(02/046) Hunger Strike in Prison…

It is learned from the news coverage of February 5, 2019 that, 291 prisoners in total are on indefinite hunger strike demanding an end to isolation of PKK leader Abdullah Öcalan.

It is learned from the news coverage of February 5, 2019 that Eren Erdem, Republican People’s Party (CHP) Party Assembly member and former MP, ended the hunger strike he started on January 29, 2019.

(02/048) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling 819 days to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on February 5, 2019 at 13.30 and 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on February 5, 2019, 2 people (Mehmet Dersulu and Mahmut Konuk) and at 18.00 2 people (Mehmet Dersulu and Nazan Bozkurt) were detained.

Thus in total 4 people were detained due to press declaration intended to be held in Yüksel Street on February 5, 2019. It is learned that detainees were released the same day.

(02/049) Police Intervention Against a Protest in Istanbul…

Türkan Albayrak, who was dismissed from her job at Sarıyer district Health Department, on the grounds of ‘personnel security investigation’ and ‘archive search’, on August 3, 2018; made a press declaration to regain her job on February 5, 2019, and attempted for a sit-in protest in front of Health Department. The police intervened into the sit-in and detained Türkan Albayrak. It is learned that Türkan Albayrak was released the same day. It is the 81st time of detention of Türkan Albayrak.

(02/050) Police Intervention Against High-School Students’ Protest in Istanbul…

The police intervened into the high school students, making a press declaration on February 5, 2019 in Kadıköy district of Istanbul, to protest the agreement of Antalya Provincial Directorate of National Education with Ensar Foundation, and detained 7 people by using physical violence. It is learned that detained people are released after statement procedures at the police on the same day.

(02/051) The Cases Against Academics Who Are the Signatories of the Petition “We will not be a party to this crime!”…

The separate cases against 4 academicians (Assoc. Professor İnci Özkan Kerestecioğlu, PhD Biriz Berksoy, Professor Tülay Erkan from Istanbul University and Assist. Professor Canay Şahin from Yıldız Technical University) for signing the petition “We will not be a party to this crime!” on Istanbul Heavy Penal Court No 36 for ‘making propaganda for an illegal organisation’ are held on February 5, 2019. The court sentenced Canay Şahin, Biriz Berksoy and İnci Özkan Kerestecioğlu to 1 year and 3 months each for ‘making propaganda for an illegal organisation’ and deferred the announcement of the verdict. The court adjourned the trial of the case against Tülay Erkan to April 25, 2019.

The case against Assoc. Professor Şükrü Aslan from Mimar Sinan Fine Arts University for the same reason on Istanbul Heavy Penal Court No 24 is held on February 5, 2019. The court adjourned the trial to May 21, 2019.

The separate cases against 2 academicians (Assoc. Professor Aslı Davas from Ege University and Professor Turgay Kurultay from Yaşar University) for the same reason on Istanbul Heavy Penal Court No 26 are held on February 5, 2019. The court rejected the demand for lack of venue decision for both cases and adjourned both cases against Aslı Davas and Turgay Kurultay.

The case against Research Assistant Ferhat Yılmaz from Artuklu University for the same reason on Istanbul Heavy Penal Court No 27 is held on February 5, 2019. The court adjourned the trial to May 7, 2019.

The case against Assist. Professor Taylan Koç, dismissed from Çukurova University for the same reason on Istanbul Heavy Penal Court No 23 is held on February 5, 2019. The court rejected the demand for lack of venue decision and consolidated the case with other cases against academicians.

The case against Professor S.S. from Boğaziçi University for the same reason on Istanbul Heavy Penal Court No 37 is held on February 5, 2019. The prosecutor declared the legal opinion on the case and demanded sentence for S.S., on the charge of ‘making propaganda for an illegal organisation’. The court adjourned the trial to February 27, 2019.

(02/052) Lawyer on Trial in Istanbul…

The first trial of the case against Can Tombul, a lawyer from Law Office of the Oppressed, on Istanbul Heavy Penal Court No 35 is held on February 5, 2019. The indictment demands sentence for Can Tombul on the charge of ‘being an illegal organisation member’.  Can Tombul attended the trial to make defence. After defence hearings the court decided to continue detention for Can Tombul and adjourned the trial to April 18, 2019.

Can Tombul was detained in Istanbul on July 31, 2018 and was arrested by the court on August 3, 2018.

(02/053) Suruç Massacre Case…

The case against 2 police officers Ali Koçak and Ahmet Oğuz Davarcı, on the charge of ‘misuse of public duty and misconduct’, about the massacre in Suruç where 33 people died on July 20, 2015, continued to be held on Suruç Penal Court of First Instance on February 5, 2019. The court accepted the involvement demand of families of people who died on October 10, Ankara massacre and adjourned the trial to July 12, 2019.

(02/054) Master Sergeant on Trial for Death of Soldier Gökhan Kılıç…

Gökhan Kılıç, who was on compulsory military service in Military Veterinary Medicine School in Gemlik district of Bursa, had a cerebral haemorrhage due to being hit by a helmet several times at his head, and has died in hospital on November 29, 2017.

The case against master sergeant Osman Hancı, for causing death of Gökhan Kılıç by hitting at his head by helmet, on Bursa Heavy Penal Court No 1, is held on February 5, 2019. The court sentenced Osman Hancı to 10 years for ‘causing death by intentional injury’ and then reduced the sentence to 8 years and 4 months based on good behaviour.

(02/055) The Constitutional Court Decision on Torture Allegation…

Adem Erdem, a prisoner kept in Izmir F Type Prison No 2, was subjected to torture and ill-treatment of the wardens on August 13, 2005, on the grounds of not participating the roll-call. Marks of violence and 22 cigarette burns on his body were identified by the medical examination of Adem Erdem. A case was opened against wardens S. E., M. S., K. K., T. K. and Ş. A. on Izmir Heavy Penal Court No 5, and all wardens were acquitted on December 20, 2006. The Supreme Court has approved acquittal of S.E. and M.S. on December 8, 2011; and reversed the verdict for K.K., T.K., and Ş.A., on the grounds of incomplete investigation. The court, making a re-trial, sentenced these 3 defendants to 2 years and 6 months according to Article 94 of Turkish Penal Code and banned the defendants from public duty for 1 years and 3 months.

Adem Erdem’s individual application to the Constitutional Court is concluded on February 5, 2019. The Constitutional Court stated that, although it does not assume a complicated appearance, 13 years of legal proceeding is not a plausible delay and that “with respect to prevent the appearance as if ill-treatment of public officials was treated with indifference, the legal proceedings were not conducted with adequate rapidity and attention which restrains an efficient legal reaction” and decided that Adem Erdem will be paid 18.000 Turkish Liras as immaterial damages.

The case against Safiye Alağaş, news director of Jinnews, on Diyarbakır Heavy Penal Court No 4 is held on February 5, 2019. The indictment demands sentence for Safiye Alağaş on the charge of ‘making propaganda for an illegal organisation’, for the news reports published on the portal. After defence hearings the court adjourned the trial to May 23, 2019.

(02/057) Journalist on Trial in Diyarbakır…

The final trial of the case against journalist Sertaç Kayar, on the charge of ‘making propaganda for an illegal organisation’ on social media posts, is held on Diyarbakır Heavy Penal Court No 4 on February 5, 2019. The court acquitted Sertaç Kayar.

(02/058) Person on Trial for ‘Insulting the President’ in Eskişehir…

The final trial of the case against a person named Sinan N., on the charge of ‘insulting the President’ is held on Eskişehir Penal Court of First Instance on February 5, 2019. The court sentenced Sinan N. to 1 year and 2 months and deferred the announcement of the verdict.

(02/059) Detentions and Arrests in Alleged Link to Coup Attempt…

On February 5, 2019, 14 people including military members on active duty are detained in operations covering 10 cities through an Izmir based investigation; 32 people including military members on active duty are detained in operations covering 20 cities through a Bursa based investigation.

(02/060) Trials in Alleged Link to Coup Attempt…

The final trial of the case against Esabil Saylak, former member of the Supreme Court, is held on Penal Department No 9 of the Supreme Court on February 5, 2019. The court sentenced the defendant to 8 years and 9 months for ‘being an illegal organisation member’ and decided to continue detention for Esabil Saylak.

The final trial of the case against Sedat Caner, former doctor of former president Abdullah Gül, and former Director of Health at Presidency, is held on Ankara Heavy Penal Court No 4 on February 5, 2019. The court sentenced the defendant to 7 years and 6 months for ‘being an illegal organisation member’ and released the defendant on judicial control conditions.

(02/061) March 31, 2019 Elections…

It is learned that the police used gas bombs to intervene the campaign office opening of People’s Democratic Party (HDP) in Ceylanpınar district of Urfa on February 5, 2019; the reason of police intervention was the speech of Narin Gezgör, co-mayor candidate of HDP, which referred to the isolation of PKK leader Abdullah Öcalan. It is reported that Narin Gezgör was detained and was taken to Urfa Police Headquarters.

(02/062) Curfew in Lice…

Diyarbakır Governorate made a declaration on February 5, 2019 and announced curfew in 6 villages of Lice district as of 06.00 on February 5, 2019 until a further notice. Diyarbakır Governorate made another declaration on the same day and lifted the curfew as of 24.00. The villages where curfew was announced and lifted are: Çıralı, Kıyıköy, Dallıca, Kutlu, Oyuklu and Türeli.

(02/063) Curfew in Kulp…

Diyarbakır Governorate made a declaration on February 5, 2019 and announced curfew in 11 villages of Kulp district as of 06.00 on February 5, 2019 until a further notice. Diyarbakır Governorate made another declaration on the same day and lifted the curfew as of 24.00. The villages where curfew was announced and lifted are: Karaağaç, Kamışlı, Çukurca, Demirli, Bayırköy, Bağcılar, Akbulak, Düzce, Temren, Uygur and Taşköprü.
