3 October Daily Human Rights Report

(10/020) Extra-judicial Killing Allegation in Şırnak…

It is reported that on July 24, 2017 a militant named Cuma İmen was captured in Şırnak’s Beytüşşebap district during clashed between HPG militants and armed forces. News coverage from October 2, 2017 report that the militant was executed by the armed forces. It is claimed that there are images of İmren held by two soldiers after his capture. The news also claim that there is a video footage of İmren where he is asked if any harm has been done to him after he surrendered to the state and to the soldiers. İmren reportedly answered saying he was beaten and then the soldier filming allegedly stopped the video. It is learned that the body of İmren hasn’t been given to his family and his family have not received any formal explanation.

 (10/021) Sergeant Attacked in Silvan…

It is learned that a sergeant named Mehmet Kızıl got out of his personal vehicle on October 3, 2017 and shortly after was shot by an unidentified person or by multiple people.  Kızıl was heavily injured and died at the hospital.

(10/022) Dead Body Found in Nusaybin…

It is learned that on October 2, 2017 a dead body was found in a construction site in Nusaybin’s Fırat Neighborhood which is currently under curfew. The body is sent to the Forensic Medicine Institute for examination.

 (10/023) Torture and Ill-Treatment in Prison…

It is learned from news coverage of October 2, 2017 that a 17-year-old child named Y.Ü was arrested due to ‘membership of an illegal organization’ and has been staying in Şakran Juvenile Prison for four months. Y.Ü. was physically abused by other prisoners and called ‘terrorist’. One warden reportedly hit him to the wall and caused for his eyebrow to tear. It is reported that Y.Ü has bruises and swelling on his body.

Now closed DİHA’s reporter Emrah Çaçan’s letter from prison was published on October 2, 2017. According to the letter, prisoners in Bursa Type H Prison were forced to stand in military fashion during roll calls, those who disobeyed were charged with disciplinary punishments, books sent by prisoners families were restrained and Cumhuriyet, Evrensel and BirGün newspapers were prohibited in the prison. DİHA was closed by a Decree with the Force of Law.

It is learned from news coverage of October 3, 2017 that a prisoner named Rıdvan Tanış in Bolu Type F Prison went under dental surgery while his hands were handcuffed.

(10/024) Trial of Teacher Ayşe…

Teacher Ayşe Çelik who called a television program on January 8, 2016 and said ‘‘Children shouldn’t die’’ was filed a case by Bakırköy Heavy Penal Court No 2 due to ‘making propaganda of an illegal organization’ and  sentenced Ayşe Çelik to 1 year 3 months imprisonment. Penal Department No 2 of İstanbul Regional Court of Justice approved the verdict of Bakırköy Heavy Penal Court No 2. The producer of the program and 38 other people who turned themselves in by stating that they agreed with Çelik were acquitted.

 (10/025) Trial of Police Officer in Hakkari…

The trial of police officer İlyas Mekikli continued October 2, 2017. The case was opened by Diyarbakır Heavy Penal Court No 3 regarding the deaths of 4 people named Serhat Buldan, Rahmi Safhalı, Necdet İşözü and Aydın Tümen as well as two people that were injured because of open fire from an armored vehicle in Hakkari, Yüksekova. Indictment requests 15 years for Mekikli due to ‘reckless killing.’ Defendant Mekikli attended the trial from Erzincan Type T Prison through SEGBİS. It is reported that ASELSAN and TUBITAK were asked for expert opinion but both denied to send experts due to not having any. Following the defenses the court ruled for the release of Mekikli and adjourned the trial to December 2017.

 (10/026) Police Intervention in Ankara towards “I Want My Job Back” demonstration…

Civil servants discharged from their jobs with KHK legislations planned for a public statement in front of the Human Rights Monument in Ankara Yüksel Street on October 2, 2017. The demonstrations have been going on for several weeks. Two meetings planned at 13.30 and 18.00 respectively were both prevented by the police forces who clocked entrance to the street by barriers. It is learned that during the intervention towards the 13.30 meeting, officers teared the banners protestors were carrying, sprayed tear gas from talking distance, physically abused a person named Mehmet Dersulu and detained him.

During the police intervention at 13.30’da 1 person named Deniz Aydın was detained. Aydın was later released after a fine for demeanor was issued. No detainment took place at the 18.00 meeting.

(10/027) Attorneys Detained in Mersin …

It is learned that on October 3, 2017 in Mersin, IHD (Human Rights Association) Secretary Attorney Özgür Çağlar and Attorneys Mehmet Altundaş, Bedir Kuran, Ali Bozan, Rıza Oğuz and Sebahat Gençtarih’s offices and houses were raided by police officers.  Attorneys Sebahat Gençtarih, Bedir Kuran and Ali Bozan were detained, Özgür Çağlar, Mehmet Altundaş and Rıza Oğuz who weren’t present at their houses were issued detention requests.

(10/028) Detentions and Arrests in Connection with the Coup d’État Attempt…

It is learned that on October 2, 2017, 11 people through a Çanakkale based investigation, 20 people through an Elazığ based investigation were detained. 29 business people were detained in Mersin due to alleged financial contributions to illegal organization.

It is learned that on October 2, 2017 detention requests for 36 people in Istanbul were issued due to alleged ByLock usage and operations began to capture these people.

It is learned that 8 of 15 soldiers, including regular soldiers, who were detained through an Aydın based investigation on September 28, 2017 were arrested on October 2, 2017. 7 people are still under detention.

It is learned that 8 of 23 soldiers, including regular soldiers, who were detained through a Kocaeli based investigation on September 22, 2017 were arrested. 15 people are still under detention.

 (10/029) Trials in Diyarbakır …

The first trial of businessperson and Diyarbakır Chamber of Commerce (DTSO) Council President Celalettin Birtane took place in October 2, 2017. The case was opened by Diyarbakır Heavy Penal Court No 9. Birtane was accused with ‘membership of an illegal organization’. Birtane attended the trial and made his defense. The court released Birtane on pending trial and adjourned the date to January 2018.

 (10/030) Trials in Connection with the Coup d’État Attempt…

The final hearing of 13 soldiers who allegedly tried to overtake TRT building during July 15 coup attempt, took place on October 2, 2017.  6 of the soldiers were already arrested. The case was opened by İstanbul Heavy Penal Court No 24. Following the defenses the court sentenced former colonel Nurullah Zeki Atmaca and former lieutenant colonel Birol Keskinkılıç to heavy life sentences due to ‘attempting to overthrow constitutional order’. The court lowered the heavy life sentences given to arrested defendants former colonel Cem Doygun, sergeants Muhammet Mustafa Çelik, Serdar Uzel and Private Murat Karataş to life sentences. The court acquitted the defendants on pending trial.

 (10/031) Events Banned in City…

Governorate of Ankara declared on October 2, 2017 that it is prohibited to organize sit-ins, hunger strikes, commemoration gatherings, concerts in all open public spaces, parks and gardens in the city.

The Governorate previously declared on September 25, 2017 that it is prohibited to loudly sing, chant, protest, gather for press briefings or any other events in any central location of Çankaya district.

 (10/032) Banned Internet News…

Istanbul 4th Criminal Court of Peace censored Evrensel, Cumhuriyet and T24 newspapers coverage on Sosyal Doku Foundation President Nureddin Yılmaz’s words on child marriage. Yılmaz previously attended a television program and said ‘it is possible to marry a 6-year-old child’. The court banned access to news and demanded for removal of the content.
