(12/238) Torture and Ill-Treatment Under Custody in Istanbul…

It is learned from the news coverage of December 18, 2018 that, Birgül Mızrak and Göksel Dilibal, 2 people who were detained on December 16, 2018 in Istanbul, were subjected to torture during detention and under custody. In relation to the claims of torture, lawyers from The Law Office of the Oppressed, who prepared an official report after meeting with those 2 people, state the following:

“Birgül Mızrak told that, although there was no such behaviour requiring any kind of use of force during detention, she was battered while being detained and that she was intensely battered although she was handcuffed in the vehicle being transported to police headquarters, she was hit under the chin, on the right side, at the head and the face, and she was choked. Widely rash on the side of her face, swell in the eyes and bruises on the lips could be seen (…) She was forced to strip search at the police headquarters where beating and insults continued. She was subjected to physical and verbal abuse several times (…) There are bruises and pain on her left leg under the knee and she feels pain in her neck too. It could be seen that there are swellings in her head and partly on her face and pain is felt there too.”

“Göksel Dilibal was subjected to beating and forced to strip search at the entrance of police headquarters and during detention. At this time, he was subjected to sexual abuse due to strip search and was beaten with belt, physical marks on his body could be seen. There are still swellings and bruises on his face and eyes and blood marks in the right eye.”

(12/239) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened into the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling 770 days to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on December 18, 2018 at 13.30 and 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on December 18, 2018, 3 people (Meltem Servi, Nursel Tanrıverdi and Mahmut Konuk) and at 18.00 5 people (Acun Karadağ, Alev Şahin, Mehmet Dersulu, Engin Karataş and Cemal Öksüz) were detained.

Thus in total 8 people were detained due to press declaration intended to be held in Yüksel Street on December 18, 2018. It is learned that detainees were released the same day.

(12/240) Former HDP PM and Co-Mayor Are Detained in Iğdır…

On December 18, 2018, 9 people including Kıznaz Türkeli, former MP of People’s Democratic Party (HDP); Iğdır co-mayor Şaziye Önder and Tuzluca district co-mayor Mehmet Gültekin are detained through an Iğdır based investigation. The reason for detention is unknown. The names of detainees are: Kıznaz Türkeli, Şaziye Önder, Mehmet Gültekin, HDP former provincial co-chair Oya Malgaz, Vedat Yılmaz, Kadir Özsular, Adem Kartal, Zübeyde Kaynar, Ayşe Bağış.

(12/241) Detained Lawyer in Istanbul…

On December 18, 2018, lawyer Didem Baydar Ünsal who was on “Watch for Solidarity with Arrested Lawyers” outside of Çağlayan Courthouse in Istanbul is detained.

People’s Law Office announced that lawyer Didem Baydar Ünsal was taken to Çağlayan Police Station and was not allowed to meet lawyers visiting her.

(12/242) The Cases Against Academics Who Are the Signatories of the Petition “We will not be a party to this crime!”…

The separate cases against 2 academicians (Assist. Professor Başak Tuğ Onaran from Bilgi University and Research Assistant Gülçin Karabağ from Yıldız Technical University) for signing the petition “We will not be a party to this crime!” on Istanbul Heavy Penal Court No 28 for ‘making propaganda for an illegal organisation’ are held on December 18, 2018. The court adjourned the trial of the case against Başak Tuğ Onaran to May 5, 2019. The court sentenced Gülçin Karabağ to 1 year and 3 months for ‘making propaganda for an illegal organisation’ and deferred the announcement of the verdict.

The separate cases against 4 academicians (Assoc. Professor Ahmet Atıl Aşıcı and Didem Çınar from Istanbul Technical University, Assist. Professor Tuba Kıyan from Yıldız Technical University, Assoc. Professor Ayten Alkan from Istanbul University) for the same reason on Istanbul Heavy Penal Court No 32 for ‘making propaganda for an illegal organisation’ are held on December 18, 2018. The court adjourned the trial of the case against Didem Çınar to April 4, 2019, the trial of the case against Ahmet Atıl Aşıcı to March 19, 2019, the trial of the case against Tuba Kıyan to April 17, 2019, and the trial of the case against March 13, 2019.

The separate cases against 3 academicians (Assist. Professor Murat Yılmaz and Assist. Professor İbrahim Yaman from Boğaziçi University, Assist. Professor Aslı Vatansever from Doğuş University) for the same reason on Istanbul Heavy Penal Court No 29 for ‘making propaganda for an illegal organisation’ are held on December 18, 2018. The court adjourned the trials to April 9, 2019.

The case against Assist. Professor E.A.T. from Mimar Sinan Fine Arts University) for the same reason on Istanbul Heavy Penal Court No 29 for ‘making propaganda for an illegal organisation’ are held on December 18, 2018. The court decided to consolidate the case with other cases against academicians and adjourned the trial to April 25, 2019.

(12/243) Former HDP MP’s on Trial…

The final trial of the case against former HDP MP’s Ertuğrul Kürkçü and Mehmet Emin Adıyaman, for Newroz celebrations in Iğdır in 2016, is held on Iğdır Heavy Penal Court on December 18, 2018. The court sentenced Ertuğrul Kürkçü to 2 years. The court decided to separate the case against Mehmet Emin Adıyaman.

(12/244) Journalist on Trial in Hakkari…

The final trial of the case against Mezopotamya News Agency reporter Hamza Gündüz, for social media posts, is held on Hakkari Heavy Penal Court No 3 on December 18, 2018. The court sentenced Hamza Gündüz to 1 year and 8 months for ‘making propaganda for an illegal organisation! And suspended the sentence.

(12/245) Kızıltepe JİTEM Case…

The case against 4 military members and 5 temporary village guards, for the crimes committed by Gendarmerie Intelligence and Anti-Terror Unit members between 1992 and 1996 in Kızıltepe district of Mardin, is held on Ankara Heavy Penal Court No 5 on December 18, 2018.

The indictment demands sentence for retired colonel Hasan Atilla Uğur; Diyarbakır Gendarmerie Commander Eşref Hatipoğlu; Gendarmerie Company Commander Ahmet Boncuk; master sergeant Ünal Alkan and village guards Abdurrahman Kurğa, Mehmet Emin Kurğa, Ramazan Çetin, Mehmet Salih Kılınçaslan and İsmet Kandemir for ‘establishing or leading an armed organisation’, ‘being member to an armed organisation’ and ‘purposely killing’.

The court decided to grant time for the prosecutor for preparing opinion as to accusations and adjourned the trial to April 11, 2019.

(12/246) Detentions and Arrests in Alleged Link to Coup Attempt…

On December 18, 2018, 4 students of military medical faculty are detained in operations covering 6 cities through a Sivas based investigation; 15 people including military members on active duty are detained in operations covering 7 cities through a Şırnak based investigation; and 16 people including bailiffs are detained in house raids in Kayseri.

118 of 191 people who were detained through an Istanbul based investigation on Turkish Armed Forces personnel, are arrested by the court on December 18, 2018. 73 people are released provided that 42 of them on judicial control conditions.

(12/247) Trials in Alleged Link to Coup Attempt…

The final trial of the case against Selman Gülen, Fetullah Gülen’s nephew, on Ankara Heavy Penal Court No 22 is held on December 18, 2018. The court sentenced the defendant to 7 years and 6 months for ‘being an illegal organisation member’.

(12/248) Special Security Zone in Hakkari…

Hakkari Governorate made a declaration on December 18, 2018 and announced 30 areas with given coordinates in central, Çukurca, Şemdinli and Yüksekova districts as special security zones as of December 20, 2018 to January 3, 2019.
