(11/125) Fire Outbreak in a Raided House in Van…

It is learned from the news coverage of November 11, 2018 that police and gendarmerie raided the house of Mehmet Polat, in Erciş district of Van. It is stated in the news reports that a fire started at the house due to a gas bomb which was dropped to the house after residents were taken out, and that the fire damaged the house.

Mehmet Polat, in his statements covered by the news reports, remarks the following: “Our house was raided at midnight; they took us from our beds out of the house without proper clothes and socks. They dropped gas bombs into our house from the door and the windows. They searched the house. My daughter is getting married next week, and all her belongings she prepared for wedding is burned down and useless now”.

(11/126) Person was Subjected to Police Violence in Diyarbakır…

It is learned from the news coverage of November 9, 2018 that, Rıdvan Toktaş, a member of People’s Democratic Party (HDP) Youth Assembly, was attempted to be detained by a person claiming to be a police officer in Yenişehir district of Diyarbakır on October 29, 2018. It is also learned that Rıdvan Toktaş was handcuffed behind his back and forced to lie down by a group of people with long barrelled weapons who came around by a “Ranger” car, and was forcefully put in a car and detained. It is stated in the news reports that Rıdvan Toktaş was subjected to physical violence in the car where they hold a gun against his head. It is learned that Rıdvan Toktaş was subjected to physical violence under custody too, along with being forced to be a police informant; and that he was not allowed to talk to the doctor at the hospital where he was taken for compulsory medical examination. It is learned that the doctor gave him a report that does not evidence the physical violence.

It is claimed in the news reports that Rıdvan Toktaş applied to the hospital once again after being released to inform the doctor about the police violence he was subjected to, and that the doctor called the police upon Toktaş’s request of medical report evidencing the physical violence.

(11/127) Operations and Attacks in Southeast…

The Ministry of Defence declared that, 7 soldiers died and 25 soldiers got wounded due to explosion of ammunition during cannon shots at Süngü Tepe military base in rural areas of Şemdinli district of Hakkari on November 9, 2018. Şemdinli Criminal Court of Peace imposed a publication ban on the incident on November 9, 2018. The court argued that misinformation and fake images have been broadcasted in the news coverage and stated the following: “In order not to prevent proper investigation, not to influence the public in a negative way, and considering the severity of the incident along with public order and safety, the request of Şemdinli Public Prosecutor’s Office for a publication ban including any kind of news reports, interviews, commentaries and footage in printed, visual and social media in accordance with the article 3/2 of the law number 5187 is considered to be lawful and formal and thus admissible”.

It is learned from the news coverage of November 9, 2018 that 7 militants died in a clash in rural areas of Şırnak between October 31, 2018 and November 3, 2018.

It is learned that 2 soldiers died and 5 soldiers got wounded in a bombing attack during a military operation in Gabar Mountain in Şırnak on November 11, 2018.

(11/128) Torture and Ill-Treatment in Prison…

It is learned from the news coverage of November 10, 2018 that 4 prisoners including 2 ill prisoners who were transferred to Manisa T Type Prison, were subjected to physical violence when they reject strip search to which they were forced to at the entrance of the prison. It is reported that Şemsettin Erdem, one of the prisoners, have fainted due to violence. It is also stated in the news reports that prisoners were kept in solitary cells although they demand to be put in political prisoners’ wards; that they were not given food regularly, their chairs in the cells were taken, they were forced to stand up during roll-calls and the medication they need were not given to them.

It is learned from the news coverage of November 10, 2018 that Diyarbakır E Type Prison administration initiated a disciplinary proceeding against Leyla Güven, Democratic Society Congress (DTK) co-chair and People’s Democratic Party (HDP) Hakkari MP, who went on an indefinite hunger strike on November 7, 2018, in order to protest isolation of PKK leader Abdullah Öcalan.

It is claimed in the news coverage of November 9, 2018 that Mahmut Aktaş, a prisoner with cardiac disease in Kırıklar F Type Prison No 1, was prevented from having the operation, which is necessary to be done within 6 months according to doctors, on the grounds of “inefficient budget”.

(11/130) Coercion to Uniforms and Reactions Against This…

The press declaration of TAYAD (Prisoner’s Families’ Solidarity Association) members attempted to be held in Sakarya Street in Ankara on November 10, 2018 against uniform coercion in prisons is prevented by the police. It is reported that 2 people (Halil İbrahim Şener and Ertuğrul Çağan) were detained in police intervention.

(11/131) Rejection to Meeting Request with Abdullah Öcalan…

It is learned that the appeal made on November 9, 2018 to chief public prosecutor’s office in Bursa by PKK leader Abdullah Öcalan’s tutelary and lawyer in order to visit their client was rejected the same day on the grounds of limitations for prisoners in accordance with the law on the execution of sentences and security measures (law no 5275).

(11/132) Police Intervention Against “I Want My Job Back” Protest in Ankara…

The police intervened the press declaration of public labourers who had been dismissed by a state of emergency decree and have been struggling 733 days to regain their jobs, intended to be held in front of Human Rights Monument in Yüksel Street on November 9, 10, and 11, 2018 at 13.30 and 18.00.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on November 9, 2018, 4 people (Alev Dersulu, Gülnaz Bozkurt, Alev Şahin and Nazan Bozkurt) and at 18.00 4 people (Alev Şahin, Derviş Lermi, Gülnaz Bozkurt and Nazan Bozkurt) were detained.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on November 10, 2018, 3 people (Alev Şahin, Gülnaz Bozkurt and Derviş Lermi) and at 18.00 4 people (Mehmet Dersulu, Gülnaz Bozkurt, Nazan Bozkurt and Alev Şahin) were detained.

It was reported that during police intervention against the press declaration which was planned to be held at 13.30 on November 11, 2018, 3 people (Nazan Bozkurt, Derviş Lermi and Mehmet Dersulu) and at 18.00 4 people (Alev Şahin, Derviş Lermi, Gülnaz Bozkurt and Mehmet Dersulu) were detained.

Thus in total 22 people were detained due to press declaration intended to be held in Yüksel Street on November 9, 10, and 11, 2018. It is learned that detainees were released the same day.

(11/133) Police Intervention Against Saturday Mothers’ Protest in Istanbul…

Police obstructed all the streets around Galatasaray Square in Istanbul to prevent Saturday Mothers who rally every Saturday for 23 years in the same place to gather for the 711st time on November 10, 2018. Upon police prevention, the group including parliament members, representatives of political parties, human rights defenders and artists along with families of disappeared people gather in front of Human Rights Association (IHD) Istanbul office and started to march. The police prevented the march too, thus, the group had a sit-in protest and made a press declaration there.

(11/134) Prevention of Human Rights Defenders’ Event in Istanbul…

 “F sit-in”, which is organized for the 346th time by Human Rights Association (IHD) Istanbul Branch Prisons Committee, to demand release of ill prisoners, on November 10, 2018 is prevented by the police. Human rights defenders who attempt to march to Galatasaray Square from IHD office are prevented by the police and made a press declaration in front of IHD office.

(11/135) Police Intervention Against a Protest in Istanbul…

Türkan Albayrak, who was dismissed from her job at Sarıyer district Health Department, on the grounds of ‘personnel security investigation’ and ‘archive search’, on August 3, 2018; made a press declaration to regain her job on November 9, 2018 and attempted for a sit-in protest in front of Health Department. The police intervened the sit-in and detained Türkan Albayrak. It is learned that Türkan Albayrak was released the same day. It is the 42nd time of detention of Türkan Albayrak.

(11/136) Police Raid to İdil Cultural Center…

İdil Cultural Center in Şişli district of Istanbul is raided by the police on November 9, 2018. It is learned that the books and belongings were scattered around. 10 people are detained in the raid. The names of the people detained are: Meral Hır, Ezgi Kul, Beyhan Gün, Aslıhan Diş, Yaşar Coşkun Karadağ, Orhan Acar, Dehman Göçer, İrem Mağden, Nuri Cihanyandı and Duygu Yasinoğlu.

People’s Law Office announced that the police did not provide water, sugar and medication to the detainees.

Academician Cenk Yiğiter who was dismissed from Ankara University Law Faculty by a state of emergency decree because of signing “We will not be a party to this crime!” petition, is detained in Ankara on November 9, 2018.

(11/138) HDP Executive Detained in Istanbul…

People’s Democratic Party (HDP) Youth Assembly co-spokesperson Tuna Aydın, who was detained on November 9, 2018 in Istanbul, is arrested by the court on the grounds of ‘being an illegal organisation member’ on November 11, 2018.

(11/139) HDP’s MP Candidate is Detained in Antalya…

Gülseren Kaya, who was MP candidate of HDP for Istanbul’s voting district No 3 for the elections held on June 24, 2018; is detained in by the police raiding her family’s house in Kepez district of Antalya on November 10, 2018. The reason for detention is unknown.

5 of 12 people who were detained in house raids in Urfa on November 10, 2018, for social media posts, are arrested by the court on November 11, 2018. 7 people are released on judicial control conditions.

Melek Başkale, who was detained after visiting a relative in Urfa T Type Prison No 2 on November 10, 2018, is arrested by the court on the grounds of ‘making propaganda for an illegal organisation on social media’, on November 11, 2018.

On November 9, 2018, 9 people are detained in house raids in Menemen, Bergama, Seferihisar and Aliağa districts of İzmir, on the grounds of social media posts.

(11/143) HDP Executive is Detained in Tunceli…

8 people including HDP executive Ulvi Gültekin and Dere village’s local administrator Hayri Doğan, are detained in house raids in Pülümür and Pertek districts of Tunceli on November 9, 2018. The reason for detention is unknown. The names of detainees are: Ulvi Gültekin, Rıza Dalkılıç, Hayri Doğan, Taki Erdoğan, Kazım Yıldız, Adil Korkmaz, Ali Sarı, Erdem Doğru.

7 of 15 people who were detained in house raids in Tutak district of Ağrı on November 7, 2018, are arrested by the court for ‘being an illegal organisation member’ on November 11, 2018. 8 people are released.

(11/145) Person Arrested in Karabük for ‘Insulting Atatürk’…

İ.Ö., a student of Police Vocational Education Center (POMEM) who was detained in Karabük for ‘insulting Atatürk’ on November 10, 2018, is arrested by the court on the same day.

(11/146) Person Detained in Edirne for ‘Insulting Atatürk’…

It is learned that a person named E.Ş., who allegedly chanted “Atatürk is not God, God has rules. Atatürk brought rules of the West”, during the commemoration ceremony for Atatürk on November 10, 2018 in Edirne is detained.

(11/147) Former HDP MP on Trial…

The case against Gülser Yıldırım, former Mardin MP of HDP, is held on November 9, 2018 on Mardin Heavy Penal Court No 3. Gülser Yıldırım rejected to join the trial via sound and vision system from Kocaeli F Type High Security Prison No 1. The court decided to continue detention for Gülser Yıldırım and adjourned the trial to November 30, 2018.

The final trial of the case against Assist. Professor Hakan Mertcan, Research Assistant Esin Gülsen, Assist. Professor Selim Çakmaklı and Assist. Professor Mustafa Şener, who were dismissed from Mersin University by a state of emergency decree, is held on November 10, 2018 on Mersin Heavy Penal Court No 2. The court acquitted Mustafa Şener, Hakan Mertcan and Esin Gülsen. The court sentenced Selim Çakmaklı to 1 year and 3 months for ‘making propaganda for an illegal organisation’ and deterred the announcement of the verdict.

The final trial of the case against journalist Sedat Sur, for the news reports he made on trustee appointed to Mardin Municipality, is held on November 9, 2018 on Mardin Penal Court of First Instance No 2. The court sentenced Sedat Sur to 11 months and 20 days.

(11/150) Anti-homophobia, anti-biphobia and anti-transphobia activists on Trial in Istanbul…

The case against 25 anti-homophobia, anti-biphobia and anti-transphobia activists for attending 2017 LGBT+ Pride despite of Istanbul governorate’s ban, is held on Istanbul Penal Court of First Instance No 48 on November 8, 2018. The court issued a warrant for 6 people absent from trials and adjourned the trial to February 21, 2019.

(11/151) Police Officer on Trial for Mazlum Tura’s Death…

The case against police officer Süleyman E., for death of Mazlum Tura (16), who was shot by the police for disobeying stop warning on August 28, 2015, is held on November 9, 2018 on Mardin Heavy Penal Court No 1. The prosecutor declared the legal opinion and demanded life imprisonment for the police officer for ‘killing on eventual intent’. The lawyers demanded arrest of the defendant and the court rejected the demand, and adjourned the trial to January 18, 2019.
