(01/026) Prevention of Right to Health in Prison…

It is learned from the news coverage of January 3, 2019 that prisoners in Kayseri Bünyan T Type Prison No 2 were referred to hospitals with a delay of 4 months, and that prisoners were forced to be medically examined in handcuffs.

(01/027) Torture and Ill-Treatment in Prison…

It is learned from the news coverage of January 3, 2019 that 3 prisoners in Bandırma T Type Prison No 1 were subjected to physical violence of wardens. It is also stated in the news reports that prisoners were prevented from right to health and social, cultural and sportive activities.

It is learned from the news coverage of January 3, 2019 that Hamdullah Aydemir, a prisoner transferred from Samsun Bafra T Type Prison to Diyarbakır T Type Prison No 1, was subjected to physical violence of wardens because of rejecting strip search at Elazığ T Type Prison No 1, where he was kept for a night during the transfer. Hamdullah Aydemir stated the following in the news reports: “They gave me a basket and wanted me to undress in two minutes. When I did not undress and reject to strip search they forced me. And they said ‘One should not give bread to people like you. One should blow your brains out and throw away’, and cursed me and then attacked and beat me. And then dragged me to a room without surveillance cameras and swooped down on me altogether. They systematically beat me there until the next morning.” It is reported that Hamdullah Aydemir took a medical report in Diyarbakır that evidences the physical violence and made an official complaint.

It is learned from the news coverage of January 3, 2019 that prisoners in Kayseri Bünyan T Type Prison No 2 were prevented from right of communication and social and cultural activities.

(01/028) Rejection to Meeting Request with Abdullah Öcalan…

It is learned that the appeal made on January 3, 2019 to chief public prosecutor’s office in Bursa by PKK leader Abdullah Öcalan’s lawyers in order to visit their client was rejected the same day on the grounds of limitations for prisoners in accordance with the law on the execution of sentences and security measures (law no 5275). With the last rejection, it was the 778th time that appeals for visiting Öcalan have been rejected so far. Abdullah Öcalan has met his lawyers on July 27, 2011 for the last time.

(01/029) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling 786 days to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on January 3, 2019 at 13.30, and detained 2 people (Gülnaz Bozkurt and Nazan Bozkurt). It is learned that detainees were released the same day.

(01/030) Police Intervention Against a Protest in Istanbul…

Türkan Albayrak, who was dismissed from her job at Sarıyer district Health Department, on the grounds of ‘personnel security investigation’ and ‘archive search’, on August 3, 2018; made a press declaration to regain her job on January 3, 2019, and attempted for a sit-in protest in front of Health Department. The police intervened into the sit-in and detained Türkan Albayrak. It is learned that Türkan Albayrak was released the same day. It is the 69th time of detention of Türkan Albayrak.

(01/031) Detained Executive and Member of HPD in Adana…

People’s Democratic Party (HDP) Party Assembly member Abdulselam Demirkıran and HDP member Uğur Bayrak, are detained on January 3, 2019 at Adana Police Headquarters where they went to give official statement through an investigation against them. The investigation is initiated because of a 2-day hunger strike organised in HDP’s Adana office to support HDP Hakkari MP and Democratic Society Congress (DTK) co-chair Leyla Güven’s hunger strike.

5 people who were detained through the same investigation in Adana on December 30, 2018 were released by the court on judicial control conditions on January 2, 2019.

(01/032) Detained Trade Unionist in Kocaeli…

Erdal Kopal, chief union organizer of Highway, Airline, and Railway Workers’ Revolutionary Union of Turkey (Nakliyat-İş) is detained on January 3, 2019 at Gebze Police Headquarters where he went to give official statement through an investigation against him. It is learned that the reason of detention is another investigation for his social media posts.

(01/033) The Cases Against Academics Who Are the Signatories of the Petition “We will not be a party to this crime!”…

The case against 1 academician for signing the petition “We will not be a party to this crime!” on Istanbul Heavy Penal Court No 36 for ‘making propaganda for an illegal organisation’ are held on January 3, 2019. The court sentenced the person to 1 year and 3 months for ‘making propaganda for an illegal organisation’ and deferred the announcement of the verdict.

(01/034) Journalist on Trial on Istanbul…

The case against journalist Hasan Cemal for his article “From Silvan: They inured us to grief and death so much…” on T24 web portal published on December 4, 2015 is held on Istanbul Heavy Penal Court No 36 on January 3, 2019. Hasan Cemal’s lawyer stated that 3 people mentioned in the article were acquitted by the court in Diyarbakır and demanded Hasan Cemal should be acquitted too. The court rejected the demand and adjourned the trial to April 16, 2019.

(01/035) Journalist on Trial in Van…

The final trial of the case against journalist İdris Yılmaz on Van Heavy Penal Court No 5 is held on January 3, 2019. İdris Yılmaz joined the trial via sound and vision system from Elazığ High Security Prison No 1. The court sentenced İdris Yılmaz to 6 years and 3 months for ‘being an illegal organisation member’.

(01/036) The Case Against People Evacuated from Nusaybin…

The case against 17 children who were detained and then arrested on May 26, 2016, after being evacuated from the buildings they were stuck in during the curfew on Nusaybin district, is held January 3, 2019 on Mardin Heavy Penal Court No 4. It is learned that the 1 of the children was brought to the courtroom for trial and 4 children joined via sound and vision system. It is stated that children did not want to join via sound and vision system and demand to be in the courtroom in person. After defence hearings the court decided to bring 11 children to courtroom and to make 6 children join the trial via sound and vision system for the next trial which will be held on February 18, 2019.

(01/037) Former MP on Trial…

It is learned from the news coverage of January 3, 2019 that Diyarbakır Heavy Penal Court No 5 accepted the indictment of Diyarbakır Public Prosecutor’s Office against Sibel Yiğitalp, former Diyarbakır MP of HDP, for events and protests she attended. The indictment demands jail imprisonment from 10 years to 26 years for Sibel Yiğitalp, on the charges of ‘being an illegal organisation member’, ‘making propaganda for an illegal organisation’, ‘participating in unlawful assembly or demonstrations and resisting despite the warning or use of force’ and ‘publicly provoking hatred and hostility among people’. The indictment also demands consolidation of this case with another case against Sibel Yiğitalp which demands 28 years of jail time.

(01/038) Detentions and Arrests in Alleged Link to Coup Attempt…

On January 3, 2019, 7 people are detained in operations covering 2 cities through an Ankara based investigation; 21 people including military members on active duty are detained in operations covering 14 cities through a Samsun based investigation.

2 of 7 people who were detained through a Malatya based investigation are arrested by the court on January 3, 2019. 5 people are released on judicial control conditions.
