(10/381) Torture and Il-Treatment in Prison…

It is learned from the news coverage of October 25, 2018 that Özgür Bektaşoğlu (43), a prisoner with disability at the rate of 52 per cent, who is kept in Manisa T Type Closed Prison, was forced to stand in military order with his arm twisted during roll-calls and he felt down due to it.

It is learned from the news coverage of October 25, 2018 that 21 political prisoners who were subjected to physical violence by the wardens because of rejecting standing in military order during roll-calls for 4 days between September 25 and 29, 2018, were punished with solitary confinement for 50 days.

It is learned from the news coverage of October 25, 2018 that Figen Şahin, who was subjected to insults by soldiers during being transferred to hospital from Burhaniye T Type Prison is punished with 15 days of solitary confinement.

It is learned from the news coverage of October 25, 2018 that, some prisoners in Kayseri Bünyan Women’s Prison are debarred from visits for 2 months, as a penalty for organising a commemoration for people died in October 10 – Ankara Massacre.

It is learned from the news coverage of October 25, 2018 that 20 female prisoners including 5 ill prisoners are transferred under coercion to Tarsus T Type Closed Prison from Diyarbakır E Type Prison. The names of transferred prisoners are: Nebahat Şirgen, Sevgi Altınel, Zehra Doğan, Gülten Orak, Hatice Ay, Sabiha Turan, Sakine Bozkuş, Maşallah Dağ, Halime Işıkçı (bedbound), Mehtap Yılmaz, Meral Temel, Evindar Aydın, Bahar Avcı, Ayhan Akgül (has thalassemia) Saadet Ergin, Özliyet Filizer, Rukiye Bakış.

(10/382) Rejection to Meeting Request with Abdullah Öcalan…

It is learned that the appeal made on October 25, 2018 to chief public prosecutor’s office in Bursa by PKK leader Abdullah Öcalan’s lawyers in order to visit their client was rejected the same day on the grounds of limitations for prisoners in accordance with the law on the execution of sentences and security measures (law no 5275). With the last rejection, it was the 758th time that appeals for visiting Öcalan have been rejected so far. Abdullah Öcalan has met his lawyers on July 27, 2011 for the last time.

It is learned that Socialist Party of Kurdistan (PSK) Muğla office was attacked by a racist group on October 25, 2018 in which the external door of the office was broken.

(10/384) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling 716 days to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on October 25, 2018 at 13.30 and 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on October 25, 2018, 2 people (Nazan Bozkurt and Armağan Özbaş) and at 18.00 3 people (Mehmet Dersulu, Armağan Özbaş and Nazan Bozkurt) were detained.

Thus in total 5 people were detained due to press declaration intended to be held in Yüksel Street on October 25, 2018. It is learned that detainees were released the same day.

(10/385) Police Intervention Against a Protest in Istanbul…

Türkan Albayrak, who was dismissed from her job at Sarıyer district Health Department, on the grounds of ‘personnel security investigation’ and ‘archive search’, on August 3, 2018; made a press declaration to regain her job on October 25, 2018 and attempted for a sit-in protest in front of Health Department. The police intervened the sit-in and detained Türkan Albayrak. It is learned that Türkan Albayrak was released the same day. It is the 33rd time of detention of Türkan Albayrak.

Zeki Koç, former member of HDP’s party assembly, who was detained in İskenderun district of Hatay, on October 24, 2018, on the grounds of ‘making propaganda for an illegal organisation on social media’, is arrested by the court on October 25, 2018.

Nasır Çagan, who was detained in Osmaniye on October 25, 2018, on the grounds of ‘making propaganda for an illegal organisation’ is released on judicial control conditions.

(10/388) HDP Executive Detained in Istanbul…

Nadiye Gürbüz, HDP’s Party Assembly member who was detained in Istanbul on October 25, 2018, when he was at the prosecutor’s office in order to give official testimonial for an investigation. It is learned that the prosecutor did not take official statement, called the police to detain Nadiye Gürbüz.

(10/389) Former Co-Chairs of HDP on Trial…

The case against Selahattin Demirtaş and Figen Yüksekdağ, former co-chairs of HDP, on Kayseri Penal Court of First Instance No 12, on the charge of ‘calumny against public officials’ is held on October 25, 2018. Selahattin Demirtaş joined the trial via sound and vision system, Figen Yüksekdağ did not attend on excuse. Demirtaş’s demand to defend himself is not accepted by the court. The court decided to send writ to prisons in order to have Demirtaş and Yüksekdağ on sound and vision system at the next trial and adjourned the trial to January 31, 2019.

(10 /390) The Cases Against Academics Who Are the Signatories of the Petition “We will not be a party to this crime!”…

The separate cases against 13 academicians (Research Assistant S.H., Professor E. Ahmet Tonak, PhD Esra Sakınç, Assoc. Professor Ayşe Evren Hoşgör, Research Assistants Kudret Çobanlı from Bilgi University, Lecturer İrfan Eroğlu from Maltepe University; Professor Sefa Feza Arslan, Assoc. Professor Özgür Martin, PhD Gamze Toksoy from Mimar Sinan Fine Arts University; PhD student B.K. from York University, PhD student D.G.İ. from Washington University, Lecturer Zeynep Güney from Fatih Sultan Mehmet University and Assoc. Professor Sevgi Uçan Çubukçu from Istanbul University) for signing the petition “We will not be a party to this crime!” on Istanbul Heavy Penal Court No 23 for ‘making propaganda for an illegal organisation’ are held on October 25, 2018. The court rejected the demands of immediate acquittal, and of consolidation of the cases with the one on Istanbul Heavy Penal Court No 13; and adjourned the trials of all 13 cases to March 5, 2019.

The case against Assist. Professor Emine Fişek from Boğaziçi University on Istanbul Heavy Penal Court No 24, for the same reason, is held on October 25, 2018. The court decided to consolidate the case with other related cases and adjourned the trial to April 25, 2019.

The separate cases against 2 academicians (Research Assistant Gülçin Karabağ from Yıldız Technical University and Lecturer Fevziye Deniz Tarba Ceylan from Sabancı University) on Istanbul Heavy Penal Court No 28, for the same reason, is held on October 25, 2018. The court sentenced Fevziye Deniz Tarba Ceylan to 1 year and 3 months for ‘making propaganda for an illegal organisation’ and deterred the announcement of the verdict. The court adjourned the trial of the case against Gülçin Karabağ to December 18, 2018.

(10/391) Journalists on Trial in Istanbul…

The final trial of the case against journalists Hüseyin Aykol, İnan Kızılkaya and İhsan Çaralan on Istanbul Penal Court of First Instance No 2, on the grounds of ‘insulting the President’ in an article published in Özgür Gündem newspaper is held on October 25, 2018. Three journalists were “Editors-in-Chief on Watch” of Özgür Gündem back then, which is closed down by a state of emergency decree. The court sentenced Hüseyin Aykol and İnan Kızılkaya to 1 year 10 months and 26 days each and did not deter the announcement of the verdict. The court sentenced İhsan Çaralan to 11 months and 20 days and deterred the announcement of the verdict.

(10/392) Journalists on Trial in Istanbul…

The case against Ali Özken, managing director of Akit TV channel, on Istanbul Küçükçekmece Penal Court of First Instance No 5, on the charge of ‘publicly insulting Atatürk’s memory’ in a news reports titled “Oppression ended in 1938” which was aired on November 10, 2015; is held on October 25, 2018. The indictment demands Ali Özken to be sentenced up to 4 years and 6 months. The court accepted the demand of last stand of Ali Özken who is on compulsory military service and adjourned the trial to March 5, 2019.

(10/393) Police Officers on Trial in Silopi for Death of 2 Children Hit by an Armoured Police Vehicle…

Muhammed Yıldırım (7) and Furkan Yıldırım (6) died on May 3, 2017, when an armoured police vehicle hit and demolished the wall of their houses in Silopi district of Şırnak. The case against Ömer Yeğit, driver of the vehicle and Murat Maden, the police chief for death of 2 brothers is held on Cizre Heavy Penal Court No 2 is held on October 25, 2018.

The indictment demands jail penalties from 2 years to 15 years for 2 defendants on the charge of ‘causing death of more than one person on negligence’.

Ahmet Karaaslan, a police officer heard as a witness, stated that Selçuk Erdoğan, police chief of Silopi district has an order to employ the personnel regardless of training and certification and that he has no information whether any personnel without training and certification is employed or not.

Defendant police officers Ömer Yeğit and Murat Maden stated that Selçuk Erdoğan, police chief of Silopi district is responsible for the incident.

The complainant lawyers criticized that the armoured vehicle is considered to be primarily blameable in the inquiry report while the driver is seen as blameable secondarily.

The court decided to demand a report from a committee of 3 consisting of specialists on work health and safety, machines, electricity and roadways from Istanbul Technical University and adjourned the trial to December 25, 2018.

(10/395) Trials in Alleged Link to Coup Attempt…

The final trial of the case against 55 military members including former admirals Hayrettin İmren and Nazmi Ekici for the incidents at Fleet Command during July 15 coup attempt, is held on Kocaeli Heavy Penal Court No 5 on October 25, 2018. The court sentenced 23 defendants including Hayrettin İmren and Nazmi Ekici to heavy life imprisonment and 13 defendants to life imprisonment for ‘violating the Constitution’. The court sentenced 11 defendants to jail penalties differing from 1 year to 26 years. The court acquitted 8 defendants.

The final trial of the case against former judges Şeyhmus Yılma and Sümeyra Yılma, who were dismissed by state of emergency decrees, is held on Erzurum Heavy Penal Court No 2 on October 25, 2018. The court sentenced 2 defendants to 6 years and 3 months each for ‘being an illegal organisation member’.

The final trial of the case against Professor Murat Şen, former dean of Law Faculty of Melikşah University which was closed down by a state of emergency decree, is held on Kayseri Heavy Penal Court No 2 is held on October 25, 2018. The court sentenced Murat Şen to 12 years for ‘being an illegal organisation member’.

Ahmet Şen, local administrative of Savaş neighbourhood in Sur district of Diyarbakır is replaced by a trustee appointed by the Ministry of Interior on October 25, 2018.

(10/397) Local Administrative are Suspended in Hakkari…

It is learned from the news coverage of October 25, 2018 that local administrative of 33 villages and neighbourhoods in central, Çukurca and Yüksekova districts of Hakkari are suspended by the Ministry of Interior.
