21-25 November 2015 Daily Human Rights Report

(11/125) Nusaybin Blockaded…

The blockade and operations conducted under the decision of curfew reached its 11th day as of 23 November 2015.

Muhammed Altunkaynak died on 19 November 2015 in Abdulkadir Paşa quarter with shrapnel pieces when a bomb exploded on his way back home.

Nurhan Kaplan (45) was killed on 20 November 2015 in Abdulkadir Paşa quarter when snipers opened fire.

Şerif Alpar (55) was shot at head with grenade thrower by the police and killed when he was going from Abdulkadir Paşa quarter to Fırat quarter to visit his relatives on 21 November 2015.

The blockade was temporarily lifted on 21 November 2015 between 08:00 and 16:00 except for the Abdulkadir Paşa, Fırat, Yenişehir and Dicle quarters.

Müzeyyen Kızıl (23) was shot and heavily wounded when security forces opened fire from an armoured vehicle on 22 November 2015. Müzeyyen Kızıl was sitting in front of her house.

Electricity, water and internet lines were cut off in the district. Armoured vehicles were located in Fırat, Abdulkadir Paşa and Devrim quarters, and also on Newroz Square and around old hospital to blockade the quarters and to conduct operations.

(11/126) Curfew in Yüksekova…

Governorate of Hakkari declared curfew in Yüksekova district centre starting from 20 November 2015.

After the curfew declaration, Special Forces conducted operations to fill the ditches in Cumhuriyet and Güngör quarter of the district. Mehmet Reşit Arıcı (18) and Naim Noyan (29) were shot to death when the police opened fire against the persons who protested the operations. At least 13 persons were also wounded. The curfew was ended on 23 November 2015 after 4 days of implementation.

(11/127) Person Died in Silvan…

According to the news appeared in the press on 21 November 2015, Latif Nangir (78) died in Silvan district of Diyarbakır when he was being carried to hospital by his relatives. He allegedly died for being horrified for the excessive use of bombs.

(11/128) Operations and Attacks in the Southeast…

A Deputy Police Chief who was heavily wounded during an armed clash in Silvan district of Diyarbakır died on 23 November 2015 in the hospital.

(11/129) Syrian Children Killed in Hatay…

Syrian children Abdulhamit Taben (16) and Ahmet Taben (16) were beaten to death by their boss Habip Oral (31) on18 November 2015 in İskenderun district of Hatay.

Habip Oral who killed the children by beating with a club was arrested.

(11/130) Assassination Allegation against Political Party Co-Chair…

Peoples’ Democratic Party (HDP) Co-Chair Selahattin Demirtaş was allegedly attempted to be assassinated on 22 November 2015. HDP officials made a denouncement when they found a trace of a solid material on the rear window of Demirtaş’s bullet-proof vehicle.

After the investigation of the trace, Governorate of Diyarbakır alleged that the trace was not a result of a bullet.

(11/131) Curfew in Diyarbakır…

The curfew in 26 villages and quarters of Lice and Hani districts of Diyarbakır was ended by the Governorate on 22 November 2015. The curfew was declared on 19 November 2015.

(11/132) Killings by Unidentified Assailants Case…

Ankara Heavy Penal Court No 1 continued on 20 November 2015 to hear the case against 19 persons including Mahmut Yıldırım aka Yeşil, Mehmet Ağar and Korkut Eken launched for 18 killings by unidentified assailants in 1990s.

Former İstanbul Securty Director Kemal Yazıcıoğlu testified at the hearing. The court decided to hear several witnesses including businessman Halis Toprak and journalist Tuncay Özkan. The court also decided to examine the “Susurluk Report” and adjourned the hearing to 26 February 2015.

(11/133) Abdullah Cömert Case…

Balıkkesir Heavy Penal Court No 2 continued on 20 November 2015 to hear the case against the police officer Ahmet Kuş (29) launched on charges of the killing Abdullah Cömert (22) with a tear gas canister on 3 June 2013 in Hatay during Gezi Park demonstrations. The case was transferred to Balıkesir Heavy Penal Court No 2 for security reasons. The indictment wants the defendant to be sentenced to a term of imprisonment up to 25 years for “killing with eventual intent”.

The court decided to write Forensic Institute to ask for the completion of the report demanded by the court or present an excuse for not preparing the report. The court rejected the demand for the arrest of defendant and adjourned the hearing to 15 January 2016.

(11/134) Police Officers on Trial for Violence during Gezi Park Demonstrations…

İzmir Penal Court First Instance No 32 continued on 20 November 2015 to hear the case against police officers İ.G., M.K. and M.B. launched for beating a woman in İzmir on 2 June 2013 during Gezi Park demonstrations.

The police intervened the demonstrators on Gündoğdu Square on the day of incident. 3 officers attacked a woman sitting on seaside on Cordelio. When the video recordings of the incident were revealed, a court case was launched against the police officers for “misconduct of duty”.

In his defence as to the accusations, the defence lawyer alleged that the police officers did not beat the victim, but just pushed. After the testimonies of the eyewitnesses, the court adjourned the hearing to a later date to examine the files for being newly appointed to the case.

(11/135) Investigations, Detentions and Arrests on the Allegations of Insulting State President…

M.E.A (24) and A.A. (23) were arrested on 20 November 2015 in Birecik district of Şanlıurfa on the allegations of “insulting State President” through their social media accounts.

R.S. was also arrested in Hakkari for the same reason.

(11/136) Demonstrators Acquitted in Ağrı…

Ağrı Heavy Penal Court concluded on 17 November 2015 to hear the case against Ejder Özdemir launched for shouting the slogan “PKK are people, people are here” during a demonstration on 15 February 2015 in Ağrı.

After the final defence, the court acquitted the defendant. The indictment wanted the defendant to be sentenced according to the Article 7/2 of Anti-Terror Law for “making propaganda of an illegal organisation”.

(11/137) Protest Intervened in Diyarbakır…

A villager was wounded when military troops opened fire against a group of villagers who staged a human shield action on 22 November 2015 to stop the operations nearby Bateyt hamlet of Hani district in Diyarbakır.

(11/138) Protest Intervened in İstanbul…

The police intervened the members of Peoples’ Democratic Congress (HDK) who wanted to stage a demonstration on 21 November 2015 on Kocamustafapaşa Square in Fatih district of İstanbul to protest in the blockade in Nusaybin. 27 protesters were detained during the police intervention.

(11/139) Newroz Celebrations…

According to the news appeared in the press on 22 November 2015, a court case was alunched against 49 Mersin University students in connection with the Newroz celebrations in the university campus on 20 March 2015.

The indictment wants the defendants to be sentenced for “being member of an illegal organisation” and “making propaganda of an illegal organisation”. Mersin Heavy Penal Court No 2 will start to hear the case on 9 December 2015.

(11/140) KCK Trial in Van…

Van Heavy Penal Court No 2 concluded to hear the case against 6 members of union of public servants in education sector Eğitim-Sen launched after an KCK operation conducted in Van. The defendants were arrested, but released during trial to be tried without remand.

The court sentenced the defendants Peoples’ Democratic Party (HDP) MP Lezgin Botan, Selami Özyaşar, Mahmut Galip Yaviç and Hakan Yaman to 6 years and 3 months’ imprisonment for “being member of an illegal organisation”. Müzahit Karakuş and Sinan Gündüz were acquitted.

(11/141) Political Party Premises Raided in Mersin…

The police raided Peoples’ Democratic Party (HDP) premises on 21 November 2015 in Akdeniz district of Mersin on the grounds that “an organisational meeting was held in the premises” and searched the premises. After 3 hours of search, 16 persons including 5 children were detained.

(11/142) Operations throughout Turkey…

8 supporters of Peoples’ Democratic Party (HDP) in Seyhan district of Adana and 13 persons in İstanbul were detained on 20 November 2015.

Bayram Can, Mazlum Metin, Agit Karasu and Azad Esenkuş who were among 13 persons detained in İstanbul were arrested on 21 November 2015 on the allegations of “being member of an illegal organisation”.

Mehmet Sefunç and Mazlum Duran who were among 6 persons detained during house raids conducted on 19 November 2015 in Silvan district of Diyarbakır on the allegations of insulting military troops with slogans when the troops were leaving Silvan after 12-days curfew were arrested on 20 November 2015 on the allegations of “making propaganda of an illegal organisation”.

Peoples’ Democratic Party (HDP) MP Berdan Öztürk’s advisor Ahmet Altunay who was detained during a house raid in Patnos district of Ağrı was arrested on 20 November 2015 on the allegations of “being member of an illegal organisation”.

Rezan Kadir Şexo and İhsan Tekin who were among 7 persons detained during house raids in Adana were arrested on 20 November 2015 on the allegations of “being member of an illegal organisation”.

İ.Ş. (17) who was shot and wounded by the security forces during curfew in Cizre district of Şırnak was detained on the allegations of “reasonable suspicion”. İ.Ş. was arrested on 20 November 2015.

7 persons who were among 11 persons detained during house raids on 17 November 2015 in Sarıkamış and Selim districts of Kars against the members of  members of Peoples’ Democratic Party (HDP) and Democratic Regions Party (DBP) were arrested on 21 November 2015 on the allegations of “being member of an illegal organisation”.

7 members of HDP who were among 15 persons detained Şirvan district of Siirt were arrested on the allegations of “being member of an illegal organisation”.

(11/143) House Raids in İzmir…

4 children who were among 11 persons detained during house raids on 19 November 2015 against the houses of members of People’s Front (Halk Cephesi) in Bayraklı district of İzmir in connection with a “DHKP-C (Revolutionary People’s Liberation Party – Front) Investigation” were arrested on 20 November 2015 on the allegations of “being member of an illegal organisation.

(11/144) Person Killed by the Police in Şırnak…

Rafet Aşut (23) who was heavily wounded when the police opened fire during the demonstration staged on 9 November 2015 Cizre district of Şırnak to protest in the curfew in Sİlvan district of Diyarbakır died on 23 November 2015 in Adana Training and Research Hospital.

(11/145) Stop Warning…

On 23 November 2015, Security Forces opened fire against 2 vehicles in Silvan district of Diyarbakır on the allegations of “not obeying the stop warning” and “being in preparation for an attack”. Murat Aktar (22) was killed and Y.M. (17) was wounded during the incident.

(11/146) Operations and Attacks in the Southeast…

6 soldiers were wounded when a bomb exploded on 23 November 2015 nearby Varto district of Muş during the passage of a military vehicle.

A police officer was killed and a police officer was wounded when the protection vehicle of the Siverek Sub-Governor was opened fire on 23 November 2015 after visiting a factory in Siverek district of Şanlıurfa.

Governorate of Hakkari announced on 23 November 2015 that several regions in Çukurca district of the province were decided to be temporary security zones for 15 days. Entrance of civilians to the security zones was also banned until 9 December 2015.

(11/147) Impunity in Extra-judicial Killing Case…

On 22 October 2015, Ankara Heavy Penal Court No 6 concluded on 23 November 2015 to hear the case against 18 retired and regular soldiers launched in connection with the killings of the HPG militants Sunullah Keserci and Necmeddin Ahmed Hasan, and villager İbrahim Atabay (18) on 6 October 2009 in Buğulukaynak (Kel) village in Çaldıran district of Van.

After the final defence, the court acquitted the defendants retired Van Gendarmerie Commander Vecihi Halil İyigün and regular soldiers former Gendarmerie Intelligence Commnader Major Hakan Başaklıgil, First Lieutenant Muhlis Çolak, Non-commissioned Officer Kabil Tanyeli, specialised sergeants İsmail Taşdemir, Hasan Kaya, Ünal Demirbaş, Hasan Emir, Mustafa Küpeli, Abdülkadir Karaca, Abdülmütalip Ateş, Mustafa Perpil, Mehmet Kocaboğa, Hamza Çelik, Hüseyin Güzel, Mevlüt Mete and Özgenç Soylu. The court also ruled that the defendants can open compensation cases for being remanded during the trial.

According to the indictment, the militants were unarmed and trying to leave the village during the incident. But Beşir Atalay, who was the Ministry of Interior Affair then, alleged that the militants died during an armed clash.

(11/148) Pressures in Prisons…

According to the news appeared in the press on 23 November 2015, 18 prisoners incarcerated in İskenderun (Hatay) T-type Prison were transferred to other prisons. They were reportedly among 32 prisoners who were recently subjected to interrogation of the prison administration under torture.

(11/149) Protest Intervene din İzmir…

The police intervened the members of Peoples’ Democratic Party (HDP) who staged a sit-in action on 23 November 2015 in front of the İzmir Governorate to protest in the curfew in Nusaybin district of Mardin. 17 protesters were detained during the intervention.

(11/150) Protesters on Trial in İzmir…

İzmir Penal Court of First Instance No 22 started on 23 November 2015 to hear the case against 81 persons launched for taking part in a demonstration staged on 10 September 2013 in Alsancak quarter of İzmir to protest in killing of Ahmet Atakan on 10 December 2013 in Hatay by unidentified assailants.

The indictment wants the defendants to be sentenced for “violating the Law on Meetings and Demonstrations”, “resisting security forces”, and damaging public property”.

Defence lawyers argued at the hearing that the indictment was against the Law on Criminal Procedures. The court decided to return the indictment to the Public Prosecutor and adjourned the hearing to 8 February 2016.

(11/151) Political Party Premises Raided in Mersin…

4 persons including a child who were among 16 persons detained during the raid of Peoples’ Democratic Party (HDP) premises on 21 November 2015 in Akdeniz district of Mersin were arrested on 23 November 2015 on the allegations of “being member of an illegal organisation”. The raid was conducted on the grounds that “an organisational meeting was held in the premises”.

(11/152) Operations throughout Turkey…

On 23 November 2015 in Çatak district of Van, the police detained 4 persons including Democratic Regions Party (DBP) executive for the district Necmettin Kıpçak.

Serhat Dayan (19) who was among 3 persons detained during house raids in Bismil district of Diyarbakır was arrested on 23 November 2015 on the allegations of “being member of an illegal organisation”.

(11/153) Nusaybin Blockaded…

The blockade and operation conducted under the decision of curfew reached its 13th day as of 25 November 2015.

Sedat Güngör (22) who shot during the operations conducted on 24 November 2015 in Yenişehir quarter died in the hospital.

Sultan Şavur (64) was wounded in Fırat quarter with shrapnel pieces.

Hasan Korkmaz (60) was shot at his back in Fırat quarter. He was wounded and hospitalised.

(11/154) Curfew in Cizre…

Governorate of Şırnak declared curfew on 24 November 2015 in Sur and Yafes quarters of Cizre district.

(11/155) Operations and Attacks in the Southeast…

Civil officer Sabri Oğlak and a police chief died, a police officer was wounded when an armoured police vehicle was attacked on 24 November 2015 in Cizre district of Şırnak.

General Staff made an official announcement and alleged that 5 militanst were killed during the operations conducted on 23 November 2015 in the rural area of Şemdinli district in Hakkari.

A transsexual woman with the first name Nilay found stabbed to death on 23 November 2015 in Maltepe district of İstanbul.

(11/157) Police Officers on Trial for Violence…

Çağlayan (İstanbul) Penal Court of First Instance No 7 started on 24 November 2015 to hear the case against police officers Ömer Serdar Küçükibrahimoğlu and Fatih Zahter. The case was launched upon official complaint by Gökçe Algan who collar bone was broken when being targeted by a anti-riot water cannon vehicle TOMA during Gezi Park demonstrations in İstanbul. The indictment wants the defendants to be sentenced for “intentional wounding” and “misconduct of duty”.

The defendant Fatih Zahter appeared and testified at the hearing. The court decided to ask news agencies to provide the footage of the incident. The court also ordered the defendant Ömer Serdar Küçükibrahimoğlu to testify through SEGBİS system for being on duty in Van and adjourned the hearing to 2 March 2016.

(11/158) Former MP on Trial in Manisa…

Manisa Penal Court of First Instance No 6 started on 24 November 2015 to hear the case against former MP Şevki Yılmaz launched for the expressions he used during a speech in a conference. The indictment wants the defendant to be sentenced according to the Law on Crimes Committed against Atatürk.

After the defence of the lawyers of Şevki Yılmaz, the court decided for an expert’s report on the expressions and adjourned 9 February 2016.

(11/159) Persons on Trial in Ağrı…

Ağrı Heavy Penal Court started on 24 November 2015 to hear the case against 5 remanded persons launched for the poster “We condemn the complot – We salute the self-governance decision of our people (Komployu kınıyoruz.  Halkımızın özyönetimini selamlıyoruz)” they carried during a demonstration in Ağrı on 8 March 2015.

After the testimonies of the defendants, the court released the defendants Mehmet Öztürk, Mehmet Şakir Çaçan and Mehmet Reşat Adıgüzel to be tried without remand and adjourned the hearing to 26 January 2016.

(11/160) KCK Operation in Mersin…

Security Forces conducted operations on 24 November 2015 in Mersin against “financial organisation of KCK”. 9 persons including Progressive Lawyers Association (ÇHD) Char for Mersin province Mehmet Altuntaş were detained.

Mayor of Akdeniz district Fazıl Türk and another person are allegedly wanted in connection with the operations.

(11/161) Operations throughout Turkey…

The police detained 7 members of Socialist Youth Association (Sosyalist Gençlik Derneği – SGD) when they were making promotion the daily Azadi on 24 November 2015 in Kızıltepe district of Mardin.

The police conducted house raids in Kızıltepe ande reportedly detained 5 persons.

6 persons in Viranşehir district of Şanlıurfa and17 persons in Siverek district were detained during the operations.
