RECENT Fact Sheet on Curfews in Turkey Between the dates 16 August 2015-5 February 2016

Between the dates August 16th, 2015 and February 5th, 2016 there has been 58 officially confirmed, open-ended and round-the-clock [all daylong] curfews in at least 19 districts of 7 cities in Southeastern Turkey. These cities are as follow; Diyarbakır (32 times), Şırnak (7 times) ve Mardin (11 times), Hakkâri (4 times), Muş (1 time), Elazığ (1 time) and Batman (2 times). It is estimated that, according to the 2014 population census, at least 1 million 377 thousand residents have been affected by these curfews and fundemental rights of these people such as Right to Life and Right to Health are explicitly violated. Even though there is not an officially announced informaiton on the matter, it is also thought by the obtained knowledge that at least tens of thousands of people are forced to leave their homes and move to other cities/districts.

According to the data of Human Rights Foundation of Turkey (HRFT) [1], since August 16th, 2015 (which is the date of first declared curfew) until February 5th, 2016 at least 224 civilians (42 children, 31 women, 30 people over the age 60) lost their lives in regions and in periods of time that curfews were officially declared.

Besides, there are some cases that are not included in the abovementioned figures; one 7 months old still birth occured due to gunshot through the womb of the mother. Also, 8 people (6, close to Sur district and 1 in Nusaybin and 1 in Silvan districts) were killed by arbitrary shooting of security forces during peaceful protests against the curfews in streets/Squares close to curfew zones, yet where no operation was onging or any curfews were declared. VIOLATIONS of RIGHT to LIFE AGAINST CIVILIANS WITHIN THE FRAME of CHANGED IMPLEMENTATIONS of CURFEWS BETWEEN THE DATES DECEMBER 11th, 2015 and FEBRUARY 5th, 2016

Between the dates August 16th, 2015 and December 11th, 2015, there were again curfews without any legal basis. However, as of December 11th, 2015 the impose form of curfews, the broadness of regions that curfews are declared, military dispatch[3] and thoughen statements of government and State officials show that by the date December 11th, 2015, a different step has been taken, another period has begun in especially some districts of the region.

The regions, where curfews declared on December 11th, 2015 are; Sur District of Diyarbakır (it was under curfew since 3rd of December, was lifted for 17 hours and continued on 11th of December again), Dargeçit District of Mardin (it is lifted on December 29th, 2015, on 18th day of the curfew). And, the regions, where curfews are declared on December 14th, 2015 are; Cizre (still ongoing) and Silopi Districts of Şırnak (still ongoing but changed to night-long curfews on January 19th, 2016) and again Nusaybin District of Mardin (lifted on 24 December 2015, on 10th day) are still going on and at least 142 civilians lost their lives (23 of them are children, 21 of them are women and 17 of them are over the age 60).

Moreover, according to the statements of witnesses, at least 64 of these people lost their lives between these dates, while they were within the boundaries of their homes. 53 of these people were killed due to opened fire or hitting by a missile and 11 of them lost their lives due to the direct stress effect of curfews on their health conditions. Moreover, 41 of these people who lost their lives within the boundaries of their homes were only in Cizre District, and 35 of these killings occured by firearms.

Again, according to the limited information that we could obtain by press and online videos, at least 31 civilians lost their lives since December 11th, 2015 due to not being able to reach to the ambulances by reason of the security forces blockings. Within the last weeks, European Court of Human Rights approved 3 interim measure decisions about wounded Hüseyin Paksoy(16), Serhat Altun(23) and Orhan Tunç in Cizre. However, 2 of them lost their lives and Orhan Tunç’s condition is still unknown by reason of the ECHR decisions are not performed.

Since Turkey is a party to International Covenant on Economic, Social and Cultural Rights and General Comment No. 14 (2000) of The Committee on Economic, Social and Cultural Rights, International Covenant on Civil and Political Rights, Convention on the Rights of the Child, Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment which take under protection the fundamental rights of people, it is an unacceptable objection within the context of human rights to declare that ‘health services are not to be provided under times and zones of clashes due to security concerns.’ Furthermore, these International Conventions clearly state that health providers and bodies related to health services are not to be intervaned under any circumstances. With regards to all abovementioned violations of Right to Life it is essential to conduct immediate, impartial, independent and effective investigations.  

NOTE: Within the context of this fact sheet the term ‘security forces’ is implying to ‘Police Anti-terror Combat Team, Police Special Forces, Gendarmarie Special Forces, Military Forces and Riot Polices.’ Also, there are some unofficial teams which are both by themselves and publicly defined as JİTEM, Esedullah, Hançer [Dagger] Teams etc.

[3]Even though it’s not officialy declared, according to the national media almost 10 thousand members of security forces are active in operations in each district that curfews are ongoing (Cizre, Sur, Silopi). Moreover, it’s known  that hundreds of armored military vehicles such as tanks, panzers, cannons etc. Are dispatched to the relative districts/cities.
