, executives of Yurt newspaper back then were charged with “insulting the President”.

The case known as “KCK Press Case” against 46 journalists on Istanbul Heavy Penal Court No 3 is held on January 11, 2019. The court decided to ask the result of the case on Istanbul Penal Court of First Instance No 26 against the security officials who carried on the investigation against journalists, and adjourned the trial to May 9, 2019.

The case against HDP Urfa MP Ayşe Sürücü, on the charge of “making propaganda for an illegal organisation” for a talk she attended in 2016 is held on Urfa Heavy Penal Court No 5 on January 11, 2019. The court adjourned the trial to March 25, 2019 and decided to forcefully bring Ayşe Sürücü to the next trial.

(01/149) People on Trial in Istanbul for Supporting 3rd Airport Construction Workers…

The case against 26 people, who were detained and then released for the solidarity rally in Kadıköy district of Istanbul on September 15, 2018, to support workers of Istanbul’s 3rd airport construction, who went on a strike action to protest poor working conditions; started to be held on Istanbul Penal Court of First Instance No 32 on January 11, 2019. Defendants stated that they were subjected to physical violence and handcuffed behind their backs during detention. After defence hearings the court adjourned the trial to May 23, 2019.

The case against Alparslan Kuytul, founder of Furkan Research and Service Foundation and executives Mahfuz Ç. and Gökhan Y. on the charge of “knowingly aiding an illegal organisation but not being a member” is held on Adana Heavy Penal Court No 11 on January 10, 2019. The court rejected the demand of general Directorate for Foundations to take part in the trials and adjourned the trial.

It is learned from the news coverage of January 10, 2019 that “Azizname” play of Cumhuriyet Theatre Company which was planned to be performed at Serdivan Municipality Cultural Center on January 20, 2019, is cancelled by the municipality.

Concert organization of Akdeniz Art Workshop with musicians Pınar Aydınlar and Serhat Çarnewa which was to be held on January 12, 2019 at Yenişehir Atatürk Cultural Center in Mersin is prevented by Mersin Governorate on the grounds of “lack of permission application” on January 11, 2019.

(01/153) Detentions and Arrests in Alleged Link to Coup Attempt…

On January 10, 2019, Kuşadası district Gendarmerie Commander M.Ş. is detained in Aydın; 20 military members on active duty are detained in operations covering 17 cities through a Yalova based investigation; and 12 military members on active duty are detained in operations covering 3 cities through a Konya based investigation.

İsmail Çolak, a fugitive defendant of the case on Düzce Heavy Penal Court No 2 against executives and members of Düzce Industrialists’ and Businessmen’s Association (DÜSİAD) which was closed down by a state of emergency decree, came to Turkey from Poland to turn himself in and is arrested by the court on January 11, 2019.

On January 11, 2019, 30 military members on active duty are detained in operations covering 20 cities through an Adana based investigation; 18 people including military members on active duty are detained in operations covering 18 cities through a Bursa based investigation; 33 people are detained in Izmir; 5 people are detained in Çorum; and 21 people are detained in Istanbul.

5 of 14 people who were detained on January 9, 2019 in Bursa are arrested by the court on January 12, 2019. 9 people are released on judicial control conditions.

On January 10, 2019, The Council of Judges and Prosecutors (HSK) dismissed 17 prosecutors and judges. Yakup Tatlı and Tuba Şule Kızıltoprak, 2 of dismissed judges are detained in Antep and then arrested by the court on January 12, 2019. It is learned that the investigation on other 15 judges and prosecutors are still in process.

The final trial of the case against 27 arrested defendants on Zonguldak Heavy Penal Court No 2 is held on January 11, 2019. The court sentenced 26 people to jail penalties differing from 7 years and 6 months to 12 years and 6 months. The court acquitted 1 person.

It is learned from the news coverage of January 11, 2019 that, Istanbul Public Prosecutor’s Office initiated an investigation against Conscientious Objection Association (VR-DER), for posts on official website and social media accounts. It is reported that the investigation is based on the grounds of “provocative posts intending not to do military service”.
